David Lee Powell: 32-years older than the last picture taken of APD Officer Ralph Albanedo

UPDATE: He’s dead.This final story had to be exceptionally difficult for the Austin (anti)American-Statesman “reporters” Chuck Lindell and Tony Plohetski to write, considering their considerable man-crush on this piece of shit murderer. I’m surprised they were able to write it through their giant crocodile tears and before rushing off to mourn with other Powell supporters.

Last Meal:

Four eggs, four chicken drumsticks, salsa, four jalapeno peppers, lettuce, tortillas, hashbrowns, garlic bread, two pork chops, white and yellow grated cheese, sliced onions and tomatoes, a pitcher of milk and a vanilla shake.

In 1978, David Lee Powell, heavily armed and warped out of his brains on another one of his frequent drug binges, shot Austin Police Officer Ralph Ablanedo to death with an AK-47 assault rifle.

Sitting in a car that had been pulled over on a dark Austin side street, Powell sighted his AK-47 through the rear window. Police radios caught officer Ralph Ablanedo’s scream as the first bullet penetrated his bulletproof vest. Nine more shots found their mark.

The well-liked father of two young sons died shortly after the 12:30 a.m. attack.

There is no defense at all in this story. He admits to the crime; has from the very beginning. He’s not retarded. He didn’t have poor counsel. He wasn’t under 18 years old at the time of his crime. He wasn’t from a bad family.

And yet it’s taken the state of Texas 32 years to carry out Powell’s just sentence.

But the long wait for justice ends tonight, shortly after 6:00 p.m. Huntsville Texas Time (HTT).

Media and Anti-DPer’s Love Affair with a Cop Killer

This case is garnering a ton of media and anti attention. They’re all trying to make the claim that Powell’s life should be spared and his sentence commuted to life simply because it’s taken so long and really — they swear — he’s a changed man who wouldn’t hurt a fly.

Which is utter bull shit. He murdered a cop. He’s been sentenced to death by a jury of his peers. Regardless of how long it takes, justice must be served.

Our local rag here in Austin, the (anti)American-Statesman, has taken it upon themselves to write a series (this is in today’s paper) of fawning love letters (and produced one vile-inducing video story) over this Cop killer (this link shows no less at least 10 articles about Powell).

“Journalists” Chuck Lindell and (especially) Tony Plohetski visited Powell on Death Row, where they apparently fell in love with each other as the pressed their hands together against the impersonal and harsh plexiglass — the only thing separating them from consummating their unnatural man-love for each other.

If you can stomach it, go read the story and watch the video here. If you come away thinking that Powell is the victim in this saga, that was the entire purpose of the two “journalists.”

Here’s a snippet:

Texas has never executed a man after so much time has passed, giving rise to a question that speaks to a basic concept of punishment and justice: Has Powell’s execution been robbed of its meaning and purpose?

The clean-cut 59-year-old man who will be strapped to the Huntsville gurney to receive a trio of lethal drugs is nothing like the nightmare from another era. Powell’s time in prison long ago removed the methamphetamine taint that helped turn a promising honors student into a jittery, lank-haired killer, and a fiercely loyal group of supporters insists that putting him to death now would be a travesty.

“He’s the old David Powell” — intelligent, compassionate, articulate and thoughtful — and no longer poses a danger to society, said attorney David Van Os, who befriended Powell in 1968. “This is not how the death penalty was intended to be used.”

The bolded question above (my emphasis) is Lindell and Plohetski’s thesis as well as what they genuinly believe.

A Meaningful Execution

Except that Powell’s death does have meaning and it does serve a purpose. Just ask memebers of Officer Ablanedo’s family who will be on hand to see justice finally carried out.

You would think that the two “journalists” wouldn’t have even needed to write/ask that question if they’d merely understood the responses they found and wrote about:

But for those most touched by Ablanedo’s murder, Powell’s execution remains a meaningful — and desired — goal.

Irene Ablanedo, Ralph’s sister, plans to stand at the window in the Huntsville death chamber to watch Powell die from five feet away. She will be thinking about her brother, what he meant to his family and how he was taken away too early. The pain of loss still burns.

“I can’t wait for that bastard to take his last breath,” she said. “That is what he deserves.”

For some officers, Powell’s death is a matter of fairness — an eye for an eye — that validates their service in a dangerous profession and adds a measure of protection by sending a clear message: If you kill a cop, you die.

More than 100 current and retired Austin police officers — including Ablanedo’s friends and some who weren’t even born when he died — will drive or take a chartered bus for an execution-day trip to Huntsville, which they’re calling the Journey to Justice. Those who can’t make it will toast Ablanedo in a downtown Austin bar at 6 p.m., the time set for Powell’s execution.

“It is a matter of unfinished business,” said retired police Lt. George Vanderhule, who helped Ablanedo’s widow plan his funeral. “This has gone on for 32 years, and he has managed to evade justice.”

Tonight, shortly after 6:00 p.m. HTT, David Lee Powell will finally pay for his horrific crime. And all the hand wringing and media fawning in the world won’t be enough to stop it. I’m only sorry that I won’t be around to hand Tony Plohetski a tissue so he can wipe away the tears of sadness at the passing of his Prison Boyfriend. Perhaps he can find some sympathy over with the rest of the twisted death row inmate groupies over at Prison Talk.

Officer Albrenados death is not acceptable (and I am ex-Law enforcement myself). His family deserve closure. But is this “revenge” or “justice”? Most of you Police officers know no different!       • I am a former prosecuting attorney and I was one of the many who believed that he did not pose any ‘future dangerouness’ one of the conditions a jury must consider when handing a death sentence as it is evidenced by his 32 years on death row he must pay for his horrible crime but given the circumstances it is not appropriate to impose the death penalty , thus I was terribly disappointed when the governor refused my recommendation to commute david lee powell’s sentence to life in prison with the possibility of parole after 40 years as based on the old texas law that applies to crimes committed before september 1st 2005

          I’ve lost the one i loved dearly more than 25 years ago,in this 25 years or 32 years you move on and after a long time you still think of you’re loved one but you dont feel that heavy pain anymore.

        • I agree that the sentencing has nothing to do with feelings. It has everything to do with justice. The sentence was handed down after logical analysis of the facts of the case. And, no, the number of years which have passed since the perpetrator illegally chose to take the life of the victim does not water down or negate the validity or fairness of the sentencing.

          Our legal system has safeguards against errors in the form of appeals. This man had three trials to ensure that no mistakes were made in assigning a just punishment. I wish it did not take 32 years for his every appeal to be exhausted, but I am glad those safeguards are in place, nevertheless.

I am trying to determine the difference between tbs and the 12-year prison sentence that you said the perpetrator was given. I am assuming that the perpetrator is supposed to serve 12 years of minimal prison time before he becomes eligible for parole?

        • The ability to determine whether a violent offender will ever repeat his or her actions is faulty, at best. Any perpetrator with a minimal level of intelligence knows how to provide what he or she knows to be the “correct” answers — and I agree with Amarius that it is not difficult to demonstrate socially-acceptable behaviors in an environment where freedom is severely limited. This is a point that I have often made myself.

          I do not trust anyone’s opinion when it comes to determining whether or not a proven murderer will re-offend. Even if the authorities were actually able to be correct in their assessments 99% of the time, that 1% where they are wrong and the perpetrator re-offends is 100% too much for me. Any new blood from an innocent victim spilled by the hand of a proven murderer is blood that stains the hands of any collective society that supports such leniency.

  4. For the record, Powell was taken to the ER 12 hours after the shoot out. He denied having taken drugs recently. So, he was not under the influence of drugs at the time he committed the murder.

  5. The fact that it took three trials and numerous appeals to get to this point is more than enough proof that his execution is justified.
    The fact that he murdered a policeman removes any legitimate claim by the hand wringers that he should be spared.
    He was committing numerous felonies when he committed this murder. Had he not murdered officer Ablanedo, he would have served time and then been allowed to live his life as a convicted felon and the old David Powell — intelligent, compassionate, articulate and thoughtful.
    God may have mercy on his soul, not me. His execution is long overdue and 6p.m. can’t get here soon enough.
    My only regret is, an innocent chicken may be sacrificed to feed this criminal before his journey to the ninth circle of hell.

      Our hearts go out to the family and officers…I’m glad the family will have support to combat the antis staging their protest…

    • A lot of the delays in these cases are due to changes (twice!)in the interpretation of the law regarding mitigation by the USSC requiring new sentencing trials, specifically Penry I and Penry II. One Texas jurist described it as: “a dog’s breakfast of divided, conflicting, and ever-changing analyses.”

      [Penry is the creep that got his sentence reduced to life by pretending he was mentally retarded and then laughed and bragged about doing so when it was over.]

      Another big change in the law by the USSC was Crawford v. Washington regarding the confrontation clause, which required new trials.

  6. I wanted to provide a link for anyone who wishes to see the photo of Officer Ralph Ablanedo. He was a very handsome and noble officer/husband/son/father/young man.

    It is a true shame that photos of the victims are not more readily available. It is important not to allow the public’s memory of the victims in murder cases to evaporate with the passage of time. I think victims’ photos should remain front and center to remind us whose rights were so viciously violated. A victim’s rights may have been violated, but they are never terminated — no matter how long ago their lives were stolen from them.

    I think it is important for the public to always have a face to associate with each and every murder, in order to maintain perspective on whose rights have truly been violated.

    My sincerest condolences to Officer Ablanedo’s family, friends, and fellow officers. May he rest in peace.

  8. My brother in-law and father in-law are policemen, but I could not care less if it is a cop or not. This POS took a life. He decided when this human life ended. How dare he and how dare they act as if he should not pay his debt.

    Now I am ready for all the euroweenies to start crying about how I just want revenge. Fuck off… revenge is not what I am after, I want justice. We are either a nation of laws, or we are not. This asswipe has been given due process and has been found guilty by a jury of his peers. 32 years is a long time to hold off on paying a debt. Try to skip out on your mortgage for 32 years.

          Of course most of the victim’s family would want the offender dead (although not all of them). They would probably like to do it themself. I would, if one should hurt my family. You cannot sentence an inmate under a law that did not exist at the time he committed his crime. Plus, lwop would be an increase of his sentence and against the ex post facto clause of the US Constitution.

          No, you can’t send everyone to supermax or SHU. Inmates are classified by the length of their sentences and then other aggravating factors. Murderers are not singled out for special restrictions. They can move freely and can be housed with forgers or in dormitories. Prison is a very violent place and there are numerous opportunities for a murderer to continue his violent lifestyle and they routinely do so. You can have an inmate be no problems for 20 years and then viciously rape and murder a prison nurse. The people of the state of Texas overwhelmingly support capital punishment. Who are you to impose your views on them? You don’t have a clue what you are talking about so why don’t you just be quiet.

    As I understand it, there were bullet fragments recovered from the scene of the murder, which could not be ballistically linked to the AK47. The 7.62×39 will shed it’s jacket and break up when fired through a car body, these pieces will not contain enough data to satify the requirements to link them to a specific weapon.

    Because the fragments could not be linked, they were not entered into evidence in 1978.

    Defense attorneys in the 1999 rehash of the punishment phase* hoped to use these fragments, “withheld by the prosecution”, to suggest there might have been another firearm in use during the shooting, which could only have been wielded by Sheila—nobody else there, you know.

    A dirty low blow to Sheila, designed to enter a desperate measure of “reasonable doubt” and negate the whole trial.

    Because the prosecution “withheld” evidence, you see.

    Forensic testing of these fragments could not be completed in time, so the lawers took another tack…which was rejected.

    Nevertheless, the story on the internet now includes a “Sheila did it” version, thanks to idiots on the moratorium sites.

    The AAS reporters actually traced her down and called her for their story.

    In previous posts, I tried to demonstrate this statement to be untrue—more or less successfully.

    1.In the woods after the murder and gunfight, David hung the bag containing $5000 worth of Methamphetamine in a tree. Preparatory to sending someone back for it, directed by him after arrest, I guarantee. (The Boy Scout search team found it first.)

  24. Austin cop killer David Lee Powell was put to death in a Huntsville prison Tuesday night. For the family of the victim, officer Ralph Ablanedo, the execution is about relief.

  25. Austin officers who worked alongside Ralph Ablanedo, and even some who never met him, boarded buses and motorcycles Tuesday morning to make the trip to Huntsville.

    “We’re here to show support for the family in his journey to justice,” one officer said.

    Also going, Sam Cox of 590 KLBJ AM. Cox was Ablanedo’s supervisor on May 18, 1978 when David Lee Powell gunned down the 26-year-old Ablanedo on a traffic stop in South Austin.

    “He was literally executed. We’re talking about shot ten times. He shot him, he went down, and when Ralph tried to get up, he shot him again. Ralph didn’t have a chance,” said Cox.

    Cox was captured in a photo shown in the Austin American-Statesman the next day escorting a handcuffed Powell.

    “I asked him, ‘Why did you kill my cop? Why did you have to do that?’ He never said a word,” said Cox.

    Ablanedo’s good friend, Bruce Mills, was the first officer on the scene.

    “We were able to get him into the ambulance and get him to the hospital, and they weren’t able to save him,” said Mills.

    Mills later married Ablanedo’s widow, Judy, and raised his two sons. David was 18 months and Steve was five years old at the time of the shooting.

    “I would’ve rather [the boys] had their real father. I would have still known him because we were friends and I would’ve had another family. That’s how I look at it,” said Mills.

    Now grown men, they along with their mother, Mills, Ablanedo’s mom, sister, and brother watched Powell take his last breath.

    “It’s relief. That’s probably the best adjective,” said Mills.

    It’s been a long, painful 32 years. The family has re-lived the crime three times for trials as Powell appealed his death sentence.

    I try to re-assure Judy or his mom, ‘Look, this is all. It’s falling together now. It’s finally going to come to an end. It’s gonna finally be over with.’”

    On November 9, 1996, at approximately 3:30 a.m., Linda Schlueter drove from Austin to Bastrop, Texas to meet some friends. Linda was 19 years old, with long dark hair, like Stacey Stites. 62 RR 12, 108. When her friends were not at a four-way stop that was their meeting place, Linda went to a nearby store to use the pay phone, but it was broken. Linda then went to the Long’s Star Mart to use the pay phone. 62 RR 40-41. Linda was able to drive up to the pay phones and call her friends from inside of her car. 62 RR 43. They agreed to meet her back at the four-way stop. While Linda was on the telephone, a tall African American man who she did not know walked up to her car and startled her. 62 RR 44-45. The man asked Linda if she could give him a ride to his house, but she refused. 62 RR 45. Nevertheless, the man persisted in asking Linda for a ride until she relented. 62 RR 46-47. The man got in Linda’s car and told her to just go a short way down Main Street. However, as Linda drove, the man continued to direct her further out of town until they reached a dirt road that he wanted her to drive down. 62 RR 48-49. When they got to the dirt road, Linda refused to go down it, although the man persisted in asking her to do so. Finally, he asked her to turn around and drop him further up the road from where they had come, which she did. 62 RR 50-51. As the man was getting out of Linda’s car, he asked her for a “hug.” When she refused, he grabbed her hair and slammed her head into the dashboard. 62 RR 51. Linda began screaming and tried to get out of the car while the man grabbed her hair, hit her, and tried to keep her in the car. 62 RR 52. The lap belt and shoulder belt of Linda’s seatbelt were not connected. She had not re-fastened the lap belt when she had previously gotten out of the car to use the pay phone. Thus, when the door was open, the shoulder portion of her seatbelt released her, which allowed her to fight back and, ultimately, get out of the car. 62 RR 42, 52-53. When Linda got out of the car, she was not able to get free because the man still had her by her hair and was repeatedly hitting her. 62 RR 54. Eventually, he dragged her back into the car. She then tried to escape by putting the car in “drive,” but the man put his foot on the brake and slammed her head into the passenger seat. 62 RR 55. Linda again got out of the car, but the man again had her hair, so he jumped out with her and got her back in the car. 62 RR 56. At this point, the man was in the driver’s seat and began driving off. Linda then jumped out again and was dragged alongside the car, because he still had her by the hair. 62 RR 58. As he tried to put Linda back in the car, she asked him “What do you want?” The man responded, “I want a blow job.” Linda responded, “You will have to kill me before you get anything” and the man said, “I guess I’ll have to kill you then.” 62 RR 60. Linda then began to scream and tried to get underneath her car. The man grabbed her and began choking her from behind, which allowed him to get her back in the car again. 62 RR 61-62. As they continued to struggle inside of the car, Linda saw the headlights of an oncoming car. 62 RR 62. The man then let go of her, which allowed her to jump out of the car. He then drove off in her car. 62 RR 63.

    Linda tried to get help from the people in the car that had driven up, but they drove off and left her in the road. 62 RR 64-65. She ultimately ran to several houses for help until someone let her use their telephone to call the police. 62 RR 66-68.

    The first officer to arrive at the scene was Kellae Miller of the Bastrop Police Department. She arrived at 3:42 a.m. and observed Linda to be extremely hysterical and in total disarray. 62 RR 12-13. She observed that large clumps of Linda’s hair were falling out and she had a large, swollen knot on her neck, and scraped, bloody knees. 62 RR 25, 63 RR 46. Linda told Officer Miller that the man who attacked her was a black male, six feet tall, average build with close-cut hair and that he was wearing blue jeans, tennis shoes, and a white windbreaker jacket with multi-colored stripes. Officer Miller knew Reed prior to November 9, 1996. 62 RR 25. Officer Miller saw Reed at the payphones of Long’s Star Mart between 3:10 and 3:15 a.m. on November 9, 1996. 62 RR 26, 34 63 RR 51. He was wearing blue jeans and a white windbreaker jacket with diagonal multi-colored stripes. 62 RR 33-34, 63 RR 51-52.

    On November 13, 1996, Linda picked Reed out of a six person photographic lineup. 62 RR 76-78, 63 RR 19. On that day she was observed to have bruises on her neck, clumps of hair missing from her head, and her hands were scratched and bruised. 63 RR 22.

    Linda’s car was found by law enforcement the next morning near the intersection of Fayette Street and Farm Street in Bastrop, which is two or three blocks from Reed’s grandmother’s home. 63 RR 10, 12.

      How can people be so callous and self-interested to decline help to a terrified woman (or anyone else, for that matter) who is desperately begging for assistance? After the people in the car drove off and abandoned her, Reed could have come back and killed her while she was scrambling around, unprotected and vulnerable, seeking shelter and aid. For people to say they just don’t want to get involved and to justify leaving a victim at the mercy of his or her attacker is inexcusable. I understand fearing for your own safety, but I cannot imagine witnessing the look of terror on someone’s face and just deciding to pass them by and leave them at the mercy of the merciless.

      My parents had always emphasized that I should never allow a stranger inside my car. This was advice I have always followed, with one exception. When I was 20 years old and on my way back to my hometown in the Texas Panhandle one day, I spotted a car with its hazard lights blinking as it idled along the shoulder of the highway. Intuition told me to slow down and, as I slowly passed, I saw the tear-streaked, terror-stricken face of a young woman. I knew in that moment that there was no way that I could continue down the road and leave her alone in her plight. I set aside my fears for my own safety because I knew that if anything happened to her as a result of her being left alone in such a vulnerable position I would never forgive myself. I circled back around on the highway and, as I pulled up alongside her and she saw my face, her relief was palpable. She had been alone on the highway for about two to three hours, attempting to idle her broken-down car to the next tiny town. She had been heckled several times by a car full of men who had come by a few times and she was beside herself with terror that they would return. We shared the same name (different spellings) and she was just a few years older than me. I never thought that taking her to a safe place was an inconvenience or was even something to be considered as a good deed — I just considered the opportunity to help a fellow human being in distress to be a privilege and an honor. I have always that most people would feel the same.

    • This is the cliff notes version. There is no doubt that Reed violently raped and beat these women and the 12 year old girl:

      1987- Broke into woman’s apt., beat, raped, sodomized, and forced her to orally cop him. He was arrested, tried and acquitted. His defense was that it was consensual — the same defense he is using in the capital case. How he got acquitted I don’t know. He broke in and he beat her up.

      However, the rape still came in during the penalty trial. The trial was delayed until 1991 and during that time, Reed was out on bail still raping and assaulting women.

      1989 – 12 year old home alone, when a man breaks in and puts something over her face so she can’t see her attacker. He threatens to kill her. He beats her, rapes her, sodomize her, forces her to orally copulate him. She accidentally bit him and he savagely beats her and rapes her again. DNA test on the semen matched Reed but not until after he murdered Stites.

      1988-1991- Beat and raped his girlfriend and mother of his two children repeatedly, including in the presense of their two small children.

      1995- woman walking home near RR tracks when attacked and raped. Semen DNA matched to Reed after the Stites murder.

      1995- Reed dating mildly retarded woman. Her case worker noticed she was bruised. Woman told her Reed would pinch and beat her if she did not have sex with him.     Searching around the internet, a few people in comments on articles had heard that he had previously committed a couple of rapes. Other than that, there is no mention – especially no reporting — about Reed being a violent sexual predator.

      Additionally, he had raped his mentally disabled “girlfriend” (I have a serious issue with anyone claiming a mentally disabled person as their consenting sexual partner — as if such people have the competence to truly give adult consent). Anyone who takes advantage of a mentally disabled person in this way is inhuman. It was the DNA taken from the investigation of his “girlfriend’s” rape that was used to obtain a positive match to Stacey’s rape and murder.

          I’ve been gone all day and just got in. I imagine Robbie and his bride, along with the hound dogs, have been having fun all weekend.

  35. Maybe im a weak Dutch girl but my dead got killed and honestly watching someone else putting a needle in his arm wouldnt give me any justice at at all. If I wanted him dead I would have fired that bullet myself. Then it would be revenge.

    And yes my dad was’nt a cop but he was still human and our families got hurt really bad too. But that doesn’t mean I think his family should feel the same pain as my family has suffered. They don’t deserve to get punished for something their dad did.
