I’ve written about Texas death row inmate Kenneth Mosley before.
He was scheduled for execution on Sept. 24th of 2009, but a last minute stay only postponed the inevitable.
Tomorrow night, just shortly after 6:00 p.m. Huntsville, TX time, Ken Mosley will take his last breath.
Facts of the Crime
Kenneth Mosley: Other than being a cop-killer and a crack head, a pretty good guy
On February 15, 1997, Mosley murdered Police Officer Michael Moore while attempting to rob a bank in Garland, TX.
Employees called police after noticing Mosley inside the bank acting suspicious. As one of the first officers to arrive at the scene, Officer Moore entered the bank in full uniform and approached Mosley, noticing that Mosley had his hand stuck in his waistband.
When Officer Moore told Mosley to show him his hands, a struggle ensued and the two crashed through a glass window. Witnesses heard several shots fired before Mosley re-entered the bank through the broken window and was shot in the wrist after flashing his pistol at a second police officer. Officer Moore died later that afternoon from at least four bullet wounds to the torso.
Good riddance to a bad person.

The ‘crime’ is bad but the individual not necessarily. I am against the death penalty and in fact believe the people responsible for instigating and delievering the death penalty are inhumane…. I have read about this man and he like everybody deserves to live
You read about this man and you concluded that he deserved to live?? I read about this man and was grateful that he committed this crime in Texas so that he would be punished accordingly. Officer Moore deserved to live but this scumbag took that life away.

There is no such thing as “good” people and “bad” people and that is why Yvonne posted what she did. In order to be considered a “bad” person I would say at the least that this murderer would have to have murdered for no good reason. There was a good reason, from his perspective. Avoiding losing your freedom is a decent reason to hurt somebody, no matter how wrong it is. I’m not defending this dirtbag, I’m defending the fact that framing judgements in terms of “good” and “evil” is what has led to humankind’s most egregious situations of ignorance, war, and suffering. If you had been born in to a terrible situation with no way out, you may have ended up “bad” too.

This included evidence that Mosley sexually assaulted a woman in 1985; that Mosley was arrested in 1985 for possession of marijuana and possession of Chinese throwing stars, which were classified as illegal knives; that Mosley was arrested in November 1996 for stealing merchandise from Home Depot and returning it for cash refunds; that Mosley robbed a Home Depot at gunpoint on February 9, 1997, six days before the botched bank robbery that resulted in Mosley’s current capital conviction; that, roughly forty days before commission of the current crime, Mosley robbed the very same bank; and that, while in the holding area during the course of the trial, Mosley was generally belligerent and, according to the guards, made statements to the effect that it would make his day to kill another cop.”

Based on her analysis of the trace evidence, she concluded that the final gunshot that struck Officer Moore was fired from more than one foot away. This fact supported the prosecution’s theory that Mosley stepped back in order to fire a final, coup de grace shot.”

On February 15, 1997, Mosley entered a Bank One in Garland dressed in long dark clothing and a dark toboggan-style cap. Because it was a hot day, this unusual dress caused several people to notice him. One of the tellers recognized Mosley from a previous robbery at the bank. A bank manager pushed the alarm button and called 9-1-1.
Several witnesses watched as Officer Moore, who responded to the alarm, approached Mosley and said, “I would like to speak with you.” Mosley and Officer Moore began to struggle. Mosley then pulled a gun from underneath his shirt. Several shots rang out and Officer Moore shoved Mosley through a nearby window. They fell to the ground into one of the drive-through lanes. A witness from across the street saw Mosley pause to look around, point a gun at Officer Moore and shoot him. Moore was shot five times.
Mosley began to walk away from the bank but was spotted by another police officer who ordered Mosley to stop, drop the gun, and get on the ground. Mosley turned as if to shoot. The officer shot Mosley once in the wrist, and Mosley dropped the gun. Mosley then complied with the officer’s directive to get on the ground. Mosley was handcuffed.

During the trial’s punishment phase, the State presented evidence that Mosley had raped a woman but had not been convicted for it. The State also introduced evidence of prior robberies and thefts committed by Mosley, including a previous robbery of the same bank where Officer Moore’s murder occurred. Further, the State presented evidence that Mosley was disruptive in jail and threatened jailers, specifically saying on one occasion that “it would make my day to kill another cop.” Mosley testified at his trial that he did not intentionally kill Officer Moore, even though the officer was shot five times. However, Mosley concluded his testimony by directing an extremely profane and graphic comment to the jury, at which point he was removed from the courtroom..

My father was murdered in the most horrific way… I despised the individual responsible, in fact I wanted them dead. The more I thought about it the more hatred I felt, and I didn’t think life was worth living… The individual responsible is still in prison and will be free in a few years. My feelings towards them are hateful but I couldn’t see them dead. I have to live my life knowing that someone took my father’s life… I’m not a cold, callous person but someone who thinks and reacts differently to the next person…

I am a resident of Garland. We went through the grief and sadness of the horrific murder of Officer Michael Moore. He was also a contributing citizen of the community.

You are correct, it takes the will of the majority of the citizens of Texas to have the death penalty imposed, using the judge, jury and prosecutor to impose it, and the Texas Department of Corrections to carry out the verdict.
It hasn’t mattered what kind of man he was or after he made the willful decision to end the life of one our citizens who was a law enforcement officer. It is what he did at that time that really matters.
This man caused much suffering, and tonight he will pay for his crime, and he will never murder again.

As pointed out earlier, we have cheap fresh produce year round. I’ve been in grocery stores in the UK and Europe – the food looks like crap and is expensive. And because we are not euroweenies, we have teeth and can enjoy our food. I only use butter on toast and I rarely eat toast. I haven’t bought butter in years.
In half our country the weather is temperate allowing us to enjoy year round out door activities.

I’m also aware of the extensive appeals process and that a string of mitigating circumstances can save a criminal from the needle even if he’s convicted of capital murder. Doesn’t change anything. Just the possibility that one innocent person risks execution is sufficient argument against the death penalty for any thinking individual.

But in this free country that we live in, she made the choice to return to her hotel room rather then go to a hospital.

People who have suffered a fatal brain injury are not always thinking very well. There were so many fuckups from the very beginning with the ski patrol and the paramedics. The paramedics never spoke to her. They should have insisted but instead just turned around and went home.
Two hours after her injury, a second ambulance is called. Three hours after her injury, she is admitted to a hospital ill equipped to treat her. She is then *driven* to a Montreal hospital and arrives 6 hours later. She should have been transferred by air ambulance to a hospital that could provide the type of surgical care she required to live. If they had air-vac’d her, it would have taken only a 1/2 hour. But, Canada does not have a regional air ambulance system. This is ridiculous.
