On August 13, 2010, the Texas Board of Pardons and Paroles refused a clemency petition from rapist/murderer/gang leader Peter Anthony Cantu (35), who is scheduled to be put to death on Tuesday, August 17, for the brutal a 1993 double rape-slaying in Houston that was one of the most horrific crimes in the city’s history.

Peter Cantu was the ringleader of a gang of teenagers who were taking part in a gang initiation for Raul Villareal, when 16-year-old Elizabeth Pena and 14-year-old Jennifer Ertman had the grave misfortune of encountering the gang, to include Cantu, Efrain Perez, Roman Sandoval, Raul Villareal, Jose Medellin, and Derrick O’Brien.

The two girls were brutally beaten by the gang members before being vaginally and anally raped repeatedly by the entire gang.

Evidence showed Cantu kicked Pena in the face with his steel-toed boot, and then crushed her neck with his boots. Ertman was strangled to death with a nylon belt. Their badly decomposed bodies were found in the park 4 days later.

Cantu, who was 18 at the time of the slayings, and four companions — all 17 or 18 — received death sentences. Two already have been executed (Medellin and O’Brien). Two others had their sentences commuted to life after the U.S. Supreme Court barred the death penalty for those who were under 18 at the time of their crimes (Perez and Villareal).

Medellin’s brother, Vernancio, who was 14 at the time, is serving a 40-year prison term, the maximum for a juvenile.

Final Exeuction

Tomorrow night will mark the third and final man to be executed in this case, though Perez and Villareal deserve to die for this crime every bit as much as their three buddies who were just a bit older. I hope their lives in prison are a living hell.

I had planned on riding down to Huntsville to show support to the families of the victims as well as the other Death Penalty proponents, but work just won’t allow it this week.

  1. The only problem with the execution is that it is basically painless. The method of execution should be decided by those left behind.

    • I very much agree. I believe that using the same method as the killer used to kill his victim would be wholly appropriate. This scum should feel all of the pain that he delivered. The problem I see is that it (hopefully) may be difficult to find someone to viscously beat him, sexually brutulize him, strangle and then stomp upon Cantu’s neck until he dies. He deserves no less…

An additional note: there will another execution tomorrow: Oklahoma is gearing up, after some delays, to deliver justice to Jeffrey Matthews for murdering a 77 year old man during a burglary.

    • The old man was his great uncle. He or his co-defendant also slit the wife’s throat and left her for dead.

      Matthews set up his relatives to be robbed. The lame defense that the co-defendant is to blame is bullshit. And then there is his creepy english actress scumpal.

    It has Jose’s name on it, Peter’s buddy but Peter deserves the same…oh how I wish he could meet his demise in agonizing pain, like his victims.

    My thoughts will be with the Ertman and Pena families, the last execution to witness…so much trama, their lives ruined. The thought that any anti could support any of these guys is mind blowing. I’ve got my bull horn ready.

    But Cantu’s execution Tuesday won’t erase Houston’s memory of heinous ’93 crime

    Seventeen years later, the simple mention of their names still evokes a shudder, a shake of the head that such a thing could happen.

    Ertman … Peña. Their photos are familiar now, attached to countless news reports since then: the same two pictures, teen girls who despite the makeup were girls still. Their story has been oft-repeated, in the retelling burnished to a handful of details: the fateful choice of a route home, the abduction from the railroad tracks, the decision of one to turn back when she heard her friend scream, the clothes ripped from their bodies, the multiple and repeated assaults, the inexplicable decision that they must die in a manner equally brutal.

    They probably would be married women now, Jennifer Ertman and Elizabeth Peña, perhaps with children of their own. Instead they are forever 14 and 16, a pair of innocents who slipped into the darkness of Houston’s near north side one summer night and re-emerged in bright sunlight on a funeral home gurney — targets of a crime so incomprehensible that it was, in the words of one of the lawyers later involved, burned into the collective consciousness of the city.

    The architect of their deaths will pay with his own life Tuesday evening. The execution of Peter Anthony Cantu in Huntsville will all but end the legal odyssey that began with the arrest of six young men ratted out by a disgusted relative. It was Cantu who asserted Ertman and Peña had to be killed so as not to later bear witness against them.

    Now 35, Cantu declined requests for an interview. He will be the third of the attackers to be put to death, following Derrick O’Brien and Jose Medellin.
    The parents of Ertman and Peñ a could not be reached for comment.
    “Assuming everything goes as we hope it goes on Tuesday, that chapter of that book for the Ertmans and Peñ as will be forever done,” said Andy Kahan, the former head of the Mayor’s Crime Victims office, who now holds a similar position with the Houston Police Department. “It’s been a long journey, and for the families an emotional roller coaster.”

    Case shook city

    No crime in modern Houston history has resonated like this one, Kahan said.

    “It’s very, very rare that you can refer to a case by the victims’ families and people will know what you’re talking about,” he said.”Most people know it from the defendant’s name. But when you go around and ask anybody in the city of Houston, do you remember the Ertman/Peñ a case, they will immediately say, ‘Yes, the two girls who were gang-raped and brutally killed.’ This case galvanized the residents of Houston.”

    It also had other ramifications. Kahan assisted the girl’s parents in changing state policy to allow relatives of victims to witness executions. He also worked with former State District Judge Bill Harmon, who presided over the trial, to allow Randy Ertman to address Cantu immediately before sentence was pronounced.Victim impact statements, now commonplace, were all but unheard-of until Ertman was given leave to speak to Cantu in open court. His stinging denunciation of Cantu, pain evident in each word, reached a climax when Cantu turned away from the grieving father and Ertman yelled, “You look at me! … You’re not even an animal. You’re the worst thing I’ve ever seen. Look at me! Look at me good!”

    Kahan, who had become close to the families, said Ertman’s bellicose rebuke was an inevitable culmination of eight exhausting months and five trials filled with gruesome details of his daughter’s death.

    “No one who was there will forget it,” Kahan said.

    Unfathomable cruelty

    Then again, no one has forgotten much of anything about those murders. In June 1993, Houston was busy reveling in the boom after the bust. Jobs were back and property was rising in value. New development was everywhere, spurred by a mayor and city council devoted to the cause of building. Serious crime was still a problem, but the overall trends looked good. Then, on the morning of June 30, the city awoke to learn of events of a few days earlier that defied belief.

    Two Waltrip High School students had left a Thursday night gathering of friends in a rush to be home before their curfew. To save time, they took a shortcut that led along railroad tracks near T.C. Jester Park. By coincidence, a handful of teenagers who had just completed a boozy, fight-filled gang initiation ritual noticed their shadowy figures. The girls were grabbed, repeatedly raped, then strangled, beaten and stomped beyond recognition.

    People normally immune to the shock of another murder were stunned by the savagery of what happened on a moonless muggy night along the banks of White Oak Bayou. This was something more than the danger inherent in big-city life. This suggested a lurking evil, omnipresent and inchoate. If it could show up at such a nondescript moment – teenagers unknown to each other passing in the night – perhaps no one’s safety was more than an illusion.

    Even the police were stunned. The attackers shouted obscenities at TV cameras when they were arrested and reportedly bragged of their crimes once in their jail cells. The killers didn’t crumple or cry when recounting the bestiality of their acts to investigators. All of it – the entire ugly tableau of human destruction – was told as if it had been a TV rerun from a year ago.

    Long history of trouble

    Somehow the story became worse at trial. Cantu’s brother, Joe, testified about what inspired him to call police. The gang of attackers had showed up at his house after the killings. They expressed no regret or even a second thought at what they had done. In fact, they laughed and joked as they divvied up the pitiful spoils of the evening: a small amount of cash, some inexpensive rings and gold chains. They spoke of having “a lot of fun (with) a couple of chicks.”

    By the end of Cantu’s trial, jurors had been burdened with a load of disturbing details, not just about the crime itself, which prosecutor Donna Goode likened to the work of a “pack of wild dogs,” but about the young man who made it happen. Cantu had been troubled and violent since his early youth. He had fought or bullied other students, assaulted a teacher, threatened another youth with a knife in a parking lot after deliberately provoking a confrontation. He threatened to kill security guards at the alternative school he periodically attended.

    “He was a kid you remembered,” one former teacher said.

    Had desire to kill

    A month before Ertman and Peña crossed his path, Cantu had mentioned to his former auto mechanics teacher that he wanted to kill someone “just to see what it feels like,” according to testimony. When the teacher told Cantu the trouble he would get into for such a thing, he said he didn’t care. Possibly he did not.
    The day after the murders, Cantu showed up at his job at an oil change shop and acted as if nothing was out of the ordinary, his boss told the Chronicle at the time. Cantu was a good worker who was courteous with customers, the boss said, stunned that the “yes, sir” guy he knew changed so dramatically when the workday ended.

    Nightmare neighbor

    At home, nothing appeared to constrain him. Cantu’s mother, sometimes absent, appeared unconcerned when school officials or authorities showed up to discuss his behavior. He apparently did as he pleased. Those who lived near his home in Houston Heights described him as a nightmare neighbor – loud, obnoxious, rude and uncaring – and spoke of large groups of young men his age who would gather at the home when no adults were around.

    “Anytime girls came down the street, they’d come out and hoot and holler at them and make vulgar remarks to them,” a former neighbor said the day after his arrest.

    One night the words turned into acts. Six anonymous teens stoked on alcohol and testosterone needed only an hour or so to make their mark on the city. Cantu’s execution won’t quite bring an end to the legal saga that followed. It will not erase from memory the faces in the photographs, or the knowledge of what happened to them.

    “Jenny and Elizabeth were everybody’s daughters,” said Kahan. “This was so senseless.”

        I just read another noteworthy article that has a video linked to it with the heartbreaking footage of Mr. Ertman trying to get past the police officers to the crime scene to identify his daughter Jennifer. It also has footage of the perp walk when Cantu so famously kicked at and threatened the reporters.

      • I remember reading a thread on an anti website where one of the posters smeared Cantu’s sister-in-law Christina, saying that she was just a dishonest teenager who had given false information about this crime in exchange for a large sum of money. What a revoltingly dishonest and vile allegation.

        The gang was caught after Christina pushed her husband, Cantu’s older brother, into making an anonymous phone call to point investigators in the direction of the girls’ bodies. Since Christina expected the phone call to be anonymous, how in the world could anyone claim that it was money that motivated her to reveal information about this crime?

        She had been traumatized by the aftermath of the crime when several of the gang members showed up covered in blood at her front door and commenced boasting of their despicable actions. She herself had been gang-raped and she considered herself lucky to have escaped with her life. She strongly identified with the girls and felt tremendous sorrow for them — and she was absolutely heartbroken for Jennifer’s and Elizabeth’s parents, who she saw on television pleading for information regarding their daughters’ whereabouts.

        The people corresponding on that website were willing to completely twist and re-invent the facts — and they had no qualms about denigrating someone who was completely innocent of this crime. Yet they attacked anyone who had anything negative to say about one of the guys who actually participated in brutalizing Jennifer and Elizabeth. Rather than admitting that he was completely responsible for his actions, they preferred to divert as much of the blame as possible, insinuating that his punishment was unfairly administered due to the fault of someone else. They seemed incapable of understanding that someone, such as Christina, could truly be motivated by compassion (and a sense of justice and moral indignation on behalf of the victims and their families) to provide circumstantial information about a crime to which she had been privy.

        If you read between the lines of that thread, those people seemed to imply that Christina should have just kept her mouth shut regarding what she knew about this crime — and to hell with justice for the girls and their families. If Christina hadn’t pushed her husband into anonymously calling the authorities, then the bodies of the girls would have lain undiscovered — possibly forever. Their parents would have remained in limbo, continuing their fruitless and anguished search for their children and never knowing their daughters’ fate. For anyone to make her out to be the villain in this case is just unbelievable.

Some dumb female with the user name “Banshee” was going off on Randy Ertman for hating the men who killed his daughter, and basically went on to blame the victims for their own demise.       • I mentioned this pending execution to one of my daughters last night. She has two young daughters.
        She was aghast at the brutality those two young girls had to endure.
        We both hoped that the human shock system kept them from feeling the excruciating pain we associate with such a vicious attack.
        As a parent, I can’t begin to imagine the suffering they endured or of their families.
        While I can’t stand silently by Mr. Ertman tonight and place my hand on his shoulder, I will be there in spirit.
        I doubt the pain will ever go away, but time and distance from this final phase will make it more bearable.

    After today, Cantu’s name and memory will fade into oblivion, but Jennifer’s and Elizabeth’s faces and their heartbreaking legacy will remain in the hearts and minds of people all across the world. I can summon every pixel of the girls’ famous photos from memory and I will never forget them.

    Blessings to the girls and to their families. Jennifer and Elizabeth truly were everyone’s daughters, everyone’s friends. They were just your typical, average, happy-go-lucky young teenagers who were capable of eliciting smiles from everyone they met. Rest in peace, Jennifer and Elizabeth.

  40. With Cantu’s long overdue demise in the books, I don’t know who is next in line. No one else is scheduled in Texas for August or September.

      Gayland Bradford
      on October 14 and Larry Wooten on October 21.

      • I’ve seen it theorized that the non scheduling of executions may be due to the current Sodium Pentothal shortage. Supposedly, the drug company will be able to restock the drug at the beginning of the fourth quarter, i.e., October. It would explain why they haven’t set a date for Carty.

          Because the drug was over the expiration date and the judge agreed with the killers lawers that no substitute was allowed, although the action of the drug would be the same.

          A new hearing will take place at October 15 and possibly a new execution date will be set.
          He already experienced his last day two times and now a third is coming up.Although it is a killer, don’t put a person through this agony and just proceed.

  41. What agony? If it was such agony to continue living, the murderer would have not filed the appeal and requested a stay. He doesn’t think he is ever going to die. Hell yeah, the killer is benefiting. Nobody is putting him through anything.

    • Sure, you are right in a way, but just because the killer is not to be considdered human, it does not have to mean that the people who are responsible for carrying out the punishment can show no compassion.
      Everybody clings to life, so if possible the convict will use the oppertunities given by law to postpone his death.
      I only wanted to say that if everything has been proven and there is no doubt of his guilt, it seems unhuman for all parties involved to let a person experience his last hours again and again eventhough he filed the appeals for it himself.
      Think about the families of the victims who were on there way to the execution when they got the news of another stay.
      It must be horrible for them too.

      I read a lot about this case but, I’m not sure he did the crime, sure he was involved as he admits, but even the surviving aunt did not see him or recognize his voice as one of the attackers.
      He was a pain in the ass for the society overthere, but that does not make him “death row material “does it.I saw the statements of the arresting officer and read about the lack of evidence (DNA, fingerprints etc).
      Well I am not sure, but there must be a lot of evidence pointing his direction that I do not know of, otherwise he would not be where he is today.
      I read about the money found in his freezer (what he can explain), the discovery of the murder weapon behind his house, how stupid can you be ??
      Well as told, I am not sure in this case, not like Cantu, Davie, Powell, Land, Burns lately.
      Maybe we can discuss this case on this forum.
      Believe me, I am no Anti European, I wish we had this punishment in my country, because we have some who deserve it.

      • I didn’t say he wasn’t human. You did. And where did the DOC deny him compassion? You’re idea of compassion is not Matthews idea of compassion. He wanted the stay. He got it.

        And Matthews caused the delays that resulted in the drug expiring – not the DOC – Matthews. And the DOC did not file the last appeal objecting to the substitution of drugs — Matthews did.

        And what do you mean if everything was proven? He was found guilty beyond a reasonable doubt and has had years of appeals denied. And again, if it was so “unhuman” Matthews wouldn’t be filing stays to live. And what about the family of the victims? Because the family had to go through this crap once again is not a legal reason to deny the stay. The DOC has no control over drug production. Matthews filed his writ. The court had to grant it. Matthews wants to live and does not consider a last minute stay “unhuman.”

        And no, you haven’t read a lot about the case. You read what was fed to you by the abolish movement and the anti-death penalty press. And no, I’m not interested in discusssing this case. I’m sure there are other forums on the internet who are discussing it if you are curious.

          Reading about those cases will make me hopefully understand how one person can be so cruel to another with so less to gain from the crimes.
          But as I stated before there must be evidence in this case what is rock solid.
          I based my opinion (and that is all it is) on data I had.
          I think you have a wider range of acces to data and that explains your reaction.
          I can understand that.

          Perhaps this will give you something with which to start. It was filed last summer with the United States Court of Appeals for the Tenth Circuit.

          I don’t know anything about this case and, unfortunately, don’t have time to read the information at the moment, so I cannot make any useful comments or give any opinion.

        • It’s accessible via the internet: Pacer.com. But as I said previously, it’s a lot of work and there is a nominal fee that adds up. That’s why I’m not volunteering. I review many of these cases but I have to limit myself to those I am actually interested in, otherwise, it is a full time job.

          Look at the Skinner case – he posted most, but not all, of the court documents. He left off the more incriminating ones. However, if people bothered to read everything that is posted, you will find plenty of facts from the trial and evidentiary hearings proving his guilt BYRD. But few people bother. Skinner and his manwife blatantly lie about the evidence and they are never called on it.

      • Dutch: This so called “arresting officer” is full of shit. This was a homicide detective case. That he may have been present when they served the arrest warrant the following day and he was allowed to put the handcuffs on Matthews gives him no special insight. As the AG stated, the courts are aware of Mars’ “opinions” – because that is all they are. Neither the courts nor the defense, according to Mars himself, appear to find him credible. Nothing he has stated changes the fact that Matthews and no one else shot the victim in the back of his head and killed him during the commission of a residential burglary.

        • Looking at it again, the OSBI was immediately called in and they – not the local sheriff’s department handled the investigation. Doesn’t mean that Mars might not have been their for the arrest but he was a peripheral and minor figure and apparently quite a nut.

      As I read your comments, it gives a whole new perspective.
      If there was an “easy way” to read the prosecution’s (evidence)side of the case it would be easier to picture the scene and compare statements made by prosecution and defense.Previously I read about the Powell, Davie, Perry, Land, Jackson and Cantu case,in my opinion that was easier to see the guilt “floating on top”.No doubt about those cases, when you see the evidence and the confessions.
      This is the first case where I thought well …
      But now I can read about the otherside of the story.
      What also strikes me as odd, is that in many cases there is “popping up ” new evidence just before on even on execution date.
      I know this is to get a stay, but the lawers must present the judge some evidence of that in order to get a stay isn’t it?
      How can they come up with evidence they could not produce in all those previous years?
      Maybe you can explain that to me.
      Our justice system is so different (read worse) from that in the US, mainly because we do not have the death penalty (what I regret).

  44. Dutch: The arguments that you read in these cases on behalf of the defendants are arguments that have been litigated and found not to be true, credible, or persuasive. The defense and supporters just keep repeating them.

    In the early morning hours of January 27, 1994, Minnie Short was awakened by a noise in the living room of her home located in a rural area east of Rosedale, Oklahoma. She thought that it was around 6:00 a.m. and decided to get up for the day. She got out of bed and went into the living room where she was attacked from behind by someone with a knife. As she struggled with her attacker he cut her throat. Her husband Earl came into the living room and was shot in the back of the head by another person. Earl fell to the floor beside Minnie. She was told to lie still and was asked several times where the money was hidden. After ransacking the house for almost two hours the two men left with approximately $500.00, a .32 caliber Smith & Wesson, and the Shorts’ brown pickup. After the men were gone, Minnie Short dressed and went to the road to try to get help. A passing ambulance saw her and stopped. She told the paramedics that she had been cut and her husband had been shot. They bandaged the wound on her neck, which had stopped bleeding and was determined to be non life- threatening. The paramedics then went to the house where they determined that Earl Short was dead.

    When the police talked with Minnie Short she could not describe her attacker or the man who shot her husband. She recalled, however, that her attacker wore a dark jacket with a large circular design and the other man wore tan loose- fitting clothes. She also remembered that the man who attacked her had made a telephone call from her kitchen shortly before they left. When the police traced this phone call they found that it had been made at 8:16 a.m. to Bill Guinn in Oklahoma City. Mr. Guinn confirmed that the call had been made by his nephew, Tracy Dyer, who had called to say that he would be late coming to work that morning because he was having trouble with his truck. At around 10:00 p.m. on January 27 the police went to Dyer’s trailer where they found Tracy Dyer and his uncle, Harry Wayne Clary, who was visiting from Madill. Both Dyer and Clary were taken to the sheriff’s office for questioning.

    Although Dyer initially denied any involvement in the crime, he became more forthcoming when confronted with the telephone call which placed him in the Shorts’ home. In his first statement Dyer said that he and Appellant had gone to the Shorts’ house to look for money that they believed to be hidden there. Dyer blamed Appellant for the murder of Earl Short and the attack on Minnie Short but he admitted to looking for money. Dyer was arrested.

    On January 28, 1994, a warrant was procured for Appellant’s arrest. After his arrest on that same date, Appellant was interrogated by OSBI agents. A search warrant for Appellant’s home was issued and executed soon after his arrest. Police seized a pair of brown coveralls, three $100.00 bills found in the freezer, some items of clothing and a prescription pill bottle for Xanax made out to Minnie Short found on a nightstand. The backyard was searched but nothing was found there. Later, in June of 1994, one of Appellant’s neighbors found a .32 Smith & Wesson revolver buried in a field situated directly behind Appellant’s house. This gun was identified as the gun taken from the Shorts’ home by their attackers. The police went to the field with metal detectors and found another buried gun, a .45 Ruger pistol, which was later determined to have been the gun used to kill Earl Short.
    Matthews v. State (Okla. Crim. App. 1998) 953 P.2d 336, 339-340.)

          135 In his seventh proposition, Matthews claims the trial evidence was insufficient to prove beyond a reasonable doubt that he perpetrated the crimes against the Shorts because Tracy Dyer recanted his prior testimony implicating him and claimed Matthews was not present and did not participate in the crimes…

          136 Though Dyer had a change of heart in this second trial, he had in the past named Matthews as his accomplice. Other circumstantial evidence sufficiently corroborated Dyer’s first statement and connected Matthews to the crimes. Crystal Smith, Matthews’ girlfriend, testified Matthews left his home with Tracy Dyer the night before the murder and did not return that night. She did not see Matthews again until lunchtime the following day. Mark Sutton testified that it was Matthews he loaned his .45 caliber Ruger to the day before Short’s murder and that Matthews did not return it as agreed. The Ruger was later identified as the murder weapon and was found buried in a field next to Matthews’ home. Bryan Curry testified that he drove Dyer and Matthews to the Shorts’ home in December 1993 so they could burglarize it. Dyer and Matthews stole eight to ten thousand dollars from the Shorts’ storm cellar. Matthews was familiar with the Shorts because they were his great aunt and uncle. Given the success of the first burglary, Matthews certainly had a motive to be the likely participant with Dyer in the instant crimes. Thomas Tucker saw two people in pickup trucks not far from the Shorts’ residence around the time of the murder. He claimed one of them was wearing khaki coveralls. Mrs. Short said the shooter, not Dyer, wore khaki coveralls. Physical evidence seized from Matthews’ home within two days of Short’s murder, namely Mrs. Short’s pill bottle, three one-hundred dollars bills and a pair of brown coveralls, was strong evidence connecting Matthews to the crimes. This evidence was sufficient for a rational trier of fact to conclude that Matthews perpetrated the crimes with Dyer beyond a reasonable doubt. As such, this claim fails.
          (Matthews v. State (Okla. Crim. App. 2002) 45 P.3d 907, 919-920.)

          The trial evidence showed that Dyer and Matthews broke into the Shorts’ home to steal more money. Dyer attacked Mrs. Short when she came into the living room, demanding to know the location of the money that had been kept in the cellar. Since there were only two men involved, Matthews, by elimination, was the shooter. Matthews shot Mr. Short as he came to Mrs. Short’s aid, using a home-made silencer he brought to deaden the noise. This evidence sufficiently showed Matthews fired the fatal shots, intending that lethal force be used and displaying a remarkable indifference to human life.
          (Matthews, 45 P.3d at 923-924.)

  46. The State presented evidence that in December 1993, Mathews and Tracy Dyer burglarized the Shorts’ residence at night with Bryan Curry. Defendant had told Dyer and Curry that the Shorts kept a lot of money in their cellar (Tr. V 1060-61). Curry dropped off Mathews and Dyer, who went to the Shorts’ residence and took a large mason jar full of money from the cellar (Tr. V 1070-72). Curry received $3,000 for his part in this burglary (Tr. V 1072). Recall that Minnie Short testified that one of her attackers had asked what she and Earl had done with the money they had in the basement (Tr. VI 1357). Mathews was familiar with the Shorts and where they lived. Mrs. Short was Mathews’ great aunt (Tr. VI 1306). Short testified that Mathews and another young man appeared at her residence sometime after December 10, 1993, under the guise of looking for a lost hunting dog (Tr. VI 1307, 1310). The Shorts were suspicious of Mathews after this appearance and purchased a .32 Smith and Wesson that Earl Short kept under his
    pillow as he slept (Tr. VI 1312-13).

    Crystal Smith, Mathews’ girlfriend, was at Mathews’ home on January 26, 1994, the night before the murder (Tr. V 1109, 1111). Tracy Dyer came over that evening and waited for Mathews to return (Tr. V 1112). Mathews and Dyer left that night and Smith slept there alone (Tr. V 1113-14). Mathews did not return that night and she did not see him again until lunchtime the next day (Tr. V 1113).

    Minnie Short testified that she was attacked by someone the morning of January 27, 1994, as she walked through her living room (Tr. VI 1348-50). They scuffled and Earl Short entered the room, asking what was the matter (Tr. VI 1351-52). Mrs. Short’s attacker threw her to the floor and began choking her (Tr. VI 1353). Mrs. Short heard a gun click and observed her husband fall to the ground next to her (Tr. VI 1353-54). As some point, Mrs. Short’s throat was cut by her attacker (Tr. VI 1355). However, she managed to get the knife from her attacker and attempted to stab him but he choked her until she passed out (Tr. VI 1355-57).

    After she regained consciousness, her attacker asked her what they had done with the money in the basement (Tr. VI 1357). She told him she paid the bank (Tr. VI 1357). There was another person present in addition to the man who attacked her and Mrs. Short could hear them moving things around in the other rooms of the house (Tr. VI 1358-59). Mrs. Short was lying on the floor, next to her husband, covered by a blanket. She remained there approximately an hour and a half (Tr. VI 1358-59). At one point, one of the men made a phone call and said Mr. Short’s truck had broken down and they would be up there in a minute (Tr. VI 1360). Mrs. Short testified that the man who made the phone call was the one who had choked her (Tr. VI 1361). She remembered that the man who made the phone call had on a dark jacket whereas the man who shot her husband had on khaki overalls (Tr. VI 1361-62).

    The OSBI traced the phone call made from the Short residence that morning to Bill’s Concrete in Oklahoma City (Tr. IV 945, 947-48). Agent Rick Zimmer went to that location and discovered the previous occupant, Bill Guinn, no longer resided there (Tr. IV 948). However, Zimmer and another agent managed to track Guinn down. Guinn told them he had received a phone call at 8:16 a.m. the morning of the killing from his nephew, Tracy Dyer, in response to Guinn’s page (Tr. IV 953-54). Mathews conceded on direct appeal “that the evidence is undisputed that Dyer was the man who struggled with Mrs. Short and cut her throat.” Matthews, 45 P.3d at 924 n.21.

    Mark Sutton testified that he loaned Mathews his fully-loaded, semi-automatic .45-caliber semiautomatic pistol on the evening of January 26, 1994 (Tr. VII 1540, 1542, 1544; State’s Exhibit 95). Ballistics examination revealed that the bullet fragment recovered from Earl Short’s body was fired from this .45 caliber pistol (Tr. VII 1630-32). This weapon, along with the victim’s .32 caliber pistol, was later recovered from the property where Mathews lived at the time of the murder (Tr. VII 1606, 1608-09). A homemade silencer made with a mass of duct tape fashioned into a cylinder was also recovered by police from the Short residence (Tr. IV 987-88; State’s Exhibits 16 & 167).

    As noted above, Mrs. Short testified that the suspect who shot her husband was wearing khaki coveralls (Tr. VI 1362). A pair of brown coveralls were discovered in Mathews’ residence shortly after his arrest (Tr. I-B 27).2 Police also recovered from Mathews’ bedroom a Xanax bottle with Minnie Short’s name on it (Tr. I-B 48-49; State’s Exhibits 56-57).

    The morning of January 27, 1994, Thomas Tucker was driving near the Shorts’ residence around 9:30 a.m. when he encountered two pickups parked on the side of the road (Tr. IV 835-45). It appeared that two men were trying to jump-start one of the trucks. Tucker saw a man in brown coveralls get into the brown pickup (Tr. IV 845). Around the same time that morning, Dennis Hawkins saw someone driving Earl Short’s brown pickup in a fast and reckless manner (Tr. IV 874-78). Robert Gulley encountered Mathews around 10:00 a.m. that same morning at a local gas station where Mathews produced a wad of twenty dollar bills to pay for fuel. Mathews’ hands were shaking so badly the attendant had to take the money out of Mathews’ hands (Tr. V 1144).

    1) I understand that after the crime they had to get rid of the guns in a hurry, but after the first police search they had about 6 month’s to loose the guns permanently.

    3) Why keep the overalls ?
    Well the money, OK I can uderstand.
    4) Leaving the silencer at the crime scene, which was fabricated with duck tape which would almost certain contain fingerprints.

    Don’t get me wrong, I do think he is guilty, but that stupid?
    Most criminals are no Nobel price winners, but this is out of a crime scene TV show.

    The supreme court overruled the conviction and death sentence of Robert Acuna because he was 17 years 11 months old when he executed my grandparents and stole their car. He now will have double life sentences without parole. I can only imagine what nightmares the MacPhail family has been through since this has been an ongoing thing for 20 years. As the family of a police officer they deserve more than anybody peace and justice. Race was never an issue in my grandparents case although Acuna was of hispanic ancestory. Amnesty International made it very hard for our family to rest, as they would taunt my family in the courthouse and the internet and demand this cold blooded murderer not be executed as a jury concluded. All I have now is the memories of my grandfather taking us fishing in the swamps of Louisiana, and his very unique sense of humor. My grandmother would help anybody if they asked for it. I hope the MacPhail family can now move on, and enjoy the way of life that their father helped protect. For once, I am glad to see the Supreme court was on the side of the law and not emotional based protest by Amnesty International.

    It’s another hot sunshiny afternoon in Texas and the radio just announced it’s in the 100’s once again. Most of the time I have ear plugs in and headphones on with the music as loud as it can go so I can have peace of mind and no one else can get inside my head. But today I was caught off guard and heard some real sicko talk that had the blood boiling. Let me explain it. The sick twisted poster child for the death penalty is “Steven Long”… he raped and killed a precious little girl out of my hometown Dallas… and he blames his actions on his alter ego he has named Pretty Boy. Well he was in the rec cage telling another baby killer he won because he’s now able to say he’s mentally retarded… “A low I.Q. Score”… all I can say is if I had magic powers or one wish it would have been to be put inside that rec cage with this tough guy who preys on little girls. I will now keep my ear plugs in and radio turned up… that ruined my happy place. We have another execution tonight and from the sound of the news reports Texas is to score on this night…

        • They complain that her lawyer was so incompetent that out of 39 death penalty trials, he lost 20 of them. However, that means he won 19 of them or almost 50% which is a damn good record. By win, I think they mean kept off death row. These cases are so horrendous and they are supposed to be well prepared and investigated before they decide to go forward. Therefore, the defense really should lose. So, if that is his record, it’s really really good.
