One of the most watched and controversial executions is going to happen today here in Texas — Jose Medellin, who participated in one of the most gruesome and disturbing murders in Houston history.

Medellin and his gang were responsible for the deaths of Jennifer Ertman (14) and Elizabeth Pena (16). Each girl was repeatedly raped by Medellin and his fellow gang members, and then finally beat and strangled to death. One of the gang members later bragged that he stepped on the neck of Jennifer Ertman in an effort to strangle her because the “bitch wouldn’t die” after being strangled with just a belt.

Medellin has been fighting to stay alive — not because he’s innocent. No, he fully admits that he helped to rape, beat, torture, and murder those two children.

His appeals are all based on the fact that he’s an illegal alien in our country, and that when he was arrested and confessed to the murders, he was too stupid to ask to speak to the Mexican consulate (he was not denied the right to speak to the Mexican consulate — he just never requested to do so).

He did finally bring it up. 4 years after he was sentenced.

The World Court has tried to stop the executions. The UN has issued a statement “prohibiting” Texas from carrying out our laws. Even President Bush has tried to intercede.

But thankfully, we are a country of laws. And, more importantly, a sovereign nation of laws. And the Supreme Court of the United States has sided (rightfully so) with Texas:

Chief Justice John Roberts, writing for the majority, disagreed. Roberts said the international court decision cannot be forced upon the states.

The president may not “establish binding rules of decision that pre-empt contrary state law,” Roberts said.

I’ve been following and writing about this since early in 2005. I’ve heard from family members of the victims, and friends and acquaintances of the condemned. It’s been a long nightmare for everybody involved.

One of the gang members, Sean Derrick O’Brien, has already been executed for his role in the rape and murder of Jennifer and Elizabeth.

Today, Jose Medellin will join him in hell.

Peter Cantu, the leader of the gang, is still waiting for an execution date.

UPDATE II (8:52 pm CST): Dammit. Looks like the SCOTUS has decided to review Medellin’s case. Which means he gets to live at least a few more months.

UPDATE III (9:58 CST): SCOTUS turns down the stay. Still 2 hours left to carry out the execution (the Warden needs a full 45 minutes to carry out the full procedure):

HUNTSVILLE _ The U.S. Supreme Court has denied an appeal by Houston killer Jose Medellin, who is now scheduled to die before midnight for the 1993 gang rape-murder of two teenage girls.

His execution, earlier scheduled for 6 p.m., was put on hold as the Supreme Court court considered his appeal for a stay.

Hundreds of comments in today’s Houston Chronicle about the execution — almost every single comment is like this one:

I still remember reading about this crime after the police arrested these animals. One of the juveniles who spilled his guts to the cops said the girls were crying and begging for their lives as they were being raped. One was killed first while the second girl watched. Capital punishment is despicable and uncivilized. But in this case, the punishment fits the crime. I hope they are all executed. Especially Cantu, their so-called “leader.”

This is a good example why juveniles should not be exempt from the death penalty. They should all be executed.

In their response to the current USSC appeal, Texas said that in other cases, “The State of Texas will not only refrain from objecting, but will join the defense in asking the reviewing court to address” such an inmate’s claim that violation of Vienna Convention consular rights caused legal prejudice during his prosecution. However, they will not back off on their claim that Medellin has had sufficient review on the issue, he was not prejudiced, and the execution should not be stayed.

What is with Bush and his love for illegals? He doesn’t flinch when it comes to executing American citizens, but this vicious animal he defends. At times I wish I never would have voted for him. In many respects, he was the devil I did not know .

I read some piece in the WaPo a few days ago, admonishing Texas, and claiming the Pardon and Paroles Board, and the Gov. should give this murdering bastard an eight month stay. This so Medellin’s attorneys could try more weasel ploys. His attorneys have filed some motion with the SCOTUS, but don’t remember the details, and didn’t save the op-ed. The point of the piece was to say the individual states are required to adhere to international treaties the U.S. government signs. That’s why I understand why W had to express his position on the matter, there is the diplo-dink aspect his position has to observe. As a state, I agree that we are not bound by such edicts, and am pleased the SCOTUS ruled that way.

To me, the larger message is, weasel if you will, but if you come to Texas, irrespective of your status as a legal or illegal resident, don’t harm our citizens, or there will be consequences. The Mexican Consulate could not have altered the decision of the court, and all the reviews. If Medellin’s dispatch to Hell can give the families of the victims any comfort or closure, it is well worth it. If it will dissuade one illegal alien from committing a crime, it is well worth it. If this sentence reinforces our state’s view of justice, then it is certainly well worth it, and I give one peanut farts worth of interest in what the *spit*UN*spit* or the World Court has to say about it.

Someone on another forum with connections to the US Consulate has said that these threats by thug huggers that Americans will be at risk if Medellin is executed are b.s.

It will be interesting to see if in the other 50 cases when the courts find there was no prejudice whether the defense will file another complaint with the ICJ. I think they will and the ICJ will find prejudice and order us not to execute them. Then, we will be back to step one.

Robbie, I just found this website while googling more information about Medellin. I saw an old forum blog about the case and people from other countries who were actually writing this piece of garbage. I was shocked. Your writing on that blog was amazing.. I just wish I would have found it sooner to back you in the debate.

Today is the day that justice comes for Melissa and Adolph Pena.. and Randy and Sandy Ertman.. Medellin deserves everything he is getting and more. I am very proud of Rick Perry for not caving to the UN and President Bush.. The United States Supreme court ruled that Bush had not right to try and intervene with this execution.. the Texas Court of Appeals held it up, too.. and Perry sided with them –rather than the World Court and Bush..

Thank goodness. 4 more hours and the world will be a better place.

Interesting. VERY interesting.

There is absolutely no doubt that Medellin committed this crime. He confessed to it — there were others there who confessed to it. He is using the fact that he was a Mexican citizen as a crutch to avoid the sentence a jury handed down.

His nationality is the only thing that separates him from the other co-gang member/rapist/murderer who has already been executed over 2 years ago for the same crime.

He grew up in the United States, albeit illegally — he still shared in all the benefits that living in America provides. And now he thinks he deserves preferential treatment based on where he was born (yet not raised). Why in the world should he not be punished the same as the others involved solely based on his nationality?

4 hours and 3 minutes until go time for Medellin - I wonder if he’s scared? I hope he’s 10x more scared than Jennifer Ertman and Elizabeth Pena were in the last hour of their lives. :(

Don’t let W off the hook with this case. I don’t know how the son of a bitch can look into his own daughters eyes and take the side of medellin. Jennifer Ertman & Elizabeth Pena are about the same age as the Bush twins. He does seem to have a thing for illegal alien criminals.
The other best case example is Ramos & Compean. The two border agents sent to prison for shooting an illegal mexican drug smuggler in the butt. W has received thousands of letters and requests from congress to pardon the agents. W has not made a move to pardon the agents. Even Dana Roybacher (Republican) called bush mean spirited. Oh, I almost forgot. He did pardon scooter libby. Interesting.

One, Bush as head of the executive branch had to intercede. At this point, it is moot since the execution will go forward and the courts will go through the motions of review and reconsideration on the other cases with minimal or no delay. However, this is a good warning to us not to allow our rights as Americans to be taken over by foreign courts. I believe the ICJ will again try to interfere with the death penalty in this country.

Two, if Bush grants a pardon, it will be in January, right before he leaves office. Normally, I would be sure he would grant it, but with his special relationship with Mexico, I have my doubts.

Now, he’s really going to die, finally. The USSC split 5 to 4 to go ahead with the execution.

Jesus, robbie. I read the announcement denying the stay, read your post that it was granted, went back and reread and thought it said stay granted, read it 2 more times. The execution is on for tonight.

I thought SCOTUS went on vacation in June, and that they had to take turns answering the phone, while they were in recess. How did they vote on it, by teleconferencing or email?

The State of Texas just gave the finger to the World Court, and the Government of Mexico.
