On Tuesday, September 22, shortly after 6:00 p.m., Christopher Bernard Coleman will be put to death for the murder of three people, including a 3-year old child that he shot to death.
Facts of the Crime
Chris Coleman: Sentenced to die for murdering 3 people in one violent night
On the night of December 13, 1995, Christopher Coleman and two other men were driving together around Houston, TX.
They stopped on a dead-end street and waited.
Soon after, another car arrived and parked behind the car in which Coleman was riding. This second car carried four people: the driver, Jose Luis Garcia-Castro; his girlfriend, Elsie Prado; Prado’s brother, Heimar Prado Hurtado; and Prado’s three-year-old son, Danny Giraldo.
Coleman and the two other men got out of their car and approached the second vehicle, where one of Coleman’s companions spoke to Hurtado. Then, standing close to the passenger side of the car, Coleman opened fire on the occupants of the second vehicle.
When police arrived, they found Hurtado, Garcia-Castro, and Giraldo dead and Prado seriously injured. Prado survived her injuries and told police that she would never forget the shooter’s face. She picked Coleman’s picture from a photo spread nine days after the shooting. A week later, police arrested Coleman in Lawrenceburg, Tennessee.
Two Houston police officers traveled to Tennessee to bring Coleman back to Texas, where he waived his rights. After roughly three hours of being interviewed by the officers, Coleman gave a recorded statement in which he admitted being present when the murders occurred; he did not admit to being the actual shooter.
In June 1997, a Texas state jury convicted Coleman of capital murder and sentenced him to death.

On this page, Coleman tries to explain how he didn’t kill the family:
The crime I was accused,charged, convicted, and ultimatly [sic] sentenced to die for involved the murders of a Columbian [sic] family, including a three year old child. There is no doubt that this was a brutal crime with the loss of an entire family that left one survivor, the mother of the child. In total there were three deaths but four shooting victims.
That fourth victim? The mother of that family? The one who survived? She told a jury that YOU were the one who shot her and her family. Pretty damning evidence, wouldn’t you say, Chris?

As a UK citizen speaking from a country with an abolished death penalty I am unsure of exactly how I feel about capital punishment. I would have said that I was against it till a macabre sense of interest took me to the Texas state Death row website, I have read through some of these crimes and I have to say a lot of in fact the majority of these animals deserve to die, however does another human being really have the right to make that choice? Is it not the same choice these inhuman scumbags made? In the UK we have recently had a sickening case involving “baby p” now the question I have been asking myself is if we had the death penalty in the UK would it be right to execute these animals? The father in me says YES but honestly I am not sure, while I agree that the animals that perpetrate these crimes do not deserve to live what gives another individual (or a group of there peers) the right to take another human life? Does this not make us stoop to there level and therefore in a way let them win? began to raise questions about Prado’s testimony. For the first time, she
admitted to an investigator that she knew one of the attackers. She had
testified at Coleman’s trial that they were strangers.
Now, just days away from Coleman’s execution, his attorneys have obtained a sworn
statement from co-defendant Enrique Mosquera insisting that Prado not only knew
him – the two came from the same town in Colombia – but was involved in the drug
transaction on the night of the attack. Coleman’s lawyers hope the disclosure
will persuade an appeals courts to stay his execution and examine the effect the
relationship of Mosquera and Prado could have had on the trial’s outcome.
“Her testimony came in unimpeached because his lawyers did not have the
information to impeach it,” said Pat McCann, Coleman’s appellate lawyer. “I don’t
think anyone can sit there and say they know the truth. Who the shooter was is a
huge question, and for that reason, this has to be looked again.” Theory
involved a debt
Police theorized that Mosquera had arranged the attack because he owed money to
Prado’s brother, Hurtado Preinar Prado, and had hired Coleman and Derrick Graham
hough Coleman may still have been guilty under the law of parties, in which all
participants of a crime may be held equally liable, it is possible he would have
escaped the death penalty, which is typically reserved for the trigger man.

Prado’s admission would have significantly altered the way they approached the
trial. If Prado had reason to avoid fingering Mosquera, either out of loyalty or
fear for her family’s safety in Colombia, that possibility could have led jurors

“The fact that these two people knew each other has tremendous importance in
this case,” lead attorney Dick Wheelan said in his statement. “It would give Ms.
Prado a reason to lie. It would also indicate that she was much more deeply
involved in the drug trade than she admitted. It . calls into question her
truthfulness in general. Had I known there was a prior connection . it would
have changed my investigation on both guilt-innocence and punishment, as well as
significantly altering my strategy and tactics for the trial.”
Wheelan, who died of cancer last year, said Prado’s failure to disclose their
relationship “changed the complexion of the entire event.” Prosecutor’s stand
Former prosecutor Luci Davidson, who tried Coleman, said the evidence available
to authorities left them with no doubt about the shooter. She said a statement
from Graham described where the trio stood around the car. He placed Coleman on
the passenger side, which is where the shooter stood.
Both police and prosecutors found Graham credible.
“Participating in this was something completely out of character for him, as I
recall,” Davidson said. “It was even a fluke that he was there that night

On 9/16/09, the Fifth Circuit Court of Appeal found that:
1. There was substantial evidence, independent of Prado’s testimony, that Coleman was present at the scene of the murders and participated in the robbery that led to the killings.

3. Coleman has failed to show that he could not have previously discovered that Mosquera had known Prado in Columbia.
4. Argument that this information is material to the punishment phase is irrelevant because he has failed to show by clear and convincing evidence that, but for the constitutional violation, “no reasonable fact finder would have found the applicant guilty of the underlying offense as required by law.
