UPDATE (4-19-2010) — A bit of good news today in the seemingly endless road to justice for Charles Dean Hood:
The U.S. Supreme Court rejected Monday an appeal from Charles Dean Hood, a Texas death row inmate who complained that he was denied a fair trial because his trial judge and prosecutor had engaged in a secret years-long affair.
Announced without comment from the court, the rejection appears to put the issue of the amorous judge and prosecutor to rest for future Hood appeals, though defense lawyers said they were evaluating additional litigation options.

A travesty of justice. There’s really no other way of putting it. But the Texas Court of Criminal Appeals has thrown out Charles Dean Hood’s death sentence for the 1989 murder of Tracie Lynn Wallace, 26, and Ron Williamson, 40. Hood’s sentence was thrown out because of a rumored affair between the prosecutor and the judge who heard his case;
Today’s 5-4 decision, which grants the Collin County man a new sentencing hearing, doesn’t mention the affair. The court attributes about-face to the “murky waters” surrounding “the Texas death-penalty sentencing scheme,” specifically noting that a jury instruction in Hood’s trial did “not allow jurors to give meaningful consideration and full effect to the mitigating evidence presented.”]
None of this changes the fact that Charles Dean Hood is guilty of killing Tracie and Ron. The evidence used to convict Mr. Hood was overwhelming, including:
- Hood’s voice heard on a 911 call from Williamson’s house.
- 4-minutes later, when police arrive Hood was no longer at the crime scene.
- Hood’s bloody fingerprints were found on the bags covering the victims and the one taped around Tracie’s head, on the closet door where the bodies were hastily shoved, and on the weight machine propped against the door.
- Hood was found driving the victim’s truck, cashing their checks, using their credit cards, and pawning their jewelry after the murders.
The court is not throwing out the guilty verdict. Hood will simply be re-sentenced. Hopefully, the next jury will come to the same conclusion as the first and also sentence Hood to death. At which point they should drag him kicking and screaming out the back door, into the alley, and shoot him between the eyes with a service revolver.

For those of you who have been around here for a while, you know I have a very personal interest in the case of Charles Dean Hood. Since I first started writing about Hood in 2005, I have become friends with the older sister of Tracie Wallace.
We hosted Big Sis in our home, and I drove her to Huntsville to be her support witness at Hood’s execution date back in June of 2008. Unfortunately, Hood escaped execution when his death warrant expired as he sat a few feet from the death chamber. And I’ll be back in Huntsville to support Big Sis again if Hood ever gets the punishment he deserves.
Charles Dean Hood wrote me a personal letter from death row, and I’ve received veiled death threats from Hood’s brother, James Hood.
I’ve closed the comments at the last Charles Dean Hood post, since there are nearly 300 comments. Big Sis left this comment over there before I closed it:
Although I am not happy about the decision, it is what it is. And yes they are waiting for the USSC’s decision. They can word it any way they like, it doesn’t change the fact he was found guilty. I will be there for sure. I pray for the best,he can cry and whine all he wants but in the end his will come. He very well may get life but he will NEVER see the outside. As for me I wish to see him handed the same punishment, then for sure he will no longer be a threat to other human lives. Yes the possibility exsists that he could get shanked while in the county jail, not really the way I would want it, but I certainly wouldn’t be all heart broken about it either.

Our legal system has failed us. What a scumbag.
This man, Charles Dean Hood, is my cousin. I haven’t seen him in over 45 years. As a child, he just didn’t seem right too me.If all of you could have known his parents, TONS of his actions could probably, maybe, be understood just a little.
He came from a home that was horrible.
What he did was NOT right and I feel for the families of the victims. He will pay for his actions,whether it be the death penalty or life. Either way, his life as he KNEW it, is over.
I am not here to condone ANYTHING that he has done.. All I’m saying is that this man, was CLEARLY a product of his own environment.
His disgusting father, should be sitting right along beside him.He ruined the kid that I knew.
Doesn’t Matter…. As you know I am Tracie’s Big Sister. You must be from a different branch of the family tree… Yes I can understand but others have experienced the same type of home. Yet they never killed, it was HIS CHOICE to take lives, weather or not “he was a product of his enviroment”, You are correct when you say, He will pay for his actions one way or the other. Yeah is life is over as he KNEW is, but so is our families. Im not here to argue, I’m done argueing.
My heart goes out to you and the family of the man that was killed…It makes me ill when they say scumbags like this had a bad life so they should be spared…I had a terrible life..I had no father, my mother (when she was around) abused me terribly…it was horrible…did I grow up to hurt others? NO. I have a beautiful daughter now that was raised with love and kindness…I have no sympathy for trash like this…I only pray for this all to speed up so all of you can have some sort of closure to this…Again, my heart goes out to you and I will keep you in my prayers…
A relative gave Hood a place to stay and got him a construction job. Hood didn’t want to work, got fired, was kicked out of the house because he wouldn’t find a job and pay his expenses. When he finally moved out, he stole the guy’s tools. Still, he fared better than Ron Williamson who lost his life and Tracie’s life because he tried to help Hood.
Oh My Gosh..I just read that letter..you’d think with all that time in his cell…he’d learn how to spell..too busy shouting lies I suppose…how sad it is these people that support violent offenders like this..so many times I’ve read how they state that EVERYONE is lying, EVERYONE is against them…look at the proof!

I read the history on him. Seems like he was a piece of shit even as a young boy. I think most people are good hearted….but some people simple are evil….and he seems to fit the bill.

I tried to read that letter from Hood, but my brain filters shut down. Following the words of a murderer have that effect on me.
I have to agree with you N2, I doubt there will be any different outcome. But let it not be said that he didn’t get a fair hearing, that he was heard. I do believe that he only has this opportunity to bring forth all of his accusations of biasness.

If the jury follows the evidence, and the judge’s instructions are clear and simple, he will be sentenced to death. I believe that, and hope for you and your families sakes, and Ron’s family, that the jury rules that way.

you know..the pulled the same shit with a douchebag who killed a cop, in cold blood, on the street in front of witnesses. They tossed out the death sentence and said the punishment phase had to be retried. *facepalm* They brought him here to Houston to retry it. then nothing so I’m not sure if the new jury gave him the death penalty or not.
Here’s the kicker to that particular case..the douchebag had just been released on parole like the week before. *facepalm* I’ve said it before and I’ll say it again. I’d change the law so if your career criminal loser you do NOT get to appeal your sentence. You die within 48hrs of sentence. I am sick and tired of the criminals, people who are career criminals and repeat offenders, rapists, gangbanger etc etc..getting free to walk the streets and pull the same crap again. Put a PAIR of mother @#%%^ng 9mm parabellums[or any other caliber that strikes your fancy] through their useless skulls and have done with it!

Are you referring to Anthony Cardell Haynes? The 5th Circuit ordered a new trial but on Monday, the USSC said no, and reinstated the death sentence.

I don’t think I would be allowed, but I did write him a few letters, in one of the previous threads he addresses that in his letter.
Like I said, Im not happy about it, but when it’s all said and done, NO ONE can say he didn’t get his say or fair proceeding. I have always had faith that he will get his just punishment.

Hi Catherine… hows the hormones! I have no doubt that he will get the DP again, the fact that he murdered 2 people! IF he were to get life, it goes by what the “policy” was at that time, so if life meant 20 yrs he would serve that time, but he stil would have to go thru a parole hearing, and you can BET I would be there stopping it. Even behind bars he is a threat to personell and other inmates. As I hear it he is not liked by other inmates. I really would like to know what they would say about him.
Hey Big Sis, hormones are all good (my hubby may disagree with that however LOL), about to give birth any day now, well actually I’m overdue by 5 days so will be induced next week if my daughter does not show herself beforehand. It is a shame that the Judge and Prosecuter were not honest at the time because you would not need to deal with this crap now. Crossing the t’s and dotting the i’s at the time of trial would save a lot of heartache for all concerned, but keep up the great attitude and optimism, it has seen you through before and will do again. His behaviour behind bars in the last 20 years must account for something surely, especially if he has posed a threat to others. Take care and hear from you soon. When is this new sentencing hearing due to take place?
It’s not settled. Hood has another pending appeal with the USSC and the AG may appeal TCCA’s decision to remand for a new sentencing trial.
sorry but i dont understand the american justice system. here in the UK if you are granted a new sentencing hearing. then you are given a date then on that date you are sentenced

In this situation, punishment hearing, sentencing hearing, sentencing trial, penalty phase, penalty trial, etc., all mean the same thing: 12 jurors will be selected to hear evidence and decide whether Hood is a continuing threat to society and whether considering all the circumstances there is mitigation to reduce the death sentence to life. Both sides can call witnesses and submit evidence. Since there was no lwop sentence when he committed his crimes, he can only be sentenced to death or life with parole.
Until the appellate issues I already mentioned are settled, there will be no sentencing hearing.
While I can’t see him getting anything other than a second death sentence, the hearing takes some effort. Each side will have to consult psych experts. Also, it’s been over 20 years and witnesses must be located. But, Hood supporters, don’t get your panties wet, the prosecution has plenty of experience.
And I’m going to be there too! Hopefully I will be able to give a victim impact statement, it’s a good possibilty that I might be able to.
Yes there are another issue that have to to decide upon. I doubt very much that he will be given life with parole. I sit and wait as I have for 20 yrs now, whats a little while longer, snark, snark!
Again, victim impact evidence and victim impact statements are two different things. The DA may choose to not put on VIE. However, I believe you may have the absolute right to give a VIS to the court at the time the judge sentences him to death. In other states you do.
I just realized that at the time of the first trial, VIE was not admissible in Texas. Now, it is.
At the penalty phase, VIE is admissible as rebuttal when the defense introduces mitigation evidence.
I’d be surprised if the DA did not want you to testify.
Well to be honest. I personally think that he may well get another death sentence. Just because the judge and prosecutor were having an affair it wasent on the juries mind at the time of sentencing. So if another death sentence is passed then I take it he wont have anything else to complain about

What that judge did was so lame. In every DP case they file this boiler plate motion about Art. 37.071 being unconstitutional. It isn’t.
Fine was wrong on his facts and wrong on the law. His ruling was wrong in so many ways, I can’t list them.
Some one else asked how this will affect other cases. It won’t. He’s a trial judge. His rulings have no authority over other courts. I suspect the AG will take a writ to the TCCA and get it reversed asap.
He’s also the judge who harassed a rape victim.

Not, quite. He now wants motions from both parties. He cites as proof that an innocent man was executed the Tim Cole case. Tim Cole was not convicted of murder and was not executed. I suspect that after the briefs, he will have a hearing on the issue of whether an innocent person was executed. Because he is crazy, his decision is predetermined. I would have preferred that he left his original decision stand and the DA take a writ to a higher court and get it overturned and give Judge Fine a whack. He’s really making a fool out of himself.

Yes that is correct, at the time of his sentencing there was no LWOP. And the life term, could be 15 yrs, 20 yrs, 25yrs……. it all depends on what was set at that time…..

No way would Texas release him after only 20 years. He’s dangerous. A rapist and a killer.
If for whatever reason the case needs to be retried, Texas will retry it. If they did make him an offer, he’d be dead before they paroled him.
I know the punishments have changed, but there was one period where one with a life sentence had to serve 40 calendar years. Was Hood’s crime before then?
Currently, that is what it is. However, Big Sis’s response jogged my memory. I have this vague recollection that life was much less or they were allowed early release.
When I was in grad school in California, somebody was going around raping and murdering women. When they caught him, I read that he had already murdered a teenage couple, was sentenced to two life terms, and was released after being in for only 20 years. He promptly left Texas and came to CA and started raping and murdering all over again.
I was shocked because I thought Texas was so tough. At the time, Texas may have had a critical shortage of prison space and had to obey federal orders to reduce prison population. All states needed to redo their sentencing scheme because they were still operating under the 60s & 70s touchy feely nonsense that every criminal could be rehabilitated. Most can’t.

Why? The tdcj has to comply with state law, federal orders, and the constitution. They have no say in releasing prisoners or determining their sentence.

I have lived in Plano for almost six years now, but did not become familiar with Ron’s and Tracie’s murders until I happened upon Urbangrounds. My husband and I had originally intended to move to North Dallas, but when we were looking at properties to rent, we found ourselves heading further and further away from the big city. I didn’t feel safe until we looked at properties in Plano, so I must admit I found this case disturbing when I learned about it. I grew up in a small Texas town called Pampa and there have even been a handful of murders there, so I realize terrible crimes can happen anywhere. It’s just a bit strange to realize that Hood is here again, even if he is locked away in jail.

Today the USSC will decide whether or not to grant cert, i.e., hear his case. If they deny it, Texas will move forward in holding a penalty trial. If the USSC grants cert, i.e., decides to hear the case, there is no reason for Texas to do anything until the USSC issues an opinion which won’t be until the next term.
The Supremes denied cert. Let me double check. Yep. They denied cert.
Next step is for Texas to either appeal the TCCA ruling or to go ahead with the penalty trial.

Once again, the Texas Office of the Attorney General has 90 days to appeal the 2/24/2010 TCCA reversal of the sentencing. So, unless they announce that they are going to waive appeal, you’re just going to have to wait for the 90 days to pass.

Yes, I have 2 questions regarding this case. If Charles Hood gets a new hearing with a new Jury, will they hear the case again like a new Trial, or will they read about the first one to make their decision. Next, If they give him the Death Penalty again, will he have the right to appeal again because that could take years. I don’t know much about the case but read about it in the paper so I don’t know what his rights would be, if any. Thanks for your time.
From what I understand, it is just a sentencing hearing, not a re-trial. But I had the same question. Is he able to appeal again and again if he is sentenced to death again? (which I’m sure his guilty ass will be)
He is getting a new sentencing jury trial scheduled tentatively early 2011. I’m not sure exactly how they do it. They would have to tell the jury that he’s already been found guilty. They would also give them background on the crime, however, I’m sure it would be by live testimony. I’ll ask somebody who would know.
Yes, he will have the right to appeal. But, no, it should not take years. One, with a few exceptions the TCAA publishes their opinion quickly. Two, almost all of the issues have been previously litigated.

If I were him I would take it and run because from what I have read so far, sitting on Death Row for 20 years and then being taken off for a new trial, or sentencing trial and then given life, he would be the luckiest person alive and he should shut up and do the time. How did a thing like that get this far? I guess we have to give him credit for fighting and lasting this long, something his victims were unable to do,I would just say give me the needle if I know that I killed someone. Why the hell would anyone give him credit for anything? He murdered 2 people, he’s a rapist, and a sociopath. Everything out of his mouth is a lie. His attorneys did all the work – not him. He was nothing but uncooperative with them. He wouldn’t speak to them and as one said, everything out of his mouth was a lie. His family was uncooperative, too. He benefited from changes in the law. And frankly, he should not have been granted a new sentencing hearing.

But, unless there is serious execution date set, a stay will automatically be granted and they know it.

Well I did not insinuate that he was innocent, I said it wrong I guess. I was only asking if anyone out there thinks he is innocent. How can a date of Death not be takn seriously? Are you an
Attorney that you know so much about when the death date should or shouldn’t be takn seriously? It’s not very nice of a Court to play with the lives of Families that are given a date to be there and then make them go through the pain of a stay, and do the Families of these victims just blow it off when they are informed that the condemned man has been given a date but not to take it seriously? Is that the law in all the states that have the Death Penalty? They give a date to the Family but say, Now don’t take this date seriously because the Court is just kidding and when it’s serious, we will let you know. Anyone out there one of the victims Family that they could tell me that they have had this happen to them? It’s interesting to look at it online, it tells you who was on death row and their sentence was reduced to life, the ones accuited after spending years there and the ones that either died on death row or killed themselves or another inmate murdered them. I’m not quite sure who to believe in this blog. One says something and others say something else. Anouymous answered my question but still seems a little rude to others and slao when she said to me “Q & A time is over” If I have a question, it seems that there are so many people in here that would have the right answer. I was not into death row until I started reading papers in Texas regarding the subject. Now I have learned that Texas executes more people than any other state. Does that mean that there are more murders and crimes in Texas than the other states? I’m moving to Austin next year and I have to wonder about the rate of violence there. I had heard that Austin if one of the better parts of Texas. Anyone wish to comment on that? I just want a comment, not a lecture. Thank you for your time.

I also talked to one of my daughters friends Family who moved to Austin and she said that Spicewood is beautiful, small and very safe. Our one daughters is elated and can’t wait to see her little friend again. In between talking in here to the lovely anonymous I have had time to look at a lot of cities in and around Austin. No sentence of death, no death row. Get it, rocket scientist? I think they should both get the same treatment too, but I understand why they didn’t. Hi again, I just read the story of the case you are talking about. It was very interesting. Apprently there were two hitmen. She pled guilty in 2002 for masterminding the whole thing. She planned on marrying this guy so that she could kill him and her stepson later and collect the Insurance money. Her daughter who was 16 at the time did 5 years in Prison because she knew about the plan but remained silent. Her defence said that she was on so many drugs, he couldn’t have masterminded this crime. Well it’s hard enough to plan a perfect murder when you’re straight but being higher than a kite, it’s probably next to impossible. There is no such thing as a perfect murder and this was hardly perfect. Her master plan got them all caught. Anyway, the Judge gave her the dp because she appeared cold and emotionless during the trial and her only motive was finacial gain. Maybe the two hitmen got a different Judge. I didn’t read about them, just her and she is scarry looking. lol Now you have me interested enough to check out the two hitmen and see why they got lwop instead of the dp. Later, Sue

One of the hitmen, Matthew Shallenberger commited suicide while in Prison and the other said that teresa did not mastermind the crime but that Shallenberger did. She offered them sexual favors and 1200 bucks. One shot the hubby and the other one shot the stepson. Her Husband didn’t die right away and told the cops that his wife knew who did this, and then later he died. They were supposed to share the stepson’s life insurance and the hubbys estate. She is scheduled for a lethal injection this September and they have already asked for a stay so we will see. OK time for bed. Night. LOL

I know that murder with special curcumstances does not mean death and that there is much to consider if it is a death trial. The Court takes much into consideration when it comes to the dp, so I am reading and getting informed elsewhere and I must say that this is good study for me. I have lost a loved one to a violent criminal which is how I came about finding this blog. Robbie’s posts are very detailed and interesting on different cases as well as NO2Liberal’s posts.
Other than Off2DR, this is one of the few blogs that (usually) discusses the facts and issues. When ignoring the hateful people that just seem to enjoy reading their own words and attacking people, the other information is quite interesting and informative.

From what I have seen in the past, I think this is a “he” and definitely not a family member of the victim.
From the sister’s comments, she has always stated the truth and her feelings (which we could all relate to if losing a loved one in a similar way). Anger is natural when a loved one is taken in such a senseless way.
From what I have seen, he just likes to argue rather than try to relate what a pro dp person feels and thinks. Victor, there is no re-trial.
He was found guilty and all appeals and reviews have upheld that jury verdict.
What is happening now is re-sentencing.
This will be conducted under the sentencing guide lines in effect at the time of his guilty verdict.
He either will get the death penalty or life in prison. It is highly unlikely that his new sentence will be any different than the original.
We fully expect another capital punishment sentence.
In Texas capital cases, after guilt is determined, a jury must unanimously answer yes to two questions: Is the defendant a continuing threat to society? And do mitigating circumstances exist that warrant mercy?
Unfortunately, it only takes one asshole to screw it up resulting in an automatic sentence to lwop or in Hood’s case life with the possibility of parole.
One of the problems with capital cases is that the USSC keeps changing the law. Texas will follow the current law and then wham! — it is changed and the conviction reversed. So, contrary to the antis and all the others who disparage Texas, Texas handles capital cases quite well and most reversals are not the result of of the cases being mishandled.

In the Rivers case noted in today’s News Scan, the “inadequate” jury instructions in a 1988 trial tracked the statute that the Supreme Court had reviewed and upheld 12 years earlier in Jurek v. Texas. The problem here is not trial court error, but the Supreme Court’s inability to agree with itself from one year to the next what the Constitution requires and what it forbids.
The Fifth Circuit also maintains that Penry error is not subject to harmless error analysis.

We noticed not one anti came to the board which was unusual but considering his admission to the horrible, violent, vicious crime and him celebrating and boasting afterwards, at his brothers, in jail and in court, I guess they realized that to support him at all is a travesty.

NOW, if the death penalty was revoked, and vicious killers were to live like that lwop in a small cage, there would then be opposition to that. And one of the main questions the law states in choosing the death penalty is…does the evidence show and the history…that the perpetrator will harm again? If so, the death penalty is given. Our correctional officers deserve as much protection as the public does. If you need more proof, watch Lock Up on National Geographic. It will show how much danger they are in with so called “regular offenders”. Those that are sentenced to death have shown by a proponderance of the evidence and their history that they are capable of hurting again and must be stopped. That is why the Polunsky unit is a major lock down. To protect the correctional officers that must contend with them on a daily basis.

Unfortunately, most people think when they set an execution date it is more likely than not going to happen when on most of them, all the defense has to do is file a motion to stop it because appeals are pending.
Texas use to be quite good at setting execution dates when appeals were not exhausted to keep these cases moving forward. It forces the defense to file their writ/appeal. Otherwise, there are these huge lag times. The defense knows they can’t win on most of these cases so their true goal is to delay the inevitable as long as possible. Texas generally keeps the pressure on.

You, I have been on a Jury so yes, I know the rules of a Jury. Believe me, what ever you hear in the Court room once you get into the Jury room doesn’t mean you are going to follow the Jury instructions. If you are lucky, 2 or 3 people actually listened and agree on testimony. In the end you vote your gut. I am pro Procecution and the evidence was there so I voted guilty. There were finally 10 to 2 in favor of Guilty and it took us 4 days to get one of them and we knew if we got one, we would get the other so we went after the one. Once she changed her mind because she had a headache, so did the other one and we got a conviction. The dumb girl said she had nothing against cops, and they were involved and once we got into the Jury room, all of a sudden she didn’t like cops. You never know what is going on in a Jury room, or what they are talking about. You think I am against the DP, but you are wrong. When the Judge tells you to ignore something a witness says, he can’t un-ring the bell because that is the first thing some of them wanted to talk about. I have been on 4 Juries so don’t tell me what goes on in Court. You can read the testimony all day long but you can not read how a Jury came to a conclusion unless some of the Jurrors want to talk about it, and I chose not to.
