Charles Dean Hood — To Be Executed in one Week

Charles Dean Hood has been on Texas’ death row since he was convicted of murdering Tracie Lynn Wallace and Roland Williamson in 1989.

Today, the Texas Supreme Court found that the U.S. Supreme Court’s 7-2 ruling which upheld Kentucky’s lethal injection procedure is “materially indistinguishable from Texas’ lethal injection protocol.”

Which was the basis of Hood’s final appeal. Which means that in one week from today, Charles Dean Hood will finally pay for the horrible crimes he committed nearly 20 years ago.

I have closed the comments threads on all the previous Charles Dean Hood threads, as several of them have over 400 comments (links to those threads are at the bottom of this post).

With exactly a week to go until Charles’ execution, I anticipate there being a lot of chatter, and I wanted to keep all the comments on on thread (this one).

I will be attending the execution as the support person for the sister of Tracie Wallace (who goes by Big Sis on this blog).

With Big Sis’ permission, I’ll write more about the execution afterward, but this time from a first person perspective.

With only a week to go, please remember that there are family members of both victims as well as Hood who read and comment on this blog.

I’d like to ask that everybody to please try to remain civil and respectful of each other in your disagreements and comments this week.

UPDATE — looks like these anti-DP idiots are sill planning to hold their protest at the Governor’s Mansion. You know — the mansion that burned down last weekend. The one where Governor Perry hasn’t lived in almost a year. There will be a bunch of clean-up crews, forensic arson investigators, restoration experts, and police on site. Though I doubt any of them have the power to pardon Hood.

  1. I understand that Hoods brother James will be attending the execution. I do not have a confirmation from Ron’s son Roger if he is attending…. last I knew he would be in attendence.

    With 6 days to go….. It just seems like a bad dream coming to an end.

    I do have empathy for Deans family as they too will suffer a loss. This is just so sad for all involved, How one persons actions caused so much hurt.

  9. Only backward and barbaric countries still have the death penalty. I’d rather see a man however evil he is, rot away in a concrete shithole for 50 years than suffer a few traumatic minutes on a gurney making his end easy.

    Why should he be allowed to enjoy existance even though it may be a limited one ?

    Fine with me if you lock him away in a concrete and steel hole with no contact for the rest of his life but then think of the poor tax payers who get to foot the bill.

  14. I see you quoted the case of Ian Huntley. Well, Mr Huntley is enjoying his life on the inside so much he has attempted suicide three times !! On one occasion he was recovered from a drug-overdose induced coma, so his attempts have been real attempts rather than gestures. Had he been executed he would now be safely in the arms of your Lord. Let the bastard rot I say. He’s looking forward to half a century reflecting on the crimes he committed. Good !!

Most British Muslims aren’t immigrants but were in fact born in the UK and are as British as I am, who’s people have been here since the year dot. The vast majority of UK Muslims have no truck with terrorists whatsoever. They are clean living people who of course don’t drink alcohol, are splendid company and have a great sense of humour. Only a tiny minority of the British prison population are Muslim. Most are hard working decent members of British society. Are you one of those hillbilly people I’ve heard so much about and don’t leave the woods very often?

    Yes Huntley’s case is just one of many where a good public hanging should have been the case instead of the Hilton suite.

Instead, he selects his daily menu from his private cell, chooses the designer clothes he will wear that day, watches television, listens to tapes/CDs, plays Nintendo and other computer games, is humored by the guards who have been ordered to play chess, darts, and scrabble with him, answers his fan mail, and visits with mom. Every time he pulls one of his phony suicide attempts, and they are phony because he knows he will be found before the pills have enough time to kill him, he is awarded more privileges. People like him reflect on their crimes only to get sexually aroused. And in another 10 years, people like you will be demanding that he be released because he has suffered enough.

    If you wish to congratulate yourself about not having capital punishment, fine, but proclaiming that the UK is more advanced culturally because they don’t practice it, while impugning our states use of it, then I will throw it right back at you every time, Limey!

    Our state, in every poll taken, overwhelmingly favors capital punishment. That is what matters, not some insecure distant voice.

    If only the process could be expedited, so the victims families didn’t have to suffer the added anxiety, each time another motion is filed, and have to relive their sense of loss, is the most disturbing aspect of the process.

  19. I want to say that it makes NO DIFFERENCE TO ME what religion/ creed, color, sexuality is…. there are good and bad in all walks of life so to generalize people all together is prejustice. An there are alot of non muslim people who don’t drink, are good company, and have a good sense of humor. I would hope that people would want to EDUCATE themselves about people and their religions and or their way of life……. To mock ones way of life is a show of ignorance and GOD KNOWS THERES ENOUGH OF THAT GOING AROUND!

  26. Big Sis, we all have our views, and sometimes we are in agreement. Since the good people of Texas have consistently, and overwhelmingly supported capital punishment, a stance I agree with, I will tolerate various opinions, but not disrespectful one’s, or attacks on the good people in this state, and certainly not by someone who doesn’t live here.

    The events that lead up to this punishment are so very tragic and life altering, as you well know, that for any to think we view this form of punishment casually, is infuriating.

    I would give anything, if you, your family, and all the many other victim’s families, didn’t have to experience what you and they have.

    While I do have some sympathy for the families of the criminals, it isn’t as unqualified as my support for the victim’s families is.

    I was in law enforcement for a number of years, when I was younger, and have viewed the results of crimes first hand, and how devastating they are to the families and friends involved. There is evil in this world, I have looked it in the eye, and there are good people gone bad. As a state, we have chosen to permanently remove those with murderous intent from our society, so that they can never cause such devastating harm, ever again. It does little to assuage the pain that has been caused, but it does give us closure, a finality to the criminals activities, and a sense of justice to those who were murdered.

    I do not take lightly this form of punishment, but I will continue to support it, and am glad that the good people of Texas support that form of punishment. Some may think they are getting off to easily, compared to the vicious murders they committed, but I disagree. The anticipation of what they are facing, and the cold formal manner in which it is carried out, is not an easy exit.

  29. As a card-carrying liberal, I would like to say that I favor the death penalty, although I do not favor it its current form. The death sentence has become so “clean and clinical” as to be useless as a deterrent.

    If we are truly going to have an “eye-for-an-eye”, I believe that the victim’s family should be allowed to determine the execution method (within legal guidelines), they should be able to be the ones to carry it out and it should be televised, live.

    I believe that someone can be a liberal and still favor justice. This little twerp (despite his sister-in-laws ravings and ignorance of facts) killed these 2 innocent people. “Procedural errors” do not obscure the fact that he killed them. I don’t give a rat’s posterior if he was abused as a child. I was abused so badly that the blood ran down my stomach and legs almost daily. You were abused? So was I, and I never killed anybody and have worked all my life. I got into trouble as a teenager, did my time and took full credit for MY error. I screwed up. Now, you little twerp, it’s time for you to take full credit.

    Please don’t confuse liberals with nutcases like some of these folks.

  31. Until yesterday I had no idea who the criminal Hood was nor the nature of his crimes. What I intended to point out is the utter futility of the death sentence. It taints all involved and makes them no better than the criminal. [Editor --- Makes them no better than the criminal? Your sense of moral relativism would be funny if it wasn't so pathetic. Sorry, but I would put the needle in that killers are in a heart beat. I would put a bullet in his head, or I would kick the stool out from beneath his noose.     In the UK when the death penalty was still in force the hangman was a man called Albert Pierrepoint who traveled the world dispatching convicted prisoners. He strung up over 400 people in his career and when asked when he was in retirement what he thought he had achieved with all these deaths he gave a simple one word answer…*Nothing*

    As to Ian Huntley, the purpose of keeping a close eye on him in jail is not out of a sense of altruism. The authorities want him to serve out a full life term and pay in full for his crimes..that is a long unhappy life behind bars. Incarceration is the punishment.

    Imagine, if you can, being sentenced to life in your own home..being told when to go to sleep, when to wake up, when to shower and how often. Surviving on a diet which is just more wholesome than you would give your dog. Never to again walk the grass, see the seasons change. Never to ever have an intimate relationship with another human being. You would go insane long before you die.

    There’s another slight snag with the death penalty, that is killing people who are innocent. Had we had the death penalty in the 1970’s quite a large number of Irish people who were convicted of terrorist killings who had nothing to do with the crimes would have been murdered by the state. That’s the reason why the death penalty in the UK nor the rest of Europe will ever return.
    Killing Hood will serve no purpose unless your motive is revenge, which isn’t the same as justice.

You people in the UK can do what you will with murders, for us ,those who murder do not deserve to see another sunset, eat a wholesome meal, or for the fact that they are even able to breathe…… Their victims no longer have the ability to do those things….. My sister and Ron both were shot execution style…. a gun placed behind my sisters ear and Ron was shot in the back of the head ….. so tell me he doesn’t deserve to die nor any of the other scum bags. They have a total disregard for human life…. selfishness, seeking their own gain, making decisions that God alone has the right to make……

    With all the taxpayers money going to house, feed, medical care, that money could be better used to feed and house the poor in this country, those who struggle to survive while they are provided for.

    Even the smallest amount of joy should be denied these animals and anyone who tries to provide them this should be held accountable.

    Since reading these blogs i’ve come across loads of “befriend a prisoner” web sites and “be a penfriend to prisoner” etc

    What is so wrong with these people to try and cause more pain to the families of those who suffered at the hands of these pieces of rectal excrement by writing to them.

    One site even has special occasions for what they dubbed as “freedom impaired” persons.

    WTF are they on ?

    They are not “freedom impaired” they are heartless dregs of society who need a good kicking not a friend.

    I agree with Good old Blighty above. Its about time we brought back public executions and punishment.

    Once a few public hangings and floggings have been witnesses these scum will think twice and it will cut down on jail space needed.

    I bet once some little scrote has had a good lashing he won’t go off stealing cars or mugging old ladys again.

    But giving him a few hours community service won’t stop him.

    Take someone like Hood who destroyed lives and caused countless suffering yet who is allowed to have a pen friend.

    Idolising a killer to the point of befriending them should concern us all. Will one of these become the next killer in society?

  36. What David Dow deliberately fails to mention is that neither Hood’s trial attorneys nor his appellate attorneys nor Dow himself, found any evidence to back his false claim. So, after 20 years, those against capital punishment should stop telling these lies. It makes them look like, well, liars.

  38. I am always unimpressed when a Godless atheist tries to throw God’s law out as an example of why capital punishment shouldn’t be used, and replaces the word of God, with their opinion. A prime example of speaking to that to which they do not know.

    Genesis 9:6: Whoso sheddeth man’s blood, by man shall his blood be shed: for in the image of God made he man.(This is God’s law, before Moses.)

    Exodus chapter 21: we learn that God in His law demanded the death penalty for a number of crimes such as murder, kidnapping, cursing parents, etc.

    Exodus 20:13 “You shall not murder.” Not as has become the current false definition, of “thou shalt not kill.” God demands perfect justice, by applying the law fairly. All murder is killing but not all killing is murder, and capital punishment doesn’t violate the sixth commandment.

    As to the executioner and capital punishment in the New Testament, there is this: Romans 13:4, “For he is the minister of God to thee for good. But if thou do that which is evil, be afraid; for he beareth not the sword in vain: for he is the minister of God, a revenger to execute wrath upon him that doeth evil.” I concur, and have no problem with justice or revenge.

  40. I’m upset at the fact everyone makes excuses and excuses. If he did it, he should be punish. Did their victims asked to be hurt or killed such a manner. I hate hearing the stories of I didn’t do it or I did do it and are crying now to be saved. That is a bunch of B.S. Did the vitims get a chance to be saved. NO! So if you did it, you should pay for your crime. You took thier life so what makes you better to stay alive. I know how it feels to loose someone. My sister was killed in Dallas 16 years ago leaving her children. Not once did her killer think of her family and children before he took her from us. All he did was think of himself. Her killer was never found. What it comes down to it is if you have mental illness and feel you are going to hurt someone or your self Please get that help. Stop before you change your life and someone else.

  41. I am so sorry for your loss…… I am also sorry her killer was never found. I understand your pain and loss. Having not caught the scum bag makes it even more difficult to have closure on the loss of your sister. Know that she is in a better place and watches over you and your family.

    May you find peace and closure one day, but is there really any closure? I will soon find out…. I feel that I will have closure when Dean is executed…..

    this morning filed appeals to get the verdict and death sentence thrown out. They’re accusing the DA and the judge in the case of having an affair at the time of the trial. As I’m sure you know, that’s an accusation that was raised a couple years ago in an online news story.

    As the day gets closer, I find myself grieving all over again. I look at her pictures and my blood begins to boil. Not just at the fact that Hood did this to them, but the fact that his name is all over the media now and I can’t escape him.
    I wish I could be there to support you through the actual execution. I live but 2 hours away, but I am not invited to the party.
    It is almost over girly. 18 long years later, it is almost over.
    I will be having my own personal memorial to Traci on the 17th. You and the family will be in my thoughts.
    I got hold of a couple of old friends that we shared and we will be getting together next week to share our memories.

The Court will have to look into this as the defence claims they can prove it and that will take time. I am not saying there will be a stay but what I am saying is “don’t count your chickens”
    To the people that think that men or women on the Row shouldn’t be able to write to anyone, Please. You are not paying for the paper and stamps so what do you care? We are not barbaric like those who murder so of course we give them their rights. There is nothing wrong with that.
    Do you know how an inmate on Death Row lives? It’s not pretty so if you think that they are laughing, playing cards, out in the tennis court or playing pool, think again.
    Now you are going to say that the people they killed have no rights and you’re right, but we as a Society have to give all human beings rights no matter what they did because we are not like them who have no regard for human life. If we treated them as they did their victims, we would be no better so knock it off already, we have to give them their rights!!

    With the charges that the Defence brought before the Court and can prove, they really must look into it and that takes time. Time is the only thing that Mr. Hood has so If they ignore it, execute him and the Defence proves it, there will be hell to pay. That alone was reason for a mistrial because it makes for a very unfair trial when the Judge and lead Prosecutor are having an affair during the trial itself and evidence was denied. Woa – Not Good.
    That means that Mr and Mrs Hood could sue Texas for the wrongful death of their son when the Court was clearly alerted to the affair but chose to close their eyes to it. I don’t see how they can ignore it. To me this just proves one thing, his trial Attorney wasn’t very good. You know the saying “If it looks like a duck, walks like a duck, and quacks like a duck, it’s probably a duck” Yikes, I wonder if no2liberals knows anything about ducks. LOL

  107. Hi. I’m from New Zealnd and over the last week or so have been reading what each other is saying. I am 50/50 about the death penalty. I have a child and I know that if something happened to him I would want that person to suffer. However, I do believe that there are still innocent people that have been executed which scares the hell out of me. I’m not saying Charles Hood is innocent, but I pesonally think there needs to be a rethink on how the US executes people. I believe it is too risky to convict on circumstantial evidence, you need harder evidence, eg. undeniable DNA, confession etc, etc. I would apprecite not being abused or told I am wrong in my opinion either. All it is, is an opinion. I come from a small country where we need a lot harsher sentences but I think I would freak out if they ever introduce the DP again. I feel very bad for the sister of one of the victims and my heart goes out to you. But I also feel sorry for the condemed man’s family, as they are too innocent. It is a very nasty and sad situation. I don’t blame the victims family for feeling they way they do, I know I would especially if it was my child that was a victim – god help. But I also have a family member that needs to develop a conscience (he is not in jail or anything but if he doesn’t sort himself out that is a possibility) but that is not our family’s fault. Sometimes it is just a bad egg, but people can also judge the family by thier actions. To those people who have not been very nice about other countries, that is not necessay. You need to remember we are just stating our thoughts and feelings, no we don’t have the DP and no we don’t live in the US, but I know internationally we get a lot of info regarding what the US is up to, inevitably we will form opinions, weather they are informaed or not.   108. I believe it is too risky to convict on circumstantial evidence, you need harder evidence, eg. undeniable DNA, confession etc, etc. I would apprecite not being abused or told I am wrong in my opinion either.

    Well, you are wrong. Are people suppose to coddle you and pretend you’re not? It may just be your opinion but since it is your opinion about our system of justice, yeah, I’m doing to correct you. Do you realize that attorneys and judges believe circumstantial evidence is more reliable than confessions?

    And since we are sharing opinions about other people’s countries: Anti-antisemitism in NZ has become rampant. Then again, if you have difficulty understanding circumstantial and testimonial evidence, you probably deny the Holocaust, too. Go clean your own house before you try to interfere with ours.

    I thought I would post the links to what everyone is talking about everyone says there is not proof well there is and much more where that came from. It is not just fiction any longer. This is what was filed with the courts and the actual affidavit that came from the assistant DA of the time Charles not (Charlie) was prosecuted. He knew about the affair among other people and now it is a matter of record and when they look into this not only Charles case but every other case tried under this judge and prosecutor will be overtuned.

I thank you for acknowledging that there is a whole other family here not just the victims families. However, I understand there pain especially big sis because of her tremendous loss. My heart is breaking for my husband who had to leave on fathers day and go somewhere that noone should hafe to go.

    Did Goeller come forward with his allegation before, during, or after trial? No. After leaving the DAs office, Goeller became a defense atty and the president of the Criminal Defense Attys Association. Still, he waited 18 years before coming forward. Apparently, he didn’t put much faith into “common knowledge” either.

    Was there any evidence of bias at the trial? No, since the transcripts of the trial and numerous proceedings have been reviewed on appeal many times and none have been found.

    What will the judges look for in reviewing the writ? Actual bias rather than the appearance of impropriety. Has the defense alleged actual bias in their petition? No.

    There’s a good chance the courts will find the issue waived by the defense failing to present it earlier since it is hardly a new allegation.

  128. Wendy, Thank you for your words and the links. I have read them both and will stick my neck out further and say that a stay is necessary so they can call those two on the carpet. She was required to recuse herself and should have but didn’t. Why??

    Maybe nobody wanted to come forward back then Madam Anonymous. Maybe they were afraid of losing their jobs had they accused them of an affair back when the trial was going on.

    The Defense can wait as long as they want to bring these charges as there is no statute of limitations for this kind of appeal. Also this is a new allegation in the Courts. The Defense has never challanged the affair in Court, it was just rumors. Now that it has been challanged, the Court must look at it and make a decision and it better be the right one.

    From what I have read, it looks pretty bad and had the appearance of bias for sure. That’s a NO NO. Get it?? A NO NO. . . They did a great big NO NO at the expense of Mr. Hood.

    Even if he’s guilty, his trial was unfair to say the least. Everyone is entitled to a fair trial in the United States and that means Mr. Hood too!

    They are not only required to stay his execution, but look back at every case the two of them were in on together. Wait until CNN gets wind of this. I wouldn’t want to be the one that has to answer to these allegations. They will have a field day with this one at the expense of Texas and it’s entire Judicial System.
    These guys aren’t playing.

    Although I´m in general against the d.p. I can accept and I have to accept the laws of the United States of America. I can understand the pain and feelings of the victims family and finally it´s their decision if they need this act of an execution for their own closure or salutary effect.

    I think Big Sis and Robbie have shown great character because they have always said, they feel too for the Hood family and the lost they will have to endure tomorrow. And Robbie and Big Sis have always shown an open mind but this was a senseless discussion because Charles Hood must be guilty. He couldn´t prove his innocence the last long years; so what?????

  132. I would like to agree with the person from Germany. I totally think that the posts between myself and annonymous were totally senseless as there is much more important things going on. In my defence though I would like to say that I was responding in annoyance of being accused of things that were obviously taken out of context and unfortunately we all got carried away and was a waste of time too. Anyway over and done with now.

    I also agree that even if Mr Hood is guilty he does however have the right to a 100% completely fair trial. If the worst is to be done to this man I believe there needs to be no doubt. Not to take anything away from Big Sis as she has suffered many years waiting for justice to be served. I just hope for all parties involved the truth comes out. Maybe that is dreaming a bit, but there is a lot to lose here, on both sides. I also agree of the good character shown by Robbie and Big Sis. My thoughts are with you. Take Care

    There should be news sometime today about the appeal. As I said a little eariler, it would seem that they have to look into it. Even if your brother in law is guilty, he deserves a fair trial and not one that shows the apparence of bias on anyone’s part.

  135. I have just looked up Hoods case and even if the judge and the pros. were banging each other senseless in the courtroom the evidence against Hood stands.

    He murdered 2 people stole from them and did a runner leaving fingerprints all over the crime scene.
    Further reports show what a nasty piece of work he was and just add wood to the already sizeable pile.

If they were sleeping with each other then the Judge should have recused herself from hearing the case. IT DOESN’T MATTER IF HE DID IT OR NOT!! HE DIDN’T GET A FAIR TRIAL!! Every Citizen and even those who are not citizens are entitled to due process. He was denied evidence and DNA by that Judge who was sleeping with the Lead Prosecutor so what part of that do you not understand?? They simply can not do that because it shows the appearence of bias toward the Prosecution.
    Think about it. The Judge is sleeping with the lead Prosecutor and she is hearing a case. Is that fair to the defendant?? I don’t think so.

  142. He was denied evidence and DNA by that Judge who was sleeping with the Lead Prosecutor so what part of that do you not understand??

    But, he wasn’t: Hood filed a motion for DNA testing on May 19, 2004. It was denied by the trial judge (not the judge that tried him who was long gone) on August 25, 2004, because the DNA would not be exculpatory. Hood appealed the decision to the state court of appeal and lost and to the USSC who declined cert.

    Numerous judges, none of which were Judge Holland, reviewed the motion for DNA and found that it was not exculpatory and denied it.

    So, what part of that do you not understand?

    At 11:53 a.m., Williamson made a call to 911 and told them that someone named “Dean” had already called the police from Williamson’s residence to report a burglary, but Williamson wanted to inform them of a possible abduction. It overturned a lower court’s request for a new trial in a case of Calvin Burdine, a man who got a death sentence even though his lawyer had slept during the proceedings. It refused to free convicted rapist Roy Criner even after DNA evidence had shown he wasn’t the culprit (a decision that dissenting judge Tom Price said made the court a “national laughingstock”). In September presiding judge Sharon Keller turned down an eleventh-hour appeal from Death Row inmate Michael Richard because it was going to be turned in a half an hour late. “We close at five,” she said. Richard was executed. Even Keller’s fellow judges were outraged.

    Which is one reason to believe that the court may actually do a non-foolish thing in the latest controversy at its door: a serious allegation of an intimate relationship between a prosecutor and a judge at a 1990 capital murder trial. The trial of Charles Dean Hood for the double murder of Ron Williamson and Traci Wallace took place in the 296th Judicial District Court of Collin County in the summer of 1990, with the Honorable Verla Sue Holland presiding. The District Attorney was Tom O’Connell who, with his assistant John Schomburger, prosecuted Hood, sending him to death row. Hood has gotten several execution dates over the past 18 years. The latest one is June 17, at 6 p.m.

    Allegations of an affair between Holland and O’Connell first arose in 1995, when Janet Heitmiller, a paralegal for Hood’s trial defense team, told his appellate lawyers about talk around the courthouse. Several attorneys confirmed the rumors, though no one had any actual proof of the office romance. An investigator also talked with Holland’s ex-husband Earl, who believed they were having an affair. According to Allan Berlow, who wrote a story for Salon.com in 2005, Earl Holland told friends the affair led him to file for divorce. Berlow talked with two of those anonymous friends. One said, “I am 100 percent sure that there was an affair,” telling of listening to tape recordings Holland had made of his wife and her lover; the other said there was a “mountain of circumstantial evidence of an affair.” Hood’s trial attorney David Haynes told Berlow, “Everyone in the courthouse had heard those rumors” — but without more evidence, he said, he couldn’t ask Holland to recuse herself. Holland and O’Connell refused to discuss the allegations then, and haven’t discussed them to this date.

    But now there is more. Yesterday Hood’s lawyers filed with the CCA an application for a writ of habeas corpus and a stay of execution based on the words of Matthew Goeller, who was an assistant district attorney working under O’Connell from 1987 through 1996. In his affidavit, Goeller wrote: “It was common knowledge in the District Attorney’s Office, and the Collin County Bar, in general…” that O’Connell and Holland “had a romantic relationship.” This is not the word of someone who used to work for Hood and it’s not the word of a bitter cuckhold. This is a still-practicing member of the Collin County bar who worked closely with O’Connell. Hood’s attorneys want to use this affidavit to get a stay of execution, but their end game is to get Holland and O’Connell into court to ask them about the affair, under oath. They have each denied repeated requests for interviews, but they won’t be able to ignore a subpoena. It’s the only way to find out the truth about their relationship.

    The 14th Amendment to the Constitution famously says, “Nor shall any State deprive any person of life, liberty, or property, without due process of law.” If you were on trial, would you want to go before a judge who was having an affair with the person trying to send you to prison — or worse, trying to have you executed? Impartiality is an absolute bedrock of our justice system, something the Texas Constitution recognizes too: “No judge shall sit in any case wherein the judge may be interested, or where either of the parties may be connected with the judge, either by affinity or consanguinity…”

    But it’s not merely justice that is important. As the U.S. Supreme Court has said, a court “not only must be unbiased but also must avoid even the appearance of bias.”

    And this is why the CCA needs to grant this writ and not, as it has done over the past ten years, rush to execution. After Holland left the district court, she served on the CCA from 1997 until 2001. She worked with eight of the nine currently sitting judges. If they ignore this appeal, this affidavit from a former officer of the Texas courts about one of their former peers, they risk not only the appearance of injustice but the reality of Texas becoming the all-time clown college of the American judicial system, the state that okayed both sleeping lawyers and lawyers sleeping with each other. The state that wouldn’t halt its execution machine long enough to ask a simple question. The CCA should grant this writ, call a hearing, subpoena Holland and O’Connell, and get to the bottom of the matter. Because it’s more than a man’s life that is at stake. It’s the absolute integrity of the way we run our judicial system.

  147. In September presiding judge Sharon Keller turned down an eleventh-hour appeal from Death Row inmate Michael Richard because it was going to be turned in a half an hour late. “We close at five,” she said.

    Keller did not turn down an appeal. She said she would not order the courthouse be kept open for the defense attys to file it afterhours. The defense attys should have contacted the judge handling appeals directly and arranged for an after hours filing, either by fax or by delivering it to the judge personally at her office or at her home. This is the routine in death penalty cases. Why no one has asked the defense attys why they did not do this is troubling. Because when all is said in done – it was their responsibility and it was they who dropped the ball. Regardless, Richards was guilty and would have been execute.

    This is not the word of someone who used to work for Hood and it’s not the word of a bitter cuckhold.

    No, it’s the word by someone who left the DAs office and became the president of the Criminal Defense Attorneys Association but never felt it necessary to come forward with the allegation until now.

    Also, the allegation did not first arise in 1995, in that Haynes said he was aware of the allegation at the time of trial but did nothing about it.

    And this is why the CCA needs to grant this writ and not, as it has done over the past ten years, rush to execution.

    Rush? Mr. Williamson and Ms. Wallace were murdered in 1989. Hood was convicted and sentenced to death in 1990. 18 ½ years is not a “rush.”

    The allegation today, is no stronger than the allegation Haynes was aware of back in 1990. There is no evidence of bias in the trial and by doing nothing for almost 19 years, the defense waived the argument.

    And in Hood’s case this is not what happened, at least until it has been thoroughly investigated. And even if you are pro DP, you have to open your eyes for this and grant this man a stay and/or a new trial.

    I really hesitated to add comment because the climate of this forum is so hostile and bias. Any statement that questions the popular perspective seems to be attacked with an immature, simplistic and ignorant response. I debated whether to waste my precious time and energy by daring to offer an opinion that would no doubt be wasted and inevitably ridiculed by a forum of ignorant, arrogant and (from what I can decipher) uneducated, close minded, dumb contributors. Ultimately I was so sickened by the comments here that I was compelled to counterpoint the dogma. I will not be particpating in this circus beyond this so tear apart my take to your heart’s content – I have better things to do than read your bullshit.

    Your apparent zeal, relish and lynch mob mentality surrounding the imminent execution of Charles Hood is sick and twisted. While I have the upmost compassion for the family of the victims the death of Charles is simply another tragic event in this sad story. Killing him will not restore the lives of the victims and condoning his state sponsored murder exposes all of you who judge and condemn him as hypocrites. Your argument is that he deserves death because he is accused of taking another human life and therefore should forfeit his own (medieval concept but anyway). You say that murderers should be denied compassion or consideration for the circumstances that may have caused them to not respect the sanctity of human life yet in this barbaric spectacle and blood lust for his execution you illustrate how any human being is capable of endorsing murder if they are conditioned to believe it is acceptable. Capital punishment, no matter how sanitized is still murder and anybody who accepts, supports or implements it is responsible for the death of a human being. Any defence to this is to echo the Nazi’s on the ground who delivered the holocaust because they were following orders and believed in the cause.

    Until we can say that the justice system is infallible we should not be enforcing irreversible penalties. Before you attack those from the UK and Europe who oppose you remember and respect that we are a much older, more mature culture who has learned the harsh lessons of imperialism and capital punishment, America is in it’s infancy and seems slow to catch on. Look at how you are perceived beyond your borders.

    I write to DR inmates not to satisfy any morbid curiousity or because I am lonely. I don’t send fan mail, I am not a death row groupie nor am I religious and on a mission to save souls. I feel for men lost in a flawed system. Brutal conditions of isolation and a belief that they were beyond redemption created a torturous regime conceived to temporarily store ‘bodies’ prior to execution but these men suffer in this limbo for years. This is not acceptable from a ‘civilised’ democratic society. A human being can be worth more than their darkest moment, a potential that is snuffed out by execution.
    I disagree with capital punishment across the board but to humour you I understand that a key tenet is that the offendant can never be released into the general population of a prison or society again. There is no way you can argue that based on their previous records and crimes that all of the current death row population would pose a further threat to society. There are individuals who perpetrated worse offences yet they are serving life sentences with the possibility of parole because they had better attorneys, plea bargains or luck. In this corruption there is a valid argument that many death row inmates have been wrongly convicted and that even the guilty could be rehabilitated to lead meaningful lives and repay their debt to society.

    Robbie, I find it bizarre that you mock those that attach themselves to DR inmates when you have now befriended a relative so you can finally get your wish to attend an actual execution and see the life being drained from Charles Hood- I hope it makes you happy and you get a kick from it.

  152. I have watched and read this blog for some time. My name has not come up, but Ron Williamson’s son will certainly remember me.

    I was one of Ron Williamson’s closest friends. I was a pallbearer at his funeral. I had to be propped up because I was near collapse in my grief.

    Tracie was NOT what she has been referred to. She had some hard times, but she found her way out of them and she met Ron at the same time he was dealing with becoming older. As I was. She was kind to a fault and as honest a lady I ever met. She helped me during a difficult time and I am proud to say my 30th wedding anniversary is coming up.

    I could bring the server hosting this blog to it’s knees if I listed the good deeds that Ron performed. We helped each other as we grew our businesses. He could never turn away from someone in need. Many of us warned him that he shouldn’t be that open. I, as others, warned Ron not to hire Hood. There was just something that made your skin crawl – but – Ron wouldn’t hear of it. His reply was that Hood was just a kid that needed help.

    The day before Ron died we had lunch. I had to go to Oklahoma City. This was the days where cell phones were intermittent. On the way back, halfway, I got a call from the Plano police. They broke the news to me. I almost wrecked. The said they needed my help. I damn near burned up an engine getting the last 100 miles back. I guess I knew more about Ron than most. I told the cops to trace the cell phone in his beloved caddy. We looked where Ron kept his gun (gone). The safe in his closet burgled.

    I help track down that despicable cretin. I would love to be there when they inject him. I testified against him and when I was on the stand I looked straight into his malevolent eyes filled with hate the whole time.

    I would like to pay back the look.

    Either way he will be in that particular hell that evil needs to be.
