Over on this post about multiple-murderer and current long-time denizen of Texas’ death row, Charles Dean Hood, an anonymous commenter pointed us to this court ruling in the case of Hood, which was handed down yesterday.
In the order, Hood’s defense asks for a motion to “stay [his] execution and suspend rules of appellate procedure to permit rehearing of direct appeal.”
Sounds like a last-ditch desperate attempt to prolong the inevitable.
The judge ruled against Hood:
Appellant now asks that we suspend the Rules of Appellate Procedure and again review one of his claims he raised on direct appeal. We rejected that claim over 14 years ago because, procedurally, it did not meet the requirements of a properly briefed point of error and, in the alternative, because we found it to be without merit. Hood, AP-71,167 (slip op at 19-20). When the United States Supreme Court denied certiorari on October 11, 1994, this appeal became final. Texas Rule of Appellate Procedure 2 does not allow this Court to create jurisdiction where none exists. See generally Garza v. State, 896 S.W.2d 192 (Tex. Crim. App. 1995). Appellant’s motion is denied.

I’m surprised his fan club isn’t streaming in here to complain that “another innocent man is going to be texecuted!”
That motion attempt was surely an act of desperation.
Having read much of the background on this case, I agree with the verdict, as did the courts throughout the appeals process.
That a man that murdered, and committed many other crimes, would try everything possible to stay alive isn’t surprising. He’s a murderer and is unwilling to fess up to his crimes; I despise both his crimes and his bad character, and I don’t respect him in any way, irrespective of the events in his early upbringing.
May his day of judgement soon arrive, and the families of the victims may find some closure in this sad and tragic experience.
I’d like to know what issue from his original appeal he asked the court to revisit.
The claim of innocence made by Hood and his fans involves several leaps of faith. Hood would have been able to sleep through the first shooting, be with the second victim while the ‘real killer’ was in the house, be present during the second shooting and be allowed to escape with a lot of property belonging to the victim.
This needle party is long ovedue.
OMG…. No kidding ….. leaps of faith indeed….. out and out lies… Any body believing that…… I have some swamp land I’d like to sell them!
Lets see……. 30 days and counting, betcha he’s really starting to panic, especially since his last appeal was DENIED!
Hood will have a radio show the night before his scheduled execution. Music that he has requested will be played and loved ones and friends will call in to wish him luck and tell him goodbye. Maybe we can call in for him?

i think ya all sick in the heads, even if he did do those murders so what!!!! nothing he can do can replace the deceased, i mean he can pnly die once init? i used to write 2 him and i was carted with his innocent bullshit but he messed up a few times which made me knew he was chattin s~#t. im against the death penalty but this geezahz an idiot, so roll on june.
