Wow. Just a couple of comments about that screed:

1) If this tome isn’t an indictment of the failed Alabama educational system, I don’t know what is.

2) Texas toast is just regular toast (usually made with thicker-than-normal slices of bread), and it’s not a major export nor part of our economy. Your Texas Toast Boycott will be largely unsuccessful in terms of getting Texas to eliminate the death penalty.

3) In what must have taken you all day to write, not once did you proclaim that your brother/sister/cousin/friend was innocent of executing 4 people (and trying to execute 2 more). Which makes him a vile, sick, animal who deserved the death penalty.

4) You asked why Doil Edward Lane is still on death row. I’m not his lawyer, so I couldn’t anser that. I’d agree that it’s disgusting that that vile piece of shit is still alive on my tax dollars (just as your brother was for 13 years). Though I never knew him, I remember him from around town here in Tuscaloosa, as I also remember Arthur, being in my 6th grade homeroom, and Tony, who I remember from the time he was in diapers. Few things are as disturbing and disgusting as Death Row Inmate Groupies (other than…you know…the actual death row inmates themselves and the horrendous crimes that they committed).

No…Dudley is not innocent. He shot those people to death. And two of his victims who survived the shooting identified him as the shooter. That’s pretty rock solid evidence.

As to the percentage of death row inmates who are actually and completely innocent of the crimes that they are accussed of? I’m betting it’s less than 1%. And those are all reprieved from the death chamber before their actual death date.

Why Is Doil Lane Still on Death Row?

Doil Edward Lane shuffles into the small cage that is the visiting room for death row inmates at the Polunsky Unit in Livingston. His head hangs down as he turns to let the guards remove his handcuffs. When he looks up, his eyes are red, his cheeks splotchy and wet. He crinkles up his face, picks up the telephone that allows him to talk with the visitors on the other side of the window, and says, “It’s hard to talk about.” So hard, in fact, that Lane sets down the phone, puts his face in his hands, and cries.

Lane is weeping not because he is facing execution, nor even because of his incarceration on death row. He’s broken-hearted because prison officials have moved him to another cellblock — away from his best friend, Marion. Now he has no one to talk to, no one to read and write letters for him. “I really miss him,” Lane says more than once, whining like a 7-year-old whose best friend just moved out of town. He cries intermittently, and then asks, “Do you want to see a picture I drew?” When he’s sure no guard is watching, he pulls from the waistband of his pants a pencil drawing of his two best friends, Marion Dudley and Leo Little. Lane says Dudley is the only other inmate who will take the time to read and explain things to him. Little helped Lane get books from the prison library — not books to read (Lane is essentially illiterate), but books with good pictures so that Lane could look at them, trace the images, and color them in with his pencils. His favorite book is The Apple Tree. “It has really good pictures,” he says.

Lane has been on death row for more than nine years. He was found guilty and sentenced to death by a jury in San Marcos in 1994 for the kidnapping and murder of 8-year-old Bertha Martinez. The crime was a parent’s worst nightmare — Bertha was in her neighborhood playing with some friends when she went off with a couple who said they needed help looking for their lost dog. Her battered and bruised body was found many days later in a small shack not far from her home.

Almost 12 years later, Lane confessed to the crime, saying that his stepfather and mother forced him to participate (neither was ever prosecuted). His confession came while he was being questioned in Kansas about the disappearance of 9-year-old Nancy Shoemaker, who had also been kidnapped and killed. Lane also confessed to having participated in that crime, this time saying that his friend Donnie Wacker made him do it.

Lane’s confessions were unusual in a number of ways. His statements about what happened changed frequently during questioning; details he recounted were inconsistent with facts already known to the police; and there was neither physical evidence nor eyewitness testimony linking Lane to either crime. But the most unusual thing about Lane’s confession was his situation when he gave it: Lane, then 30 years old and rather burly, was sitting in the lap of the police officer taking his statement, with his arm around the officer’s neck and his face buried in the officer’s chest, weeping.

Doil Lane is mentally retarded; doctors believe his brain may have been deprived of oxygen during his birth. His biological father was 74 years old and died shortly after Lane was born. His mother and her new husband neglected him, and later abused him both psychologically and sexually. Lane was placed in special-education classes at school, and consistently did poorly there. Eventually the state of Kansas stepped in, removed him from his home and sent him to the Brown School in San Marcos, a residential treatment center for children with developmental disabilities. Testing from his time at the Brown School, and later for his appeals, shows that his intellectual functioning is significantly impaired, that his full scale IQ is 65-67 — among the lowest 1% of the population — and that his mental and emotional development is that of an 8- to 10-year-old child.

Slow Wheels Turning
In 2001, the Texas Legislature passed a bill that would have banned the execution of the mentally retarded. Gov. Rick Perry called it unnecessary and vetoed it, saying, “We do not execute mentally retarded murderers today.” The governor’s statement was inaccurate on its face — nobody involved in the capital cases of Mario Marquez and Terry Washington disputes that both were mentally retarded at the time of their Huntsville executions in the late 1990s — but at the time, Perry could at least have argued that no national standard required Texas to refrain from such executions. Then last year, in a case called Atkins v. Virginia, the U.S. Supreme Court held that the “evolving standards of decency” in this country would no longer tolerate the execution of people with mental retardation, noting that no other Western democracy allows their execution. The court thereby officially abolished capital punishment for the mentally retarded.
Since the national reinstatement of the death penalty in 1976, prosecutors had been acting under the assumption that seeking a death sentence for a person with mental retardation was permissible as long as the jury was able to consider the issue in deciding whether to impose a sentence of death. The Atkins decision changed that — but the Supreme Court left it to the individual states to adopt procedures for ensuring that no person with mental retardation would be executed. The court gave scant guidance as to what those procedures should be, but did suggest that a finding of mental retardation require that the defendant have subaverage intellectual functioning, significant limitations in adaptive skills, and that the deficiencies manifest before the age of 18 — requirements consistent with both medical and governmental definitions of mental retardation.

Whatever their opinions of the death penalty, Texans should wonder why, more than a year after the Atkins decision, Doil Lane remains on death row.

The prosecution in Lane’s case has never disputed that he is mentally retarded. In fact, at trial, Hays Co. District Attorney Michael Wenk presented the fact of Lane’s mental retardation as part of the expert opinion regarding whether Lane would be a danger to the community if he were not sentenced to death. In his questioning of the state’s expert witness on the issue of future dangerousness, Wenk asked the expert to assume “that [Lane] has been diagnosed as borderline or mildly retarded, with an IQ in the range of 70.” Wenk told the jury: “There is no question that there is something wrong with [Lane]. … He’s mildly retarded; he comes from a dysfunctional family. We’re not disputing that.”

Last August, Lane’s attorney, Austin lawyer and UT law professor Bill Allison, filed a motion asking the trial court to remove Lane from death row because of his mental retardation. According to Rick Wetzel, former chief counsel for the Court of Criminal Appeals, the statutory process requires that the trial court forward such motions to the CCA within a short period of time. However, for reasons that the Hays Co. clerk’s office can’t explain, that has not been done in Lane’s case. The prosecutor’s office

I went to school with Marion. We used to hang out from time to time. I can’t say whether he did the crimes or not. He never made me feel in any way that he was capable of mutiple murders. He admitted what his major problem was in those days and that was trying to get the ladies. Quick money, fly cars and clothes was basically a sure way to get them. I can and will not judge him, that’s not my job or any other man. I will say though, our legal system is “crooked”. Money talks folks! People are paid off on a daily basis. Things are covered up so that only the “obvious facts” are known. We will never know why they “bought” testimony from convicted criminals that would say what is needed to benefit. Evidence is fabricated. Anything to prosecute a major case as this one. We will never know the extent in which the “law” is manipulated until we are on the negative end of it. You know the saying, “guilty, unless you can prove otherwise”. I can say that, I have sympathy for the victims, I really do; but wasn’t she a drug smuggler, dealer, trafficer, etc. who got off free. I understand the tragedy she experienced, but the line of business they all were in was not honest, safe, legal or without enemies. But isn’t this ultimately a felon’s testimony vs. another felon’s testimony.

I was once good friends with Dud and girlfriend of Tony’s. Myself, my best friend, Dud and Tony shared an apartment once (many years ago). I won’t comment on the actual crime but I will say that my heart cries for what took place and the lives that were lost. My prayers goes out to the families who lost their loved ones.

i am also from tuscaloosa and went to school with Dud and Tony, i had seen Author on several occasions.

i do find it hard to think that Tony would do something of this matter. he was not the gang banging tipe in school. i also want to say after the exucution i could not sleep for two days just because i knew him once. my heart went out to both sides of each family.

i have a brother who was murdered and have forgiven the killer because the longer i felt hate in my heart it made me filled with evil thoughts. once i forgave it was like a weight lifted off my shoulder. also at first i felt this person should die to, but thought that the person that thinks or does the exucution what kind of person are you.

life is life and should be given and taken by the same. i do wish that the remainder two author and tony try to speak out to the young guys growing and thinking that drug life is all that. you see everyone that i know that used to sell and were like all that with new cars and money. none of them have anything or are locked up. its like chasing cheddar, but in the end got caught by the trap. yes, in the end the most high is the one that will have the last say over all.

but then again haven’t we all commited some type of sin in one way or another. what are we doing as people to help others not become victims of a situation similar to this. for the ones out there trying to make change to clothe themselves or if its to have money to impress or keep some girl. i remeber people exspecially those brought in low income. when we saw guys rolling in cool cars that was what we wanted. and some of those guys i wander if those girls that were down with them then still rolling while they are locked up and on deathrow. are you lifting their spirits helping them cope with life before death.

I’ve sinned. In fact, looking at the Ten Commandments, I’m guilty of breaking five of them:

#3 — I’ve taken the Lords name in vain.
#4 — not being a church going kinda guy, I break the Sabbath each and every week.
#8 — The one sin I’m most ashamed of, but yes, I have stolen something which was not mine (granted, I was just a kid, but stealing is stealing, just the same).
#9 — I’ve lied. Many times.
#10 — I have coveted all sorts of stuff.

Now, I’m of the belief that not all sin is equal. For instance, if you’ll notice which one of the Ten Commandments I haven’t broken — notice the biggy that is missing?

That’s right — Though shalt not murder. Maybe it’s just me…but I think that one’s a little more serious than stealing candy bar from the corner store when I was 8 years old.

sure i know that you are pure as a babies buttom. but i’m quite sure there are more that you have unknowing committed. i ask you though mr. saint what have you done to help some young person not fall into the same path. are you out there trying to help make our society a better place or are you just good with your fingers and wasting time . do you love your neighbors, have you ever been mean or said something when you were younge that scrared a person for life. then also look at the age of these males when they committed these crimes. i know tony didn’t have record prior to this. no the crime is awful, but is the person that injects the life out of a person on deathrow not have blood on thier hands. taking a life is neither going to bring those people back nor stop any pain of the victims. what kind of person would take gradification to see another become lifeless. me i propably couldn’t sleep at night for this because i have compassion for life. you know my grandmother used to say let the lord handle it and i didn’t quite understand until elder years because one does reap what they sow but it for him to do so. you may make light of sins but still the same it is all agaist the one who died for all of our sins. no one knows what madness or sanity dud dealt with while waiting years before that last day. no one knows was he in good health, we just look at what we do or don’t see.

And no, the person who carries out a legal execution in a painless and humane manner is not the same as your friend Tony, who needlessly subjected the victims to fear and pain and ultimately death. But, because you couldn’t sleep the night your scummy friend got his, you think you deserve some sort of prize. You have no true compassion for life. for starters my friend or as i said someone i knew in high school didn’t get death sentence. i only went to school with dud, yet and still he is still a human. and point is not that he or they should not get life in prison, but that to take his life is not going to give pleasure to a true person in the most high. and no someone that kills six people isn’t the same as taking candy, but who are we to say yeh give himj death or even be the person that do so and live and sleep as if we are a good person because murder is murder maybe you don’t see it that way and i can understand with someone with a couple of nuts missing from their bolts. whether i go out and shoot two people or i’am the person with the job as the person that execute. i sure their not murders try telling God that on judgement day. and it didn’t say that dud was dragged out of his cell. and i’m sure that if they were doing the same with me i would skip down as if i’m going to Oz. if they wqanted me their they would have to come and carry me to. you are not a person that reads and comprehends i see. what happened to those people was terrible and i pray for anyone who would commit such a awful crime. it is not me to belittle the actions, my point is yes these human beings belong to not be able to harm anyone else in this way again but, is murdering them the answer. yes it would be one more person that commited a unthinkable crime. we are so quick to judge maybe if we let them work in prison for the rest of their life for free. and yes i couldn’t sleep at night to know someone i once went to the same high school with. i wondered what could’ve happen to have made this person if they did these crimes do so. as i said before i had a brother murdered and at first thought i wanted to be this executior and then when finding the most high i then began to see okay if i were to do this would this make the same and the answer is yes. you can think what ever you like of me and yes i need help and seek help from the most high everyday yes, help us all. and be with me in my everyday journey in this world.and i ask to you as i begin to think what can i do to help some young man or woman not become the person behind the gun? what are you doing to help some person not be this human being, do something instead of talking about it. make a difference, help change the numbers in prison then maybe you want have to be on a site like this debating the issues. let me tell you this i have a small child and he wanted a pet dog i am and have never been a pet person, but because my child wanted a pet well guess what i’m purchasing one. this dog was in my home in less than a year when oneday my neighbor ran over my dog and when they ran her over they stopped the car looked back and kept driving. i thought what kind of a person would do this. i was upset and even shed a tear or two for the pup. as i watched my sons dog lay there with blood running out his mouth. i didn’t want my son to view this so tried to remove body before he awake. now some would say a dog yes thats just me a person with compassion for any thing with life.

I was Marions penpal for 5 years. Writing to a DR inmate sure beats going to church amongst idiots who believe in some uneducated pastors words!
What you fail to realise is that your legal system is flawed and deliberately fails working class white and black men and women. As does your health care and your education system. Also despite the fact that Texas is notorious for its excecutions there has been no improvement in the crime rate. It appears criminals are certainly not deterred. Furthermore USA CHINA AND IRAN your favourite people all walk hand in hand with the worst rate of excecutions.

As civilized and God loving as you claim to be - your lust for violence and revenge is startling and worrying.
Hence i do not rush off to church to hang around with blood thirsty christians who will kill for revenge, call homeless people ‘bums’ and despise single mothers.

I do not know if Marion committed the crime, he never gave up hope till the day he was removed forcibly from this plane. Alas your american dream creates monsters in the face of greed and neglect.

It don’t matter now. He dead and gone, just like the victims. He committed a crime and got caught. He should have been swifter with the job.
