SCOTUS made exactly the right decision:
The Supreme Court noted that it could not grant a stay to allow for the possible passage of the Leahy bill. “Our task is to rule on what the law is, not what it might eventually be,” the court ruled.
The court also discounted arguments that “grave international consequences” may follow Leal’s execution.
“We have no authority to stay an execution in light of ‘an appeal of the president’ presenting free-ranging assertions of foreign policy consequences, when those assertions come unaccompanied by persuasive legal claim.”
Predictably, the four activist Liberal judges who believe that we should consider foreign law when ruling on US laws and cases voted in favor of the illegal immigrant rapist/murderer. Talk about being on the wrong side of an issue. Meanwhile, Obama has succeeded in making Governor Rick Perry look tough on criminals while upholding the laws he was elected to uphold, and himself, more concerned about foreign governments, and murdering rapist’s over the victims family and justice.
And without SCOTUS stepping in, there was no way Governor Rick Perry was stepping in. Which means that Texas was finally able to carry out the death sentence that the people of Texas have demanded for brutally raping and killing one of our children. Yep…he’s dead Jim.
No word yet on his final meal. Though I’m certain some chickens likely had to give up their lives for this POS’s final meal. Dead men walking always seem to want chicken at their last meal. UPDATE: Yep chicken for his FINAL MEAL: fried chicken, tacos, fried okra and a bowl of pico de gallo.
Leal had maintained his innocence all along, claiming that he did not kill the 16-year old Adria Sauceda, and his friends and supporters have been echoing his claims of innocence. At least with his dead, those ridiculous claims can all be laid to rest, as Leal used his dying words to (finally) admit his guilt:
I have hurt a lot of people,” he said. “Let this be final and be done. I take the full blame for this. I am sorry and forgive me, I am truly sorry.”

The conservative Justices on the SCOTUS were, as usual, entirely correct in their decision. That especially includes their scolding of Congress for not putting the treaty obligations into statute as expected of them by that deal in yet again more inexcusable delays with inaction on their obligation to act. As they said, they’ve had seven years since the ICJ decision and 4 years since the Medellin decision and–once again–they haven’t done it. It’s their job to apply law on the books, not what might get passed or not in a Congressional bill and they have no jurisdiction over this issue to compel Texan scumbags from breaching their treaty obligations until Congress acts as obliged to do by the treaty obligations. Kudos for them to put the jurisdiction to demand compliance with the ICJ decision against scumbag states who don’t wish to honor the treaty made by and in their name where it belongs–in the proper branch. That’s what Real Republicans in the federal judicial branch do..interpret the law as it is, nothing more and nothing less.
As for Leal, he’s a piece of maggot shit as I already told you repeatedly and he got what he deserved. You go to Texas and kill people like that, you can expect that fate and rightly so.

If you really examine this statement, you will see the flaw in it. Rights given to the States are fully separate from the Federal Government rights and responsibilities. Adherence to the Vienna Convention is not actually a law on our books as of this posting, as you correctly point out. However, even when it passes, it will only apply to Federal prisoners or political prisoners. The States will still have the right to conduct legal proceedings against those who break laws. The lines could be murky if the FBI should get involved, but if the State successfully prosecutes and convicts someone and the death sentence is handed down, the States will still be able to prosecute that sentence. Under no circumstances can the Federal Government put itself in a position to try and litigate on behalf of the States. Each State has its own legislative body for this purpose. Texas is not responsible for the position the Federal Government has placed itself in, and they did the right thing today.
If the primary concern about this is the safety of U.S. Citizens overseas, then perhaps we, as citizens, need to enter and leave these countries legally and not break any laws while in that country. I have traveled both south of our border and in parts of Europe. Based on parts of your writing, I am under the impression that you have as well. Neither of us went to another nation and decided to start “criming”. We successfully navigated in that nation, then returned home. The trick is not in getting the States to back up a weak policy by the U.S. Government, it is in having our citizens be good diplomats when overseas. If this happens, our nation and its citizens would not be in need of the Vienna Accord.

Moreover, when those in Texas guilty of the continuous conduct kind of piss poor attitudes toward the personal responsibilities, aimed high standards, obligations and best interest of the United States over a mere state within it never mind those we deal with, they deserve the contempt because they earned it.
I get it…they love Texas. Loving one’s home is admirable. But loving one’s nation is the primary duty. I will defend my country against all threats foreign and domestic, and quite frankly, they pose it by their behaviors as explained. And I’ll hit hard and harder than anyone jeopardizing the best interests of this nation.
It was not disputed in the Medellin case that these matter are an international obligation intended that the nation itself abide by them. Our separation of powers are a wondrous and intelligent design for our domestic handing and dealings of our affairs, but in international dealings, we deal with one voice. Nations don’t make deals with Texas or PA or another internal state–they have no recognition beyond what we give them internally within our nation. They make deals with the United States and all things and people within it and we make deals as Americans for our nation collectively in that regard.
It works the same with other signatories like Mexico with these treaty obligations at issue. Like us, they have a federal and state system. What happened here would be similar to witnessing a US citizen getting detained, prosecuted and punished in the Mexican state of Tamaulipas bordering Mexico under the rotten Mexican system without any consular notification or assistance, then us finding out after the damage is done, then requesting Mexico to honor the agreement and ICJ remedy for such a breach, and having some official in Tamaulipas claim those treaty obligations don’t bind them due to a procedural default in the Mexican federal system.
If we got that kind of runaround, we’d be seriously pissed off and called the whole matter an act of bad faith and a breach. We expect Mexico to honor its deal, that’s it with no ifs, ands or buts. We made no deal with Tamaulipas and instead Mexico in its entirety, including that state no matter how cute and smartass they people in Tamaulipas wish to claim otherwise.
If you look and read Medellin in full as well as past cases like the Breard and LaGrand decisions, etc, it is not disputed that these obligations are intended to be binding upon the whole nation as such, whether the actual exercising authority is the fed, state or local entities.
Indeed, due to Congressional defaults here, Texas is legally allowed to do what it has done according to our laws. But these treaty obligations were undoubtedly undertaken by Texans because they are part of the USA and it was undertaken by and in its name. There is no ‘Texas’ here insofar as this deal…it’s just a case of Americans not honoring the deal no matter how internally the blames or bad faith actions are that result in it.
In that aspect, Texas is in the wrong. It’s no secret the nation called upon you to do the right thing here when Congress had not for a deal made in all our names. It’s been long explained–even pleaded–by bipartisan people including Presidents that Texas do the right thing given Congressional defaults. It’s been pleaded how breaching this treaty can lead to serious consequences with how our citizens might get treated abroad if we breach this treaty.
You let us down on that. You let your country and fellow citizens down on that, possibly with future negative cost to the nation and fellow citizens. All that is asked is that you be good Americans to Americans first and foremost, even when other Americans won’t be good Americans in Congress. You should have risen to the occasion, not joined them in breaching the deal. It would have done our nation a great service rather than put fellow citizens abroad at risk and sully the national reputation for making deals with others.
Do the right thing. Both could have been accomplished here insofar as serving justice on this scumbag and serving justice to the nation.
One last thing there for you. Yes I travel. I also try to be a good ambassador for this country when I travel by obeying local laws where I travel like yourself. But as you know, there are loads of countries with very deficient justice systems, corruption problems and anti-American bias…all of that no secret to you. That certainly exists south of the border.
If some US woman is about to get beheaded over some bullshit claims and sharia law in Saudi Arabia and we never knew or tried to assist or intervene because we weren’t notified and able to offer assistance, that’s a problem. If Hugo Chavez or some other anti-American douchebag wants to rig an arrest of an American for political theater, that’s something I want to have this treaty in place to address. If some corrupt cop wishes to detain a US citizen because he wants bribes I want to know about that as a US consular official.
The last thing nearly happened to me in Brazil. I did nothing wrong. The cop wanted to shake me down for money because I was a ‘rich American’ in his view. I have always kept my consular information with me ever since to call for assistance if I need it.
I’m not worried about us honoring this deal on our end because we have a good justice system. It’s Americans abroad who stand to benefit, and hence why as a pro-DP guy I want that treaty honored.
