If someone else shot Ronald Williamson and his girlfriend, Tracie Wallace, in the head and shoved them in a closet…how do you explain Hood’s bloody fingerprints being on the garbage bags in which Tracie’s body was found, on the closet door in which both bodies were hidden, and on the wieght machine that was propped against the closet door?

Or how do you explain that the day after the murders, Hood was picked up in Indiana driving one of his victim’s truck? Or that Hood had the been using the victim’s credit card and had cashed one of the victim’s checks? Or that Hood had pawned the victims’ jewlery after the murders?

So, convince me to join your campaign…what is your theory and what is your evidence that Hood did not commit these crimes?

I have no problems with people being against the dp based on religious, moral grounds. What I do object to and find down right offensive is when they lie about the facts, minimize the brutality of the crimes, and attack the victims.

Innocense isn’t even an issue here. Besides all the previous evidence of guilt: While the male victim was calling 911, Hood’s voice could be heard in the background on the 911 tape. The police arrived 4 minutes after the 911 call and found both victims shot and Hood no where to be found. Hood was already on parole for burglary when he skipped out to Texas with his 15 year old girlfriend. He told the girl’s mother that if she interfered, he would kill the girl. The girl said if she refused to have sex with Hood would rape her. A few days before the murders, he raped a different 16 year old girl and told her if she went to police he would kill her. So just spare me the character references.

Answer to II :
Thanks to have no problems with people who are against death penalty. I am deeply against DP. We all need to stay open mind, pro and anti, and we have to speak together because it is our world !

But I have to say that being abolitionist does not mean “minimize the brutality of the crimes”, and I never knew any abolitionist who ever attacked the victims ! Trying to save a killer does not mean refusing to consider his crime. It only mean that DP is NOT a solution. And this is not an offense to victims.

I will fight to save life of every inmate of the death row, guilty or innocent. This is our fight for the respect of human life. But the guilty must have another sentence, and the innocent must be free. This is our fight for justice.

About the Charles Dean Hood’s case, I know your arguments. These are the arguments of accusation during the trial. It would be too long to debate here about the trial, and unfortunately it is too late for that.

i am born with german citizenship and i never hat anything to do with amsterdam (u should get some better informations).
i got my american citizenship a couple years ago because i got married to a air force soldier who was stationed in germany.
after a couple years living in the us with my husband i got a phonecall from germany that my cousin got killed cause he was in a bar, trying to get between 2 guys who was arguing about nothing. i don´t wanna go to deep into details.

I checked the Office of the Attorney General press releases, and the only mention of Charles Hood is a PR from June 22nd that affirms the execution date.

Any notice of a stay would be posted here as well. Nor can I find a single Google News link that says there a stay has been ordered.

I would assume she heard it wrong. Yesterday, the USSC denied Hood’s petition for certiorari. There is no reason to issue a stay of execution if they are not going to accept the case.

I never met Charles myself nor am I familiar with his case. However, one would have to conclude, that the the bloody fingerprints leave a first impression of guilt. So nice therefore to learn that Hood is in fact a jocular, bi-lingual poet in need of company!

Just talked to a clerk at the Texas Court of Criminal Appeals…and, sadly, Hood has been granted a stay.

But, it has nothing to do with his possible innocence, rather it’s a procedural thing. Hopefully this will not prolong the inevitable too much.

And Eagle…you do know that nearly all newspapers are available online, right? And that Google News indexes those papers for you, so that you don’t have to read every paper to find the information you are looking for.

HUNTSVILLE, Texas — The Texas Court of Criminal Appeals has blocked the execution of an Indiana man who was scheduled to die Thursday for a double slaying in the Dallas area more than 15 years ago.

Charles Dean Hood, 35, would have been the 10th Texas prisoner put to death this year.

The appeals court delayed the punishment after lawyers argued jurors who determined Hood should be executed did not get proper instructions that would have allowed them to consider mitigating factors such as Hood’s difficult family life and childhood injuries and illnesses that left him brain-damaged.

The court order Monday came after the U.S. Supreme Court rejected another appeal that sought additional DNA testing on evidence used against him at his trial.

The state court ruling sends the case back to the trial court in Collin County.

Hood came to Texas in 1989 to work in construction and wound up as a bouncer at a topless club in Plano, a Dallas suburb. When he lost his job at the club, one of the bar’s patrons, Dallas computer company operator Ronald Williamson, let him stay at his Plano home and paid him to do odd jobs. One of the dancers at the bar, Tracie Lynn Wallace, also was living there.

Williamson, 46, and Wallace, 26, were found shot to death in the house Nov. 1, 1989.

Hood, 20 at the time of the slayings, was arrested in his native Vincennes, Ind., driving Williamson’s $70,000 Cadillac. He said he had Williamson’s permission to use the car and has insisted he was not responsible for their deaths.

“I’ve done a lot of stupid stuff in my life,” Hood said in a recent interview. “But I have never killed nobody.”

At least five other Texas inmates have execution dates over the next four months.

I checked the Court of Criminal Appeals website. It’s worthless. Google is now reporting it. I’m surprised that they granted review based on instructional error, if the news story is correct, since the defense had to be aware of it through the appeals and writs. The courts do not allow defendants to sit on their rights. I also question why it would be sent to the trial court if it is an appeal. So, all in all, it doesn’t make a whole lot of sense.

Better to hate “Murderers, terrorists, rapists, and drug dealers” as opposed to the euroweenies, who’s apparantly hate the women, the children, the elderly, all the victims, that these murderers pray on.

What does stand out in that news article, is that the murderer still shows absolutely no remorse for the murders.

Id like to tell everyone that reads your blog that the DP is the best thing a country (state in your case) can have !!
When we used to have the death penalty in SA we could leave our keys in our cars at shopping malls, sleep with windows open.
Everyone was just so damn scared of doing anything.

Then Nelson Mandela stepped in cancelled the DP and all hell broke loose after that.
In my family, my mother’s cousin, her 2 daughters (16)(10), and grandparents were all shot dead, they stole R200 which is equivalent to about $65.
The police caught the mudering bastards, and they got 15 years, they’ll be released in 2007 to rome the streets again !!!!

However, this evidence was undercut by the fact that the murders were premeditated and planned. Ultimately, the jury did not believe the old head injury excuse.

On March 2, 2005, the state court denied Hood’s motion seeking additional DNA testing on evidence used against him. The court denied it because it would in no way exonerate him. His attys then appealed the denial to the USSC. On June 27, 2005, the USSC refused to hear it. It was sent back to the trial court on another writ of habeas corpus which has nothing to do with dna.

Lets get to the bottom of this! Charles D. Hood’s constitutional were definately violated. He did not get a fair trial. Whether a person is guilty or not, they still deserve a fair trial. The circumstances surrounding this case need to be properly presented to the courts. Every single American has rights and they need to be exercised at all times, regardless of the crime. Maybe if everyone took a look at the Constitution, there would not be so much arguing. People, please educate yourself before making these comments. The Constitution is the supreme law of the land and must be followed by everyone. If someone violates the Constituion, it IS grounds for a mis trail and therefore a new trial must be sought. Obviously, there was some violation of Hood’s rights, that’s why he was granted a new trial.

Hood received a fair trial. It is patently untrue that “if someone violates the Constitution, is IS grounds for a mistrail (sic).” Furthermore, a mistrail (sic) occurs during a trial, not 15 years later during appellate review.

It’s rather silly of you to tell others to “look at the Constitution” when it is apparent that you haven’t. Nor would you understand it if you did. Here’s a clue: You’re interpretation of the Constitution is irrelevant and undoubtedly wrong. It’s the state and federal court’s interpretation that matters here, something you clearly have no knowledge of.

2 is right on…Hood’s stay and appeal was granted on the sentencing phase of the trial. In other words, there is noquestions as to his guilt. A second jury will just as easily and quickly determine the same thing. And, under proper instruction, he will once again be sentenced to death.

Only this time, they should immediately drag him out behind the court house and put a bullet in his ear, as he has been enough of a burden on soceity for long enough.

Robbie is correct in that this order only affects the sentencing. However, all that happened is that the Texas Court of Criminal Appeals, remanded the case back to the trial court for findings of fact and conclusions of law. There has been no finding of error, no reversal of the death sentence, and no granting of a new trial.

Here’s the thing Amy…I acknowledge that there have been instances where a person was executed that was not responsible for the crime that they were executed for. But those instances are becoming more and more rare. As forensic science has evolved, and the use of DNA testing has become more acceptable and widespread, fewer and fewer criminals are being wrongly convicted.

But, forensic or “scientific” evidence is not the most “creditable” [sic] type of evidence for convicting criminals. I’d say admissions of guilt, video/surveillance footage of the crime in progress, and multiple-witnesses testimonies are all more convincing than “scientific” evidence.

But in Hood’s case, there was scientific evidence of his guilt — his own damn bloody fingerprints were found all over the crime scene. Hood wants some items that are irrelevant to the crime to be tested. A court has deemed that his appeal to have these irrelevant items tested is merely a stalling tactic. Besides, if you had any idea of what you were talking about, you would know that the stay is based on a procedural issue in the sentencing phase of the trial AFTER the jury had already found Hood guilty of the horrendous crimes he was charged with.

The only thing Hood deserves at this point is to be strapped to that gurney in Huntsville as soon as possible and administered a lethal dose of justice.

Has anyone heard whats up with Hoods stay? I know they have 120 days to review and they will probably take the whole alloted time, and then some.

Hood told his brother from Nebraska last year on a visit over the Holidays that he was sorry he did this. This is from a reliable source who is related to Hood’s brother so Hood is obviously guilty and he does feel remorse for what he did but he also deserves to be punished for his crime! Hood comes from a nice family and I really feel sorry for what they are going through but I cant imagine what the two victims families are going through by having to re-live this all again. The only closure for everybody is when Hood recieves his punishment which is the needle. May the Lord comfort the victims families, Hood’s family and Hood himself. The case is back at the state level according to Karen Martin OAG office. No new news to report. As I do follow the case as it was my BABY SISTER THAT PIECE OF SHIT MURDERED! Just an update…

I spoke with Jeff Garon at the Collin County DA’s office. Their office has filed their answer to Hood’s subsequent application for writ of habeas corpus. He and Hood’s attorney are working on the “Findings of fact and conclusion of law”, which is due on November 23rd to the trial court judge.

The trial court judge will review the document and make a recommendation to the Court of Criminal Appeals. The Court of Criminal Appeals will then issue the final ruling.

No telling how long that will take as the CCA has no deadline!!!

I just took some time to read over the above blog again (it has been months since I read it) and something confuses me. Some people are making the arguement that Chuck might be mildly retarded. It says in his ad that he can read and write english and spanish. It also says that he enjoys “poetry & novels”. Does this sound like the words of a “mildly retarded man”? I am an educated man and sometimes struggle with a second language. I also know that it takes intelligence to actually enjoy poetry. UPDATE:

We just heard that the trial judge is recommending a new punishment hearing for
Hood. This is not final unless the Texas Court of Criminal Appeals agrees with the
trial judge. This does not affect his guilty conviction, only the punishment
portion. I’m sure the Collin County District Attorney’s office will file
objections to this recommendation.

This happened because Hood had the same jury instructions which have been found to
be faulty in many other cases by the United States Supreme Court.

If the Court of Criminal Appeals reverses the punishment conviction, I imagine the
Collin County DA’s office will have another one and seek the death penalty again.
We will be sure to keep you notified and make sure you know what is going on.

The final ruling could take weeks or months, but I will let you know as soon as I
hear what it is.

Somewhere down the line, I read arguments as to the alleged error in the jury instructions. I think it’s b.s. Regardless, if he gets a new penalty trial, the jury will still come back with death.

The female victim in this case was once my girlfriend’s closest friend. We talked about the murders at length over dinner in California last summer. It was probably the only sullen conversation during a magnificent summer exploration of the pacific northwest.

It’s my understanding that the girl who was killed was an exceptionally nice person that was wasted in cold blood. My girlfriend is still quite disturbed by it. Chuck is guilty. He needs a one way ticket to the land of wind and ghosts. Surely we can do without another stalker/rapist/rage-killer.

4) Hood is found driving the victims truck, cashing their checks, using their credit cards, and pawing their jewlery after the murders.

Just bounced across this today and wanted to say my piece. I don’t know Charles and I don’t know this case or anyone directly involved in it.

Hear’s what I do know. I know that the families of the victims probably still feel the loss of their loved ones. I know that there have been comments about the lives they lead. That doesn’t change how they feel about thier loss or how they loved thier family members.

I do know a man named James, brother of Charles. He is a good, honest and kind man. He works hard and has a good sense of humor. Yes he’s not perfect but he is a good man and he too feels a loss. Not a loss of his own doing but a loss just the same. There are victims everywhere from the boy who won’t know his dad to the sister that won’t see her sibling grow up to the man who’s brother will most likely be put to death. Please show a little respect for all the victims involved. In the case of James, he’s earned it and deserves it. I wouldn’t want to walk a step in his shoes let alone a mile.

You say you don’t know about the case, or anyone directly involved but you know James. I find that hard to believe that you don’t know more that what you are letting on. How well do you know James? Is he your neighbor? Do you work with him? We do miss our loved ones, and James will feel what Ron Williamson son and I have felt for the last 17 years. You talk about respect for all the victims involved, and what makes you say that James has earned respect and deserves it more than myself and my family as well as Mr. Williamson sons. You wouldn’t want to walk a step in his shoes try mine! I buried my baby sister, the state will bury James brother. At least James can talk to his brother, I haven’t been able to talk with my sister for all this time and to watch the suffering of my Mom and other sister. If you ever have had to bury a loved one you know what I mean.

And that justifies your disrespect to James. The justice system will do it’s part and you may or may not agree with it. You might try to judge James based on his actions rather than those of his brother. I worked with James for many years. Your disrespect for him is not warranted. You may feel you have reason to dispise his brother but do any of us really want to be judged on the actions of others rather than our own actions? I doubt it.

I never said you or your loved ones did not deserve respect. Don’t know you. I also never said that James deserves more than you or your loved ones. I only stated some of his qualities and that he has and that he too feels a loss and will one day feel a greater loss.

No I would not like to walk in your shoes nor in the shoes of anyone else any where. It’s tough enough dealing with my own mistakes so why would I like to deal with someone elses. Knowing that you carry a burden for someone elses actions why would you want to heap additional burden on someone else for actions not their own.

How many motions for counsil can one make? Seems like nobody is good enough for him as he keeps requesting new counsil, hmmmm maybe because he is a liar and nobody wants to represent him. Hoping to hear something soon, it has been almost a year since he received his “Stay” WHAT A CROCK OF SHIT.

This is what I received from Victim services re: Hood

I’m so sorry this case has gone back to state court, and how long the process takes.
The Court of Criminal Appeals received the record from state court and ordered Hood
to file his brief by May and the State to file its response 30 after that.

I don’t have access to the documents in state court, but it looks like he did file
his brief by May 4th. The court told the parties to brief the merits of the issue
regarding the jury instruction claim. The court also told them to brief whether
this issue should have been raised in his previous appeal. That is good because
that means they want to see if this is abuse of the writ or if he can legitimately
raise this claim.

I will keep you notified as I hear information on the case.

SOON I HOPE! I know the wheels of justice turn slowly but this is crazy! I would never want an innocent person wronged for something they didn’t do, but Hood is guilty for his crimes, the evidence was just overwhelming, even the jury felt he was guilty, there is just a question of the sentencing phase. I want to see that he gets the same deal that he dealt my sister and Ron. What ever way this turns out he will never get to hurt another innocent person. As an outsider I write…although I do have personal feelings regarding issues like this, my grandfather was murdered in somewhat of a similar story and the man got off for it, if you bible quoters find justice in that than what about “eye for an eye?” Is that not etched in time as well? My other grandfather was a child molestor and he was murdered in fact stabbed to death in the early morning, I believe that he got what he deserved…it is not about the killer but about the reasoning behind it…the fact that the victims in this case were “good” people and were murdered for nothing more than pennies is a sad fact! Listen, this man you guys are sitting here talking about is my uncle. Now, I don’t agree with what he did, and I may not know him so well but if he has changed, good for him. I may never get a chance to see him again and I know that the family of his victims wont get to see their family members either. I’m sorry and deeply feel for you. We all defend our families if we think we are right, but why do you wish to defend someone who has had a TOTAL DISREGARD for human life? I refuse to associate with one of my family members , because they to have a disregard for human life, life is so precious. I just recieved this update and wanted to share it for all that have been following this.
“I just wanted to let you know that the Court of Criminal Appeals has set
an argument date for Hood’s case on October 11, 2006. I will be there
to argue on behalf of the State, and I am not sure which one of his
attorneys will actually argue his case.

Unfortunately, there is no telling how long it will take the Court after
the argument to reach its decision, but it is progress. I know the
length of time a case can take to be resolved, especially one such as
this, is frustrating, but hang in there.

Often the tenor of an oral argument in an appellate court and the
questions they ask do not provide any idea of what the judges think of
the case or what the final decision of the court will be. I’ll be happy
to let you know how it goes, and I understand that several from the
Attorney General’s Office will attend.”

I’ve just finished reading the majority opinion and the dissenting opinions on Hood’s application for a Writ Of Habeas Corpus (which was denied by a 5-4 majority of the Texas Court of Criminal Appeals).

I’ll post an update and summary of those decisions later today. But in short, even though, his writ was denied, I would expect it to be reviewed and decided by the Supreme Court of the United States.

Dwayne Eddie Mathews was in a cast up past his elbow that covered his entire right dominant hand from injuries sustained on a construction job. Dwayne was investigated thoroughly and was not even inidicated in the crimes. Dean was angry with Dwayne for asking him to leave his home after Dean refused to keep a job, lied about the age of his girlfriend and continually took items from his residence and the surrounding residence and pawned them.

Dwayne has no violent history and a completely clear criminal history record. Dwayne testified,as did I, that we did not feel that Dean would have been capable of murder based on what we knew of him…only that he was capable of theft and laziness.

Dean had a rough childhood with a very strange family bringing him up. Dwayne and I hoped that evidence would be found that would explain the overwhelming evidence against Dean. But it was not. We we then and have always cooperated with the investigation and defense.

Based on the evidence, he committed these murders. Something obviously snapped that I did not see in him. I am glad he did not snap while living in my home the short time he did.

I have heard Dwayne’s name brought up, but never believed it. Just like the “letter from a concerned citizen” never believed that either.

My sister told me 10 days before she died that Hood made her uncomfortable he was a thief, lier and a lazy piece of shit that just wanted a free ride. I think that is why he snapped as he was told to leave again, and the greed just took over, he wanted what Ron had and was going to get it one way or the other. The chicken shit shot my sister in the head with a 22 cal. bullet while she was sleeping, cleaned up the mess in the bed, taped a garbage bag over her head and shoved her in a closet, the evidence he left was just so overwhelming, but of course he didn’t do it, somebody else did!

My grannie used to say you can trust a thief part of the time but never a liar! An Hood was both that and a rapist and murderer. Indeed he will never be free to harm another innocent person. He doesnt deserve to be imprisioned for the rest of his life either, he deserves the same punishment he delt out to Ron and Tracie.

The crime took place a few months from the time he lived at our place. During these few months we saw very little of him but to ask for us to store some stuff which we did not do because were afraid it was stolen. When Dean left the house, he was working at Taco Bell and living at a hotel…he stopped by a few weeks after he left and said he was working for Wranglers…a sleezy topless bar as a bouncer..which we thought was weird since he was underage….about all I can tell you.

Treva, the underage girlfriend would know more, but I have no clue how to get ahold of her. In fact, during their stay, she came to me saying that she was having a lot of pain upon urination. I told her I thought it was probably a UTI or a bladder infection, and I would take her to the hospital…that is when I found out she was under age. I made her call her parents from a local payphone because I knew they would be worried. That may have been what lead to the police finding her and Dean at a local car wash and taking her into custody.

How did you and Dewayne know Charles? It doesn’t surprise me that he was working in a bar, he is manipulative and a very good liar. It is sometimes easy to work in a bar underage.

Finding Treva’s parents probably saved her life, as who know she too could have been harmed or murdered by Hood. She should be grateful if she isn’t.

Was not very nice either, I hope you read all the comments made by both sides. There were some personal attacks made by your husband, so that is where the anger comes in. I don’t know you or any of the family members of Dean. I don’t sit in judgement of them but first impressions are just that. Your husband very well may be a kind, compassionate loving father and husband but that is not the impression I got.

I think they call that Justice. I certainly hate the fact that such violence exists, but violence is a part of human existance, it just a matter of at what level does it exist in all of us. I look at it this way if Dean is like a vicious animal in the pound, and is unable to live within society’s rules and would harm, mame, murder just like he has in the past then he should and will be put down, why should we as american taxpayers support them? Dean was given many opportunities to turn his life around and chose not to, so he is where he belongs, but to live until he dies a natural death, when for so long my sister Tracie and Ron were denied that right to live a long life.

My sister was 26 yrs old when her life was cut short, if she were alive today she would be 43 yrs old. I buried my sister as my mother was devistated and still has a difficult time dealing with her death. Dean has denied and shows no remorse for the deed he has done. The difference is ” we ” who live within societies rules don’t lie, mame, rape, and murder our fellow man/women. I could go on and on.

dear bigsis, do you really believe that you and your mother are getting “justice” because I don’t. It seems to me that this death sentence has claimed many more victims on both sides. I know a wild ,viscous dog wouldn’t be reprieved for some 17 years and to bask in some pseudo celebrity status. I personally don’t believe in the death penalty, your loss is far too great to add a further 17+ years before you can even begin to heal properly! Friend, “the law is the law” argument doesn’t stand up. If we didn’t question our lawmakers and laws and blindly accepted everything they enacted there would be no change or any improvement. The “death penalty” was law in the UK and Australia until the mid 60’s, since its abolition murder rates have fallen markedly.In the UK the police don’t even carry guns! Friend, your laws need changing not supporting , then maybe your horrendous crime rates may fall also.

Your entitled to your opinion Big E, but that does not change the facts that he not only took 1 life but 2, he has no regard for human life nor has he ever shown any remorse for his actions, nor will he ever. It is not right that we american taxpayers have to “support” these animals. They do the crime but then try every trick in the book to get out of punishment. There is no Rehabilitation possibilities. My point is why does it take 17 years of yoyo land to confirm a sentence? “Justice” in the states is one disgusting moneymaking enterprise, and you are the unfortunate pawns in this evil game. Prolongation seeks to serve the legal proffession firstly, the victims are well down the list. I would presume the costs of all these legal cases would have far outweighed paying for this guy being locked up forever from day one.

Every one has rights and he has the right to try and get out of his sentence. I agree that the legal profession profits greatly, and the costs of all these legal cases probably do cost more than if he were just locked up for life, but he would still have his right to appeal. Everything has a price in this world. The sentence is confirmed he just doesn’t want it to happen…..he could dish out his own form of a DP with the murder of my sister and her friend Ron. It costs an average of 35000 a year to house an inmate, thats 420,000 a year.

Big Sis – I applaud you on the bravery and strength of character you have so aptly displayed on your many entries to this blog. It is empowering to hear the views of someone as directly involved in this terrible crime, as opposed to the trite – and quite frankly boring – delusional bleatings of the morons who profess the innocence of an undeniably guilty man.

Also, well done Robbie for creating a place on the web in direct opposition to the many Scumpal sites I staggeringly happened upon after reading about a similar case – highlighted on these pages, regarding Jennifer Ertman and Elizabeth Pena (trying so so hard not to even type the names of the sadistic scum responsible).

Quite frankly the kind of person that seeks out such murdering scum, listens to their lies and then comes on these boards preaching about the virtues of forgiveness and the enduring quality of humanity that allows a sadistic monster to change for the better, does not deserve any kind of voice. However, thanks to the likes of Robbie, BigSis, JustMe (plenty others I’ve probably missed) they have been shown for the heartless, unsympathetic losers they really are. Never is any sympathy afforded to the victims or their families, never are their rights appealed for – they seek to make the actual perpetrator the real victim of the piece. And they will continue to do so on their contemptible Scumpal sites, even going as far as to placing a tribute video onto You Tube for one of the murderers of Jenny and Elizabeth!

So keep up the good work Robbie; supporters of humanity and those opposed to the dereliction of all human rights must have a place to air their views. And even when this foul piece of crap, Hood, finally gets whats coming to him we should carry on remembering the real victims of their crimes. For Hood, like all the others, a lethal injection is not enought. But by remembering the victims we also ensure the names and lives of these sick individuals remained forever stained!

OMG there is another sane person in the group. Darren thank you for your support and outlook on things. I have not heard anything further on an execution date for Hood, but rest assured you and everyone else that views this Blog will. Robbie has been a wonderful support, I thank him tremendosly for that support. This blog has given me an outlet for the frustration and lies that have existed from the wacko’s that defend an animal like Hood. Since my sister Tracie cannot speak or defend herself it is my loyalty to her that I speak out. She was truly a wonderful loving sister. Does anyone know the status of Charles’s case?

Nothing new to report on Dean’s status…it is in review once again with the courts, rest assured as soon as I know something, you all will know.

As far as my sister being friends with ToolGirly they were very good friends, close as sisters could get. Who ever is ranting and raving that she wasn’t is full of shit, obviously have their head shoved up their ass and can’t see the light of day.

Dean put her in the closet, his bloody fingerprints were on the door jam where he had shoved her. He had shot her in the head while she slept. Dean didn’t realize that head wounds bleed something aweful and he was trying to contain the blood. I also applaud you on the strength of character that you exhibit on this blog, I am sure that it was horrific to lose your sister, especially in the way that you did.
Why did that piece of garbage murder Traci while she slept, was it premeditated that he would then kill Ron when he came home for lunch. How could he possibly think that he could get away with this, especially seeing as he lived in the house. What was his true motive, robbery, jealousy, obviously he is not a very intelligent person.
Anyway, keep your head up, stay strong, and know that there are a lot of people in your corner hoping that justice will be served.

Thanks Ron for your support, it means alot. I think he thought he could get away with it because he did live there and it would have been normal to find his prints there. He didn’t want to work for what he wanted, he just wanted a free ride, and yes I think that envy was a very motivating factor. I do know that my sister was very uneasy around him, she told me that 10 days before she was murdered, I think he did premeditate to commit murder/robbery so he could get what he wanted. His intelligence is that of an ameba, which is none at all. That piece of shit will get what he deserves and I will be there to watch it, though lethal injection is to easy, somebody should creep into his cell and put a bullet in his brain just like he did to Tracie.

From what I have read about Texas death row, it is a horrible place to be, however the piece of shit is still alive. There must be some consolation that he has spent so many years living on the row, and being treated like the animal that he is. I live outside the US, and really do not understand how these killers can live on the row for so long. If you are guilty of the crime, you should pay for the crime, in a very short period of time ! Do you have any idea what is going on with his case, what is taking so long, he must have a good lawyer.

I think he changes lawyers frequently, due to the fact he cant tell the truth to even his lawyers. The appeal process can be a very long one, for a time he was kinda “lost” within the system. Our judicial system is slow due to all the “appeals” he is just stalling and we all know that but in no way do I want an innocent person to be punished for something they didn’t do. Time is definately on my side, He manipulates everychance he gets. Oh sure he whines that conditions are bad, hot in the summer and cold in the winter but I really don’t care that he lives like that it is some satisfaction to know he isn’t “comfortable”. He deserves everything he gets, what goes around will eventually come back around to you. I think they call that KARMA. He has bad karma for sure.

I have always taken care of myself, because if I don’t who will? I am very independant, know what I want, and work my butt off to get it. some of my friends say that I am just a very driven person. I refuse to be a leech on society, that’s not to say that I haven’t had help when it was needed but one has to pick themselves up by their boot straps and be a productive member of society. I’ve just finished reading the majority opinion and the dissenting opinions on Hood’s application for a Writ Of Habeas Corpus (which was denied by a 5-4 majority of the Texas Court of Criminal Appeals).

I’ll post an update and summary of those decisions later today. But in short, even though, his writ was denied, I would expect it to be reviewed and decided by the Supreme Court of the United States.

Dear big sis, this blog is an absolutely fascinating insight into understanding a little about what its like to live through this horrible scenario. Most of us can only guess at how we would feel if the crime had happened to one of our loved ones. Dean does have several sites where he can be seen, all thanks to the idiots that oppose the DP. They just glorify the trash that needs to be thrown away. Oh poor me…………I didn’t do it, I’m innocent, blah, blah, blah.

My thoughts on today’s kids, is they have no respect for themselves or the value of human life, they try and do take what they want without working for it. Seems to be a “give me, give me” world. The world owes you nothing, you appreciate more when you have had to earn it. I come from a family who basically only had a wonderful hardworking Mother that did everything she could to instill values and respect. I am the oldest of 3 children, I helped my mother raise and look after my siblings. My dad wasn’t around much, he was a selfish person when he was younger, and to this day still kinda is.

Through all the hardships that have occured in my life I strived to be a productive member of society. That certainly makes me no saint, I too have skeletons in my closet, just like everyone else for I am human and not perfect.

Let me tell you this: I was married at the age of 18 had a son who I stayed home with until he started school. My son’s dad worked and when the plant closed, we ended up on state aid. My then husband refused to take a job that paid less than what he was earning at the plant. I decided to go back to school, I never graduated from H.S.
but I do have a GED and attended college while my son was in school.
I worked doing odd jobs for gas money as my then husband refused to help me, he made it as difficult as he could, he tried to make me quit. When I want something bad enough, like a better way of life, I worked my ASS off to get there. I graduated from college with a 3.4 gpa and an associates in applied science. As my mom says “YOU’VE COME A LONG WAY BABY” There are no excuses for laziness, again it goes back to values. I have a picture of Tracie but not Ron. Since Robbie is the moderator for this blog I would most likely have to send it to him to post. I am sure that he would do that if asked to do so. HINT HINT ROBBIE!

Hey Everyone, this is just an update I received today. Just wanted to keep everyone in the circle.

The Court of Criminal Appeals’ ruling from January ended his challenge
to the jury instructions in State court.
After that he has 90 days to file for certiorari (or an extention) to
the United States Supreme Court.
Given that the division of the Texas judges and the fact that similar
issues are currently pending in the Supreme Court, I do expect that they
will challenge the Court of Criminal Appeals’ decision.
If he decides not to do that, he has no claim pending in either State or
Federal Court and the time would be appropriate to seek to set an
execution date, although you should not be suprized if he does file
something else before that time.
I will let you know as soon as anything occurs.

How long can this continue to go on, are you saying that he has another 90 days to appeal again. It seems never ending , what exactly is he appealing , or is this just a stall tactic ?
How about you , are you satisfied with the ruling ?

He only has about 30 days to make an appeal, which they think he will do, to me it is a stall tactic but justice will prevail. I am somewhat satisfied but would have been really satisfied if it had been an unanimous decision, then an execution date would have been set, but alas that did not occur. With 30 days to appeal, what happens after that? Does the appeal drag on and on and for how long? Do they make a decision, and then set a date for his execution? Or is there another court he can go thru to delay his death? How long in the future do they set the date for his execution? Is it months, years? I’m confused. Could someone on this blog help me with this? The legal stuff on this guy – animal I should say – has dragged on for YEARS!!!! When will it end!!!!

He will no doubt wait until the last minute to file an appeal, it does take some time for it to get on the docket. once he is out of appeals the execution date is set fairly quickly a minimum of thirty days but could be longer just depends. Yes it has dragged on for years, and we are all hoping it will end soon. Any time I hear from the courts on anything he is doing I post it here so we may all follow along.

He has 90 days from the date of the decision to file a petition for certiori in the USSC. It would be IAC for his lawyers not to file a petition. If you check the USSC website and do a name search under dockets, you will find it after it is filed. The Court will then make a decision to either grant or deny cert. If they grant cert., they will then set up a briefing schedule. I can’t predict if they will or will not grant cert. The fact that this is an issue in multiple cases, make me believe that they may. If they do grant cert., the earliest the opinion would be issued is late in the 2008 term (early summer).

Wow! I certainly hope it’s this summer and not next summer!

If they decide not to grant cert., it will be before summer. If they decide to grant cert., each side is given time to file briefs, a time for oral arguement is set, and then the opinion written and published. That would be in spring/early summer 2008.

Is there no limit as to the time each side is given to file briefs? and what about oral arguements. I know the system works slowly but that seems kind of ridiculous, a whole nother year will pass, which will make 18 -19 years that this will have dragged on, which is just down right frustrating, but it is one of those things I have no control over so………………………….. I just guess I will have to wait.

Unfortunately, the chances the ussc will grant cert is high since there are already similar issues before the court where cert was granted. I don’t know the name of those cases. Otherwise, I would check the ussc docket and see how close they are to being decided.

Hey I just got this from the DA’s office, just wanted to keep EVERYONE abreast of the situation.

“I just wanted to let you know that indeed, Hood filed a petition for
certiorari in the Supreme Court of the United States.
His argument is that the Court of Criminal Appeals decision that Hood
could have raised the issues a previously filed writ was not an
appropriate manner in which to resolve the case.

At this point, he is just asking the Supreme Court to review the case,
and the writ of certiorari is a document explaining why this case is so
important that the Supreme Court needs to hear it. If certiorari is
granted, then he must file a complete brief detailing all of the reasons
that the Supreme Court should reverse the Texas Court of Criminal
Appeals.”

I was doing research on Death row inmates and saw that Charles Hood was supposed to be executed on June 1. I wrote him a letter in May of that year to ask him if he was sorry and I asked him what it felt like to kill and was he sorry and did he accept Jesus. Our first two letters were not very nice and I got a letter from him and he was angry that I wrote him with those questions. I assumed he was guilty because he was scheduled for execution. When I read the story of the murders, there was nothing in there about a rape of any kind. As you know by now, Charles got a stay and is still alive and on Death Row. He has never once in all our letters admitted to the murders. I have asked him several questions about it and I was not in court to hear the argument but I advised him if he gets a new trial, to take the stand. If a person has nothing to hide, then they should hide nothing. We have become about as close as a person on death row and a pen pal can be. He sent me his picture with his brother and says how bad he feels that his boss, whom he lived with and his girlfriend were killed. The only thing that has not been answered for me is why he went home to Indiana with his boss’s car. He tells me that he let him use it all the time and that was not unusual. As far as the check, that was a small amount for a killer to take. He told me that he went to that bank all the time and they never called the teller to the trial. I feel so sorry for the Families of these two people who were murdered, but I think that Charles has the right to another trial. Before we kill someone for a crime, don’t we need to be 100% sure we have the right person? After all, he has been on death row for over 15 years and they haven’t executed him yet, mabe there is a reason why. He tells me that he is innocent and that his Attorneys are working on getting him a new trial. If he does get it, I may travel to Texas from Michigan just to see for myself. We have been writing each other for over two years now and I know that he believes in God and that he proclaims his innocence. I am old enough to be his Mother and we do not have a relationship of boyfriend/girlfriend, but just friends. He respects me and I respect him. I just have to know that he is guilty before I can be as angry as your other writers on here. Not everyone on death row is guilty, and DNA is now setting people free that didn’t do it after spending years trying to proclaim their innocence. Thank you, Darby

Dean is a liar, why would HIS bloody fingerprints be on the closet door where he had hidden my sisters body? Did Dean tell you about the flowers he bought for a girl he was infatuated with, using Ron’s credit card? Dean only lived at the house about a month or two…..and the amount of the check he cashed was 400.00. No my sister was not raped, autopsy confirmed that. My sister was shot in the head while she slept….. the mattress was full of blood.

How about his voice on the 911 call and Ron being murdered within 6 minutes of the call and Dean being gone….. an innocent person does not run, they have no reason to……. Dean also had a wound on his shoulder, where Ron must have tried to defend himself.

The note that was left was not written by my sister….. why would she mispell her own name if indeed she had written the note.

As far as another Trial…..I don’t think that will happen….. the reason he has not been executed is related to the sentencing phase….. he wants out of the execution and wants his sentence commuted to life.

I wrote him letters too, as an alias to see what he had to say, unlike you I do know the story….. not once thru the trial did he ever show any remorse, or sorrow. He has asked the families of the victims to commute his sentence to life now what do you think of that!

Do you really think he would admit he took innocent lives? You say you are just friends and you are old enough to be his mother, you must have lived a sheltered life or you are very gullible, what made you write to him in the first place? Was it because he is looking for “Pen Pals”, or that you are very religous and want to “save” him.

The evidence was so overwhelming it was not funny….. he has been found guilty that will not change, like I said his appeals concern the sentencing phase of the trial.

His request for DNA testing was denied, it wouldn’t change have changed the outcome of the trial.

I am glad he is where he is so he can no longer hurt innocent people. I will be there when they finally execute him.

• On the morning of the offense, Hood purchased flowers, using Williamson’s credit card and wearing the watch that Williamson usually kept locked in his safe.

• When Williamson called 911, he was talking to Hood during the phone call; Hood’s voice could be heard responding.

• Four minutes later, when the police responded, Williamson was dead and Hood was no longer on the premises.

• Tracing Williamson’s credit card, the police discovered that Hood was en route to Indiana to visit the woman to whom he sent the flowers.

• Hood stopped to cash two of Williamson’s business checks that he forged to himself, and to pawn one of Williamson’s rings.

• Hood arrived in Indiana in Williamson’s car, in which were many other items stolen from Williamson’s house.

Hood’s bloody fingerprints were found on the door to the room where Wallace’s body was found and on the trashbags in which her body was wrapped.

His fingerprints were on the note purportedly left by Wallace. These are not the fingerprints of someone who just happened to be living at the house; these are fingerprints demonstrating involvement in the crime.

Guilt has been established. Hood is arguing that the jury was erroneously instructed at the penalty phase. He’s been trying to claim that he is retarded. Did you know that, Darby? Of course not. Because he may be an uneducated a$$hole but he is not retarded. Hood deserves to die and will be executed. His only regret is for getting caught.

Big Sis, Thank you for your letter. Yes, Charles did tell me about your letters. You must live in Michigan because he thought that I was you. He asked me if I knew you because apprently I wrote him either just before or after you did. I don’t know you and so I told him that I never heard of you. I was doing research on Death Row in Texas in May of 2005. His scheduled date of execution was the first one that I saw on June 01, 2005.

I picked him because he was going to die. I thought that maybe he would tell me what makes people kill. In my research, most men and women who are on death row and going to die soon, admit and are sorry for their crimes. I didn’t even know that he denied killing anyone until I got his first letter. In that letter he told me that I had some nerve writing him a letter such as that and that he wished no one to be in his place BUT ME.

He said that he didn’t kill anyone and he seemed pretty mad that I had written with my questions. I wrote to him because I knew that he was going to die and that didn’t freighten me knowing that he would never get out and try to find me. I would never write to anyone in jail or prison that had a chance to get out.

I’m afraid of people who do bad things and are in Prison for it. When he got his stay, I was a bit concerned thinking that he may know someone on the outside that will get me, so I wrote him back and said I was sorry for the letter. My letter was a bit nasty and very hurtful. When I told my friends and family that I actually wrote to somone on Death Row, they thought that I was nuts! Anyway, I told him that I was sorry for assuming that because he is on Death Row, that he did it. I only read the story that is online about what happened.

I knew nothing about a 911 call and that he was heard in the background. I knew nothing about your sister being killed as she slept and that she was put in a closet. I knew no details at all, only that he was convicted of killing both of them and taking his car to Indiana. I am told by him that he was raised in Indiana and his Parents are there, He tells me that his Mother’s health isn’t that great. I feel very sorry for you and that your sister’s life came to such a dramatic and violent end at such a young age.

I do not believe in the Death Penalty though so if Charles did do this crime, I think that he should live out his life in Prison. Having said that, I wonder why he asked for DNA and why they refused to do the test? Do you know why they didn’t?

He tells me that he may indeed get a new trial, and that his Attorney says it looks pretty good for that. I know you think he is a liar and he may be. I am not a naive person at all and you needn’t say negative things about me just because I sought him out and am writing to him. I’m just not absolutely sure that he did it, and until I am I have to question.

If there is anything else you care to share with me about the trial, or evidence I would be very happy to read it and take it all in as I have your letter. I said in my last blog that one question that bothers me is why he went to Indiana in his Boss’s car. Why?? And they are dead in the house. But I have a reasonable doubt because of the DNA that he asked for and was denied. Can you help me?

To KMA, No I didn’t know until tonight that he has professed to be retarded. From the letters that I have received from him, and I have received dozens of them, he is absolutely NOT retarded in any way, shape, or form. His letters are solid, written very smartly and he has no handicap in his brain that I can see from his writing. You do not have to be nasty to me either just because I write to a convicted killer. I feel bad for all the Families including his because no one wins here.

I do have something else to say. To the people who think that Charles will rot in hell for what he did. Charles nor anyone else in this World answers to anyone but God. If he did this crime and has asked for forgiveness, he shall receive it.

I know that you are grieving and you have every right to do that. I know someone that was also murdered who was 27 years old and the guy is out walking the streets and he admitted it! His name was Joe and had a brother named Jim. After the guy that did it got out after only 6 years for Manslaughter, Jim found him twice and kicked his sorry ass. Last year, Jim drank so much and was found dead from drinking so much he was toxic. He blamed himself because he left his brother at the Bar that night, so I lost two friends because of the same guy so it’s not like I haven’t ever known anyone to get murdered by someone. I forgave him because I had to in order to be free from the hate that I felt towards him. He will pay for what he did if he didn’t ask for forgiveness too.

Charles does believe in God, or at least that is what he tells me and I believe him. What else do you have on Death Row but God and prayer?

There are only 4 people who know the truth, and it isn’t any of us. It is Charles, Ron, your sister, and God. Unfortunately, we aren’t going to hear from the two that are gone, and God isn’t going to come down here and tell you who did it, so that leaves Charles. He is the only living person who knows what happened that day.

Tell me something if you can…..Did they get a handwriting expert in there to determine if it was Charles’s handwriting on that letter? That would help me alot if I knew that they did and the expert said with a reasonable amount of certainty that it was in fact his handwriting. Even I know his handwriting by now. That is a big question that would help me a lot. I am trying to be fair and honest about this, and I know you are going to blast me but please don’t.

I know you loved your sister!! I know that she should be here!! I know that someone killed her!! Please try to get rid of the hate in your heart, it’s not helping you to get better. To you, Charles is dead anyway so you should think of it like that. He’s not having any fun where he is and you must know that. He’s a young man and it would seem to me that you would rather see him live out the rest of his long life in Prison in a cell with only one hour a day out of it rather than die and he’s free.

Wouldn’t it make you feel better that he will never get married, have children, play baseball, go camping, have a nice car and his freedom? He will never hear a bird chirp or see a mountain or a waterfall. He has lost everything but the air he breathes. For me, that would be enough. If he dies, he’s not suffering anymore. Is that what you really want is to watch this man die? Well, you may get that wish someday, but I guarantee you that it won’t make you feel much better.

Even if you are the last person that he lays his eyes on and you get to give him some crazy silly little gesture, it still won’t bring her back. Please stop the hate. There is one thing that I’m going to write to him about, and that is the letter that was left. We never talked about that and he never told me there was such a letter. Sometimes the littlest things are the important ones, at least with me. I have no doubt about Scott Peterson or David Westerfield because I watched the trials and every day got updates on evidence and got the whole story as it happened, the same for O.J.Simpson. I know in my heart those three are guilty of murder and there is no doubt at all in my mind. I just have a doubt in this murder because I wasn’t able to see the trial and didn’t even know that there was a murder until 15 years later whern I found Charles. Please indulge me a little. As for the DNA testing, It was denied because it wouldn’t have changed the outcome of the trial, that was written by the courts in there response to his request.

I am just curious as to what he had to say about me? Once he found out it was Tracie’s big sister, he never wrote anything back regarding his “innocence” I am an open minded person and I really wanted to know what he had to say about why he was on Death Row. Did he mail you copies of his appeal requests with all of his little notes on the side? He did me. The very first letter I received from him wasn’t even from him, it was written by another inmate asking for “help with his defense” I wrote him back and told him I didn’t appreciate it. This an absolutely true statement. If Charlie didn’t commit these murders, then someone else (the “real” killer) would know what happened, too. But, as it is, Charlie does know what really happened that day, because he was there and because he did those horrific things.

I SAID that I was doing research on Texas Death Row.com and found his name first on the list to be executed so I wrote to him. He has never asked me for money for his defense nor would I send him any. As far as anyone using his letters to me against him, dream on. The only thing Charles asked me was did I know you. I didn’t understand at first why he even asked me that. It wasn’t until later that I went back and re read the letter and figured it out. He thought that I was you writing to him because we both live in Michigan and we both wrote to him at the same time. I wrote him and assured him that I was not the sister of the murdered girl and it was just a coincidence that we both wrote to him at the same time. I will write to him about you and will certainly give you the satisfaction of telling you what he says about that. I’m going to send him a letter today. Once I am convinced that he killed them, you will be the second to know. Charles will be the first.

This is bothering me so bad I can’t tell you. I’m very mixed up. To answer your question about Scott Peterson, David Westerfield and O.J.Simpson…there was so much publicity about their trials that I can not really answer your question truthfully. I got to see the evidence and hear all the lies that were told but I waited until the end of all the evidence to come to a conclusion. I really do try to be fair.

I wish they would have televised Charles’s trial on Court TV because I watch it every day and know all the trials on that show. Right now I’m watching the Phil Spector trial. I have heard for the last 4 years about how he did it, but I am not going to make up my mind until it’s over. I don’t listen to public opinion, I just go by the facts of the case. I really need to know if they brought in an expert in handwriting to say if the writing of the letter matched Charles’s writing. And, if he killed your sister while Ron was not there, I wonder how he thought he would get away with no car, if Ron was out with the car. I certainly can hold my own, Robbie, KMA, and others are here to give me support. It seems that you doubt what evidence was/is. I too have served in 2 murder cases prior to my sister Tracie’s. I know what goes on too.

Dean had lived at the house for a short time, and knew the general routine of the house. Ron came home for lunch, Dean knew that he was going to be told to leave….. I got that straight from my sister, 10 days before she was murdered, Dean made her very nervous/afraid.

His fingerprints were on the letter, as far as a handwriting analysis I cant say for sure.

KMA pointed out to you evidence that was presented. Did Dean send you a copy of the ” concerned citizen letter” if not ask him to send you a copy, read it and tell me what you think…. This person NEVER came forward.

From what is stated in this Blog you should be able to figure it out that Dean is guilty. He will never get a totally new trial, it is just the sentencing phase.

In one of the letters he wrote to “Janelle” he stated he was Ron’s body guard, when in fact he was given a job as grounds keeper/handyman.

He also states that the judge and the DA were sleeping together….. it is hearsay….it was never brought up at any other appeal.

1. Stop calling it “research.” If you had investigated what you claim you did, you would not make a dumb comment that most prisoners on death row admit their crimes or have any doubt that Hood is guilty. Again, you did nothing to research the facts of his crime.

2. All mail leaving prisons is examined, and copied and forward to the prosecution by the correctional officers when it is incriminating. The only exception is legal mail. Since Hood is arguing that he is retarded, I am sure all his “solid” “smartly” written letters indicating that “he has no handicap in his brain” will be quite a help to the prosecution. 5. What makes you think they had to bring a handwriting expert in? Generally, in court they submit a known sample of a defendant’s handwriting and allow the trier of fact to compare the two. If Hood did not write the note, why didn’t he call an expert to testify that he did not write it? And, while you’re demanding questions be answered, you answer these:

Why his fingerprints were on the note?
Why his fingerprints were on the bag wrapping Tracy’s body?
Why his bloody fingerprints were on the door to the room where he had hidden Tracy’s body?
Why he was forging Williamson’s checks?
Why he was wearing Williamson’s watch?
Why he was using Williamson’s credit card?

I have been doing “research” on Death row for years and so I know that 9 out of 10 people are remorseful for what they did and also turn to God. I have read every last words from every one on Death Row in Texas and a few other states and that is where I get my information from, in their own words. I went to Texas Death Row and read every last one of them so please don’t tell me that I know nothing about criminals on death row. Since I am against the death penalty, it facinates me to read about it. Michigan does not have the death penalty so I picked Texas because they execute more than any other state. There are only 12 states that do not have it. I had doubts about Charles because I was trying to give him the benefit of the doubt after talking to him. I’m not even sure that my doubts are reasonable. Did you actually hear the 911 tape? You act like you were sitting front row at his trial and you weren’t EVEN there. As you should know, it is not up to Charles to prove he didn’t do it, but the state to prove that he did. I have to wonder why they didn’t bring in someone to check the handwriting on the letter, why he was denied DNA testing, and why they didn’t bring in anyone from the bank or the pawn shop to verify what he did. His prints were supposed to be in the house because he lived there. His bloody prints were NOT supposed to be there unless he found her body, touched her and then went around touching everything which would be a stupid thing to do. There is no such thing as a perfect murder and all of them make mistakes that get them in the end.

As far as his mail being sent to the court, that is bull and you know it. The man is a convicted killer and on death row. Why would the court care what he wrote to anyone? The jury spoke and convicted him. Unless Charles admitted it to anyone in a letter, it wouldn’t help any appeal he may have. His letters to me are not incriminating at all so no need to Thank me. He never once in any letter told me that he is retarded. I didn’t even know he was saying that until you told me.

You don’t know much about trials do you? A person is innocent until proven guilty. It was not up to Charles to bring in a handwriting expert or send the 911 tape for testing to make sure that it was his voice in the background. It is up to the Prosecutor to prove his guilt, not up to him to prove his innocence.

When the Judge and the Prosecutor are sleeping together, it can change a trial by not letting important information in like DNA, experts, and other evidence. He may have done it but he got a shabby trial and he deserves another one. The instructions are being questioned about his and other trials that were given the same instructions. It is a legitimate complaint when a mans life is on the line.

For the last two days, I have done much “research” on this trial. I have read this whole blog and the only thing in here is hate and yelling and disrespecting each other in here. There are no facts except the updates given on his case.

I believe that big sis is not the one who wrote to Charles but rather KMA. Big sis said it in this very blog but told me it was her that wrote to him. I wrote him and told him all this crap going on in here. When I hear from Charles, I will not discuss it with anyone in here. Big sis asked me to inform her and I said that I would until she wrote that I need to take my head out of the sand. I am sorry for the families that lost someone that day and I always will, but I came in here to read and I made a comment that I was writing to him and with that, I got blasted not only by you, but big sis and Robbie and I was not even talking to him.

After reading what I needed to read about the case, and that was not from this blog, I have come to a conclusion. He didn’t get a fair trial because of lots of issues, and his being retarded has nothing to do with it, if he is. I read enough to know if he is innocent or guilty, but no matter what any of us think, he still didn’t get a fair trial. He had a shabby Attorney and a Judge that liked to play with the Prosecutor. That is a fact and not hearsay from what I read straight from the court papers.

I started out with many doubts and now that I have read what I think I needed to read which were facts and not opinion, I have made up my mind. I’m sure that you don’t care how I feel so I will not give you the satisfaction of what my opinion is.

I’m surprised at Bigsis for saying that my head needs to come out of the sand. I never came in here to make trouble. Charles didn’t get a fair trial because he was denied evidence, and the jury instructions were in question. The Judge was playing with the Prosecutor and that could have made a difference on what was allowed in court and what wasn’t. According to what I read from a person from the court, that affair was not hearsay, but fact. He had a shabby Attorney and he deserves another trial, wheather he is guilty or innocent. Even the lowest of life has rights.

I wrote to Charles about all this blog and another thing, somebody lied to me. Bigsis told me that she wrote to him under the name Janell, but then said that a friend of hers did under the same name. Bigsis does not live in Michigan but KMA does. Why did you have to lie about it? I don’t care who writes to him or what he writes back. I only know that he thought that I was Janell for awhile, just because we are both in Michigan. Once you catch someone in a lie, you never have to believe anything more that they say.

I have learned more than you probably want me to. I’m done in here so you don’t have to write cruel things and act like little kids because my opinion didn’t agree with yours. I have read this entire blog and it offers nothing but opinions and no facts of the case except for the updates from the Court. Keasler, J., delivered the opinion of the Court joined by Keller, P.J., and Price, Womack, Johnson, Hervey, Holcomb, and Cochran, JJ. Meyers, J., did not participate.

O P I N I O N

Charles Dean Hood was convicted of capital murder and was sentenced to death. He filed a motion for forensic DNA testing, which the trial court denied. Hood appeals, arguing that the trial judge erred in various respects. We disagree and affirm the trial court’s judgment.

Facts

In the fall of 1989, [Hood] was living with his boss, Ronald Williamson, and his boss’ girlfriend, Tracie Wallace (the two victims in this case). On November 1, 1989, [Hood] was scheduled to report to work at 12:30 p.m. At 11:30 a.m., [Hood]’s boss came home for lunch and found a note allegedly from his girlfriend saying that she had gone jogging. However, Williamson apparently suspected something was wrong since Tracie’s name was misspelled on the note. Williamson called the police and told them that he believed that his girlfriend had been abducted. After the police arrived at the victims’ house, they found both Williamson and Wallace dead with gunshot wounds to their heads. [Hood]’s fingerprints were found on the “girlfriend’s” note, on garbage bags that had covered her dead body, and on documents that had been taken from his boss’ safe. [Hood] was also later found to be in possession of several items of Williamson’s property. (1)

Procedural History

Hood filed a motion for DNA testing on May 19, 2004. In it, he requested testing of eight different items: a tan jacket, two pillowcases, a pair of jeans, a T-shirt, a black jacket, a comforter, and a sponge. He attached to his motion an anonymous letter from a “Concerned Citizen” sent to the Collin County District Attorney in May 2003. The letter implies that Hood is innocent of the crime.

The State filed its response and proposed findings on August 23, 2004. The trial judge denied Hood’s motion on August 25 and signed the State’s proposed findings on September 8. The judge made the following findings:

• All eight items exist and are available for testing.

• Identity was an issue in the case.

• Hood must establish by a preponderance of the evidence that he would not have been convicted if exculpatory results had been obtained through DNA testing.

• Testing of the items could not provide results that could exculpate Hood.

• Hood would have been convicted even if evidence of forensic DNA testing had been presented at trial.

• Hood has not met his burden to show that he is seeking genetic testing for any reason other than to delay the execution of his sentence.

Two days later, Hood filed his own proposed findings and notice of appeal.

Analysis

In his first point of error, Hood argues that the trial judge applied the wrong burden of proof. He complains that the judge required him to establish “by a preponderance of the evidence that he would not have been convicted if exculpatory results had been obtained through DNA testing.” According to Hood, applying this burden of proof required him to “actually establish” that he would not have been convicted. But, Hood argues, he should have been required to prove only a “probability” that he would not have been convicted.

Hood’s argument fails because he relies on an outdated version of the statute. The former version of Art. 64.03 required a convicted person to establish by a preponderance of the evidence that “a reasonable probability exists that the person would not have been prosecuted or convicted if exculpatory results had been obtained through DNA testing.” (2) But the Legislature amended the statute effective September 1, 2003. (3) The statute now requires a convicted person to establish by a preponderance of the evidence that “the person would not have been convicted if exculpatory results had been obtained through DNA testing.” (4) The current statute applies to cases in which the DNA motion was filed after the statute’s effective date. (5) Hood’s motion was filed May 19, 2004. The trial judge therefore applied the correct statute and the correct burden of proof.

Additionally, Hood is mistaken that this burden of proof requires him “to actually establish” that he would not have been convicted. The statute is clear that the burden of proof is preponderance of the evidence. Hood’s first point of error is overruled.

In his second and third points, Hood contends that the trial judge erred in finding that DNA results would not be exculpatory and that he would have been convicted even with DNA testing. Hood claims that the evidence of his fingerprints at the home is not persuasive because he lived at the home. He argues that there was also evidence of unknown fingerprints in the home and that the murder weapon was never found. Hood argues that Andrew “Andy” Yourston, Wallace’s former boyfriend, had a motive for killing the two. Additionally, the “concerned citizen” letter suggests that the killer was named “Randy,” which is close to “Andy.”

We reject Hood’s argument because the evidence at trial conclusively established Hood’s guilt. In addition to the evidence mentioned above, there was evidence that:

• On the morning of the offense, Hood purchased flowers, using Williamson’s credit card and wearing the watch that Williamson usually kept locked in his safe.

• When Williamson called 911, he was talking to Hood during the phone call; Hood’s voice could be heard responding.

• Four minutes later, when the police responded, Williamson was dead and Hood was no longer on the premises.

• Tracing Williamson’s credit card, the police discovered that Hood was en route to Indiana to visit the woman to whom he sent the flowers.

• Hood stopped to cash two of Williamson’s business checks that he forged to himself, and to pawn one of Williamson’s rings.

• Hood arrived in Indiana in Williamson’s car, in which were many other items stolen from Williamson’s house.

Even if DNA tests revealed the blood of another individual at the crime scene – even Andrew Yourston – that evidence would at most establish that Hood acted with someone else in committing the crime. Hood’s bloody fingerprints were found on the door to the room where Wallace’s body was found and on the trashbags in which her body was wrapped. His fingerprints were on the note purportedly left by Wallace. These are not the fingerprints of someone who just happened to be living at the house; these are fingerprints demonstrating involvement in the crime. Hood’s voice was on the 911 tape recorded minutes before Williamson’s death, and Hood was then nowhere to be found when the police arrived. Hood was later apprehended in Indiana after leaving a trail of purchases with Williamson’s credit card and possessing numerous items from the home, including Williamson’s car. Hood fails to establish by a preponderance of the evidence that he would not have been convicted if exculpatory results had been obtained through DNA testing. We overrule Hood’s second and third points of error.

In his fourth and final point of error, Hood argues that the trial court erred in finding that his only reason for seeking DNA testing was to delay the execution of his sentence. We have already concluded that Hood fails to establish by a preponderance of the evidence that he would not have been convicted if exculpatory results had been obtained through DNA testing. As a result, he cannot establish that the trial judge erred in denying his motion for DNA testing. We therefore need not decide whether his motion was made to unreasonably delay the execution of his sentence. Hood’s fourth point of error is overruled.

Conclusion

The trial court did not err in denying Hood’s motion for forensic DNA testing. We affirm the trial court’s order.

I am writing this on behalf of my sister, who has been banned by the owner of this blog, Robbie. I don’t know if this will even get in but she wanted me to tell you that she has read everything she needs to read, including the above and has come to a conclusion. The evidence against Charles Hood is very strong. She wanted me to tell KMA that no, she does not think that every trial that is on Court TV means that she does not believe or consider. She also wanted me to convey that the name calling such as “botoy” and other things was unfair just because she didn’t agree with your opinion. The one thing that I would like to say it this…You said that one of the tem Commandments is “Thou shalt not kill” but you said that if the state does it as a legal execution it’s OK. I don’t know when God changed that Commandment and it’s not OK to kill anyone no matter what he or she did. Since you asked me so many stupid questions, let me ask you one. How come Charles got a stay over 2 years ago and is not scheduled to be executed yet? What’s the problem if he is so guilty?

Do you know how many men were executed only later to be found not guilty by DNA? Do you know how many men are now being freed after spending years on Death Row denying that they did it but there was proof at their trials that they did?

I know that Charles’s bloody prints were in the house and I already said that I have an opinion as to his guilt or innocence, BUT he still did not get a fair trial and that is my beef.

Since the death penalty was reinstated here in Texas, not a single person who has been executed has ever been proven innocent or exonerated after their execution.

Want to name some names? How about cites and links to the court documents that exonerated them.

Robbie, I believe that the death sentence was re instated in 1976. Since then, they may not have exonerated, but their innocence has certainly been questioned.

Carlos Deluna convicted in 1983 and executed in 1989. Ruben Cantu convicted in 1985 and executed in 1993, David Spence convicted in 1984 and executed in 1997 , Gary Graham convicted in 1981 and executed in 2000, and Cameron Willingham convicted in 1981 and executed in 2004.

I have read about them and there were many questions and articles about their innocence after the fact. What a shame that there were so many questions and yet they still put them to death. One of them, after his execution had a guy come forward who knew who really did it and stated that Texas has put an innocent man to death. Why he didn’t show up for the trial is a mystery.

I just think that before we put someone to death, we better be 100% sure we have the right person.
If there is a single little doubt, then it should be investagated until there is not a single doubt. You already know that I do not believe in the death penalty so to hear that some people may have been put to death for a crime they did not commit is just plain sad.

He got a stay because Lawyers argued Jurors who determined Charles should be executed did not get proper instructions that would have allowed them to consider mitigating factors such as Charles’s difficult family life and childhood injuries and illnesses that left him brain-damaged.

I wrote a poem about a murder of a young girl as the Prosecuting Attorney and it states that I was going to seek the death penalty. A writer has to let their feelings go and put themselves in other’s places. I’m sorry if you think I’m just another ass hole beause really I’m not. I understand that you lost a sister. I have lost my Mom, Dad, brother, cousin, my two favorite Aunts, and best friend so I know how it feels to lose someone you love so very much.

So let me get this straight. Tracie was sleeping in her bed, Charles went to her bedroom and shot her, then took the time to put a garbage bag around her head and shove her in a closet and Low and behold, Ron came in and saw the note and called 911 to report that he thought that Tracie was abducted while Charles stood there all bloody talking to him with a gun in his hand. What’s wrong with this picture???
It’s the way you tell it, that’s what’s wrong with it. If Ron came in and saw the note, why didn’t Charles kill him before he had the chance to even call 911. That would have given him plenty of time to clean up, grab the note and go anywhere before the Police even knew there was a double murder. It may have taken them days to find them in the house. It didn’t happen like that.

You said that his bloody prints were all over the note. So did Charles write the note before he killed her or did he bloody up the note after he killed Ron and leave it there. It didn’t happen like that either.

If Charles wrote that note, then he must have done it after he killed Tracie. Why would he touch it after he killed Ron too?? Oh but you said that it was Charle’s blood on the note and not Tracie’s or Ron’s blood on it. So it couldn’t have happened that way either. Or did you say it was his bloody prints?? Who’s blood was on his prints, all three of them or just Charles’s?? Sorry, but it didn’t happen that way either.

If you would stand up, reach down and take your brain out of your behind, you would see that those stories don’t work. If it was Charles that was heard talking in the background, that must mean that at that point, Ron didn’t suspect Charles. He didn’t even know she was dead at that moment.
So what is the real story here?? There is a story but I have yet to hear one that makes any sense. I read in here that Charles knew the routine at the house and knew that Ron would be home for lunch that day, so why didn’t he plan it a little better than he did?? How could he stand there talking to Ron while he called the Police and Ron not see that he was covered in blood and tell the operator that he thought that Tracie was abducted?? It didn’t happen that way either.
Now if Charles was not in the same room and hiding holding a gun and all bloody, that would make some sense, but how could that be if it was his voice that was heard over the 911 tape?? He had to have been standing near Ron for his voice to be heard on the tape. So, it didn’t happen that way either.
