UPDATE — I just got off the phone with Julie, Tracie Lynn Wallace’s big sister. Her plane just landed in Dallas about an hour ago. Her flight from Michigan lifted off about 30-minutes before the court handed down its decision. To say that she is livid is a gross understatement. Once again, the scum murderer has more rights and gets more consideration from the criminal court system than the victims families (who are themselves victims, too)

Charles Dean Hood has cheated death once again. The man who undoubtedly and unquestioningly killed two people in Plano back in 1989 has had 6 execution dates.
Back in June, Hood was just minutes away from death when Gov. Perry ordered a 30-day reprieve just minutes before the death warrant was set to expire.
Hood was supposed to die tomorrow. But a few minutes ago, a representative of the Victim’s Services division of the Texas Department of Criminal Justice called me to let me know that Hood had received another stay, and to cancel my trip to Huntsville tomorrow.
He also asked if I could get hold of Big Sis (the older sister of Hood’s victim Tracie Lynn Wallace), as he could not reach her. Unfortunately, her plane was supposed to leave Michigan en route for Texas at 3:00 this afternoon — I got her voice mail, but I’m afraid that she’s going to be very disappointed (and pissed off) when her plane lands.
Interestingly, Hood’s stay was not due to the alleged affair between the judge at Hood’s trial, Verla Sue Holland, and former Collin County district attorney Tom O’Connell.
Instead, Hood was granted a stay and will receive another hearing based upon jury instructions.
Jury instructions. 20 years later. And their nit picking about jury instructions.
The Collin County district attorney’s office had wanted to proceed with the execution, but the state attorney general’s office has filed a brief urging the allegations be investigated to protect the integrity of the criminal justice system.
I’m sorry, but Hood and his lawyers have already made a mockery of the criminal justice system, and it’s way too late to “protect the integrity” now.

If it is the issue I’m thinking of, the trial court failed to instruct the jury that they could consider mitigating evidence when deciding whether or not to impose the death penalty. Later, the law was changed requiring this. However, if I remember correctly, when Chas. D. Hood, Rocket Scientist, filed his own writ he did not allege it, therefore, the issue was waived. You only get one bite of the apple and when you are your own atty, you can not later claim ineffective assistance of counsel.
I would like to read the last minute writ his attys filed last week asking the court to reconsider the issue, but I can’t find it.
I have my own opn on what is going on here with this last minute grant, but I will keep it to myself. On the bright side, not that there is on, I believe if they prevail on the jury instruction issue, the remedy is a new sentencing hearing and another 10 years of appeals.

Yes, you do have a right to be there and you also have the right to give what they call victim impact evidence. However, what you can say at that time is limited because you will be in front of the jury and rules of evidence apply. But, you also have the right to address the judge directly right before he sentences Hood to death. You can pretty much let it all hang out and you can also slip in what ever you want to say to the piece of shit directly.

Well, there is a long way to go. The TCCA hasn’t even ruled that he is entitled to a new sentencing trial. If they rule that he has the right to a retrial, they will send it back to the trial court. At that time, I would speak to the DA and tell them that you want to offer victim impact evidence. I’m sure they would want someone from the family to testify. The reason you weren’t called to testify during the 1989 trial was because victim impact evidence wasn’t admissible then. They have since changed the laws. The way your sister has been attacked through the years by people who don’t know her is disgraceful. So, it is important for someone to be there to let the jury and the media know that to this very day, Tracie is loved and missed.

I’m glad Hood got a stay, not that I’m sure he’s innocent, but when a state takes the risk to have dp, it must take all possible precautions to offer the suspect an honest trial. Law has nothing to do with personal hate, and the purpose is to make justice, not to avenge. What if the evidence against Hood were suddenly broken (and I can tell you it happens, I’ve seen many cases in my career, even after years)? Try to believe less and to think more.
Last minute stay after 20 years?
This is why I don’t understand how anyone can support the death penalty. No justice has been served if Hood committed these crimes and ‘Big Sis’ along with other family members shouldn’t have to wait 20 years to then have to wait indefinitely thereafter.

Well i emailed Gov Perry and the Warden with my request that Hood should not be allowed to recieve letters from his scumpals.

Uh, no. The ex post facto clause only prohibits the retroactive application of new rules of evidence that lower the state’s burden of proof at trial. Since, victim impact evidence does not reduce the burden of proof, it is admissible. And, it is a rather settled issue of law.

Unfortunately, I lost my faith in the belief that some crimes are so heinous that the perpetrator will never be released when a few years back the feds paroled a guy who tortured and murdered two border agents.
And it almost happened again in 1995 when they were going to parole another federal cop killer. The parole was stopped at the last minute, the defense appealed, the federal court ordered another parole hearing. They again granted parole, the AG appealed and lost and a new parole date was set. It was just luck that shortly before he was due to be released, someone on the internet noticed that the correct parole procedure was never followed and notified the FOP and his parole was canceled. It’s a constant battle. Time goes by. People forget. Someone always has to be vigilant.

An idea. One that I would seriously consider if someone killed a relative of mine. It would have to be done correctly to avoid a solicitation charge, but I’m pretty confident it could be done somehow.
How about an “inmate bereavement fund” funded by donors? The fund would be set up to deposit ‘x’ dollars into the commissary accounts of each and every prisoner on his cell block if he happened to die for any reason. The purpose of the fund would be to help cheer up his fellow inmates after the tragic loss of their close friend and fellow inmate.

I’d donate. Contrary to what some might assume from my posts, I do think this guy richly deserves to die. But as in all capital cases, I’m not willing to toss the Constitution to see that happen. Oh, brother! No, what Matt is doing is his regularly scheduled b.s. routine. He is not qualified to determine what rights, if any, were violated and what is the legal remedy. You can’t bring back the dead but you can’t make up your own interpretations of laws to give the guilty a pass and give people the false impression that you know what you are talking about. The execution was stayed because the defense filed a motion asking the court to consider a jury instruction issue. The court previously refused to do so because Hood never raised the issue when he was required to do so and under the law the issue is waived. He was acting as his own lawyer at the time and many people in the defense bar felt it was unfair to penalize him for being a narcissistic sociopath who thought and continues to think he knows more than his attys — sort of like Matt.

After reading all of the above, I just wanted to say thank you. While this may not be the only rational post I’ve seen here I don’t recall another one. We must all accept that the rules and guidelines are put inplace for all of us to follow. If we choose not to then we are wrong. If we disagree with the laws, rules and guidelines then we should work to change them and not simply choose to ignore them.
We must all support the system in place or we must all accept that we too are at risk of not being treated to the letter of the law. We should not choose to follow the rules in one case and not another simply because if suits our needs at the moment. A constitution whether that of the state of Texas or that of the US must apply to all or none.
I believe our criminal laws are intended to protect the innocent/society in general and to punish the guilty. I do not however believe they are there for the express benefit of the families of victims. This can often be a side benefit but is not the original intent of most laws. While family members often are victimized they are not the primary victim and not addressed in criminal law. Often they are addressed in tort law but not so much in criminal law.
There are many valid reasons for this.
While I can never fully understand the depth of loss for a family member and pray I never do, I also can’t support ignoring a law out of convenience. For the record I am pro DP however should this guy not get his date for execution it is not the fault of the system or even the defense lawyers. In this case we have a judge and a prosecuter to blame. They either did or should have know better.

Well for the record I’m surprised that he got a stay for the reason he got it and not for the reason they first asked for it. I think that I predicted the stay for the affair that was going on and not for the Jury Instructions, but that is an issue also. That guy Glenn up there was right, they questioned something so they are going to look into it and that is the right thing to do.
We can’t kill someone simply because the date is set without first making sure that all the loose ends are tied up and there are not any questions about him having a fair trial. Yes, All this should have been done years ago but it wasn’t so now they will struggle with these 20 year old questions and try to figure them out.
I read that he is requesting a new trial and may even get one. Not sure that will happen but pretty sure he will be afforded a new sentencing phase because of the instructions in his first trial. One would think that he would get a new trial because of the affair during his first one also as that concerns me more than the instructions do although those two factors should both be considered.

I have to say that whatever they decide I will have my say in court, I want no loose ends, and yes they should have acted on this sooner, but as you all know I am a patient woman and time is on my side, so is freedom, neither that are really on Deans side…. If they decide a new sentencing phase, i will have my say with victim impact statements since they are allowed now, I want no one to forget Tracie, or Ron.
All i can do for now is sit and wait, just take it one day at a time. The serenity prayer says it all:

Well I am holding up just fine…. things have calmed down in here for a while anyways….. I haven’t heard anything but don’t really expect to for a while, I am not going to worry about it cuz there is nothing i can do about it. So I am not going to sweat it…… My life goes on as usual…. I have faith that the justice system will do what it needs to do, so that justice will finally be served.
Jules — if it gives you any measure of satisfaction, at least some of Charlies’ buddies on death row are being taken from him over the next six weeks (on two days ago, one tonight, and 10 more over the next 5 weeks).
Charles might start getting a little lonely on DR. Although, I hear he’s not even that well liked or regarded by other murdering and raping scumbags.
And those people aren’t usually too particular or choosy about their friends. And even they hate Hood.
Looks like even they have some standards! He will get his in the end, justice will be served. I’m sure there will be others to take their places, but thats life…

His case has been remanded to the trial court for the judge to prepare a memorandum of findings, due in 60 days, on why Hood did not pursue the conflict of interest issue for 20 years. The legal maxim is use it or lose it. This does not bode well for Hood.

One, Texas retries murderers all the time. If they can prove their case and obtain a death sentence, they will retry it. Plea bargains are offered only if there is a problem of proof. There is no problem of proof in the Hood case. The evidence of his guilt is overwhelming.
Two, multiple victims equals multiple consecutive sentences. And the sentence for each count of first degree murder is 40 years X two = 80 years. However, see above. There would never be a reason to plea bargain this case. Again, the evidence of Hood’s guilt is overwhelming.
And last but not least: Hood has not been granted a new trial because his conviction has not been overturned.

The DA objected to a special master instead of a judge conducting the hearings. The TCAA ruled in the state’s favor and sent the case back to the trial court for the hearings to be heard by a judge.

Well today’s hearing went about as expected.
We filed a State’s reply yesterday and many exhibits, including your affidavit.
They filed some pleadings today with, of course, a very different view.
The judge is going to review what the parties have filed, allow for both side to determine whether any more information needs to be filed, and decide whether any witnesses will need to testify. He is hoping to have enough information to make a ruling and findings not long after that.
It is progress, although I am sure too slow for you.

I can’t understand why he has been allowed so many appeals, I thought they would have run out by now or has he been given a new set of appeals cos of the situation with the trial judge and the prosecutor? Little confused on how that works. All I know is that once appeals have run out a potential execution date is set. Is that correct? Interesting how he talks about his “troubled” childhood. Did his other siblings experience the same problem? I assume they are not behind bars or living the life of a criminal. Just food for thought.

Judge says romance-bias claim can be reviewed

HOUSTON — A state district judge ruled Friday that a condemned Texas
inmate’s claim of judicial bias during his trial can be reviewed on
its merits.
State District Judge Greg Brewer, in suburban Dallas’ Collin County,
said lawyers for Charles Hood didn’t deliberately wait until the
prisoner’s execution was imminent when they released information
about a romantic relationship involving the prosecutor and trial judge.
Brewer said defense lawyers weren’t at fault because former Collin
County District Attorney Tom O’Connell and Hood’s now-retired trial
judge, Verla Sue Holland, “took deliberate measures to ensure that
their affair would remain secret.”
The day before his scheduled execution in September, Hood won a
reprieve from the Texas Court of Criminal Appeals, where Holland
served as a judge in the late 1990s.
Hood’s lawyers have asked the state’s highest criminal court to grant
him a new trial, insisting his right to an impartial trial was violated.
A former Collin County assistant prosecutor last June filed an
affidavit saying the affair involving the judge and prosecutor was
“common knowledge” from at least 1987 until about 1993. The time
included Hood’s trial.
As the September execution date neared, attorneys won a court order
forcing Holland and O’Connell to be questioned under oath. In
depositions, the pair acknowledged they’d had a years-long affair.
“Judge Holland and Mr. O’Connell did not abide by their ethical and
constitutional duties to disclose the fundamental conflict caused by
their relationship,” Brewer said, adding that O’Connell misled Hood’s
attorneys and Holland resisted their “investigative efforts.”
Brewer also said state attorneys could not argue that time deadlines
for appeals were violated in Hood’s case because their hands were
“unclean.”
“It is the appearance of partiality that is damaging to the public’s
confidence in the integrity of the judicial process,” he said.
Attorneys for Holland and O’Connell have declined to discuss the
case, citing a gag order.
Brewer’s findings, released Friday, now go to the appeals court,
where the judges there can either accept or reject them.
Hood, 39, is a former bouncer at a topless club who was 20 when he
was arrested in Indiana for the fatal shootings of Tracie Lynn
Wallace, 26, an ex-dancer, and her boyfriend, Ronald Williamson, 46,
at Williamson’s home in Plano in 1989.
Hood has maintained his innocence. He was driving Williamson’s
$70,000 Cadillac at the time of his arrest. Evidence against him
included his fingerprints at the murder scene. Hood has said he had
permission to drive the car and his fingerprints were at the house
because he had been living there.

Hood never had permission to drive that car let alone to drive it to Indiana. And it wasn’t just his fingerprints, it was his BLOODY FINGERPRINTS on the door to the room where Tracie’s body was found and on the trashbags he put over her body. Williamson had called 911 and Hood’s voice can be heard speaking in the background. When the police arrived only 3-4 minutes later, they find two people shot and Hood gone. Hood stole and used Williamson’s credit cards, stole his gold watch, pawned rings that Williamson had kept in his safe, and attempted to cash two company checks that he had stolen and forged Williamson’s signatures on.
Maintain his innocence, my ass. As Hood’s own attys said about him: “I don’t think he told us a single truth other than his name.”

There are plenty of issues for the Court to address with the trial court’s findings, so I am not really surprised that it is still pending.

I actually think both the Defense Attorneys as well as the Anti Death penalty groups have done such a great job of “muddying” the waters on this issue. I know the 8th Amendment to the Constitution prohibits Cruel and unusual punishment. But I will NEVER agree that lethal injection is Cruel and unusual punishment. I also don’t feel that the founding fathers meant this to mean that a punishment should be painless. For the record I can live in a world that has the Death Penalty and a world that don’t. I just get upset at people that feel that their opinion is right and they have the moral high ground, and over the last 30 years this seems to be the anti death people.
I also agree that in this case the Courts as well as the Governor have made a joke out of this process. This vermin should have been pushing up flowers a long time ago.

I know in a constitutional Republic the minority is protected from the tyranny of the majority. I have no basic problem with this, as I am part of that minority in some issues. These protections are put into place to protect people’s basic human rights. In my opinion the death penalty is NOT a violation of someones civil rights, actually it can be argued that it “fixes” a civil rights violation, because Cold blooded murder is the ultimate violation of someones civil rights. What pisses me off though is statist Judges that “piss” on the rights of the majority. In this Death penalty issue this is whats happening. The people through their elected Representatives have caused to be made into law this sentence. The people have that right, and the right to NOT want these vermin out into society OR be feeding and housing them. SO this is my message to any and ALL of you anti DP people. If you want to stop this, get a Majority and change the laws through the legislative process and STOP using the Judicial Branch to thwart the will of the Majority.

hmmmmm not sure on that one. if he was and it was mentioned in re-trial it would effect sentencing outcome.
Though Hood denies that he had a defense psychiatrist appointed, one did examine him and diagnosed him as having an anti-social personality and in the future was likely to act out his aggressions on other persons or property. The defense did not call him to testify.
The state’s psychiatric expert testified that in the future, Hood would probably commit criminal acts of violence and therefore was a continuing threat to society. There was also testimony that he had an antisocial personality disorder, was a sociopath with little chance of rehabilitation, and would more likely than not pose a future danger to the public.
Jeez I wonder why they didn’t call the appointed defense psychiatrist!!!! It only would have collaborated what the states psychiatric expert testified to… No big surprise there.
I can see no reason that his pathetic sociopathic ass should have any consideration in changing the penalty of death. He gave no consideration to the victims. If it had not been my sister Tracie and Ron it would have been somebody else…

I hope that justice will be served sometime soon so that this nightmare will finally end for you and your family. I further pray that, once justice is served, you and your family will find the level of peace you so richly deserve. Hopefully, the knowledge that justice has been served will allow all of you to more fully enjoy the many wonderful memories you so obviously hold of your sister.
It is so touching and awe-inspiring to observe your faithfulness to Tracie, which you demonstrate by continuing in your role of protective older sis’ after all these years. I am so very, very sorry that you had to suffer so much due to losing her in such a manner.

Sorry for my late reply. I just wanted to say that I am extremely supportive of your efforts to keep your sister Tracie’s and her friend Ron’s memories alive. That is exactly what I feel is most important in honoring any victim of a violent crime. We, as a society, owe them that. We should provide a voice for the voiceless. An additional duty we have, as a society, is to ensure that justice is served in response to their wrongful deaths.
I am grateful to you for speaking out on behalf of your sister. I am also grateful that one of Ron’s good friends posted on one of these threads, testifying on behalf of Ron’s good character. I wish that, rather than showing photos of the killers in news reports, MORE photos of the victims would be shown for the express purpose of providing to the public a face/human identity to attach to the victim’s name.
No victim should ever be thought of “just another victim.” All victims have names, faces, preferences, personality quirks, strengths, weaknesses — the entire gamut of what makes us human. Their murderers may have chosen to have treated them as less than human, but we have a duty to remember them and to treasure their humanity.
I hope this makes sense. I have felt this way as long as I can remember. I always had an inherent sense of the above since I was a child and began reading in the newspaper about crime.
Finally, I want to encourage you to completely disregard anyone who ever tells you that you are “psychotic” in your faithfulness to your sister’s memory and human dignity. It is painfully apparent that it is your love for your sister that drives you. I admire you for your steadfast devotion to her. I just hope that this ordeal will be over soon so that you can finally relax some in your vigilence, thus allowing the healing process to continue without distractions and obstructions. I am also very glad to know that you have been able to release some of your pain and to find so much support through engaging in dialogue with your many friends. I cannot believe anyone convicted as he has been is still sat on death row 20 years later, I don’t know whether I am pro or anti dp. I don’t know enough about it to comment.

Great question, Big Sis: Where IS he getting the money for all the attorneys? No doubt some are doing pro bono work, but I highly doubt that all of them are (or have done pro bono work throughout this loooong ordeal). Then again, for what purpose do we think he has his little “fan club”? He has to drum up some money somehow. Plus, he, no doubt, loves all the attention.
It seems that I have not yet read far enough back on the old threads to realize that you actually wrote to Hood. Unfortunately, I do not have time to hunt these old threads down and read through them at the moment (the thread I’ve read so far was LONG!). I cannot help but wonder if you were able to learn anything worthwhile and whether this experience revealed a glimpse of whatever it is that he has inside him which enabled him to do the unthinkable to two fellow human beings. I would imagine that receiving letters from him must have been a nauseating experience.
I am so sad that you have been forced into the position you are in, where you are simply trying to make sense of your sister’s senseless death. Oh, how I wish I could offer up some wisdom to try to help you make sense of it, but there is simply no sense to be made of Ron’s and Tracie’s deaths. I have always had the understanding that criminals who are incarcerated could not profit from books, movies, or other things like that.

Duh. I just realized. He’s been declared indigent and he is not paying for the attys representing him. Either way, he’s making money based on the fact that he committed a crime and that is illegal.

No retrial for condemned man after judge-DA affair

DALLAS — A Texas death row inmate won’t be able to argue for a new
trial, despite admissions of an affair between his trial judge and
the prosecutor.
The Texas Court of Criminal Appeals issued a ruling today that
convicted murderer Charles Dean Hood should have raised concerns
about the affair between the now retired court officials in earlier
appeals. The ruling overturned a lower court’s recommendation that
Hood be able to argue for a new trial.
Current Collin County prosecutor John Rolater called the ruling “a
significant success.” Hood’s attorney declined to comment.
Hood won a reprieve last September, a day before his scheduled
execution. He was convicted in the 1989 fatal shootings of a 26-year-
old woman and her 46-year-old boyfriend in Plano.

I’m closing the comments to this post, as Hood’s last appeal has been denied by the Court of Criminal Appeals of Texas.
Hopefully a new execution date will be set (and finally carried out) quickly.
