UPDATE: Sigh. And un-fucking-believable.

You’ve probably heard by now, but the murdering piece of shit has received his third stay at the last minute. That’s three trips from death row in Livingston down to the death chamber in Huntsville, and three return trips back to Livingston. All in the same year.

A former Army recruiter who for the third time this year was hours away from his scheduled execution for the rape-slaying of a woman in Fort Worth nearly 10 years ago was granted yet another reprieve by the U.S. Supreme Court on Tuesday.

Cleve Foster, 47, was set to die Tuesday evening in Huntsville.

The high court twice earlier this year stopped Foster’s scheduled lethal injection. The latest court ruling came about 2 1/2 hours before Foster could have been taken to the Texas death chamber.

Foster was meeting with one of his lawyers in a small holding cell a few feet from the death chamber when a Texas Department of Criminal Justice spokesman delivered the news.

The court’s brief order said the reprieve would remain in effect pending the outcome of Foster’s request for a review, known as a petition for a writ of certiorari. If the writ is denied, the reprieve is lifted, clearing the way for a new execution date to be set.

Justice has been (once again) delayed. But rest assured, his day of final judgement is coming. And it will be soon.

Remember Cleve Foster? Iv’e written about him twice here (once in January and once again in April)? He’s the thug who has already had two death sentences stayed at the last moment by SCOTUS this year.

Well, tomorrow night, it looks like Foster’s luck is about to run out, as he has a third date with the Gurney this year.

In case you’ve forgotten the details of his crime, the Texas Attorney General’s office has ‘em for you:

Cleve Foster, a former army recruiter, and his co-defendant, Sheldon Ward, met Pal one night in a Fort Worth bar. They followed her home, then kidnapped and raped her, and shot her.

Pal’s nude body was found the next morning in a remote wooded area, with a gunshot wound to the head. Evidence led to the arrest of Foster and Ward.

At trial, DNA results showed that Foster sexually assaulted Pal. Pal’s blood could not be ruled out as the source of the blood stain on the front seat of Foster’s truck. Ward’s bloody clothes were found in the trunk of his car and a cooler filled with a soapy bleach solution and containing items such as Foster’s boots and leather gloves was found in the bed of Foster’s truck.

In the punishment phase of the trial, Foster’s statement to police, in which he related circumstances surrounding another murder, that of Rachel Urnosky, several weeks prior to Pal’s murder, was read to the jury. In the statement, Foster admitted that he had had sex with Ms. Urnosky the night of her murder, but claimed Ward was her killer. Ms. Urnosky was found dead in her apartment, also from a gunshot to her head. Foster and Ward were charged with the Urnosky murder, but were first tried for the Pal murder.

Well, tomorrow night, shortly after 6:00 pm HTT, Cleve Foster will finally be put to death for his crimes.

And if that’s not enough to get the antis blathering more than usual, there is a second execution the very next night, when Lawrence Russell Brewer will be executed for the 1998 torture and murder of James Byrd, Jr., in a case that drew national attention. Brewer was one of three men (along with Shawn Berry and John King) who dragged Byrd behind a pick-up truck along an asphalt road after they wrapped a heavy logging chain around his ankles. Byrd was pulled along for about two miles as the truck swerved from side to side. Byrd, who remained conscious throughout most of the torturous ordeal, was killed when his body hit the edge of a culvert severing his right arm and head. The murderers then drove on for another mile before dumping his torso in front of an African-American cemetery in Jasper.

      • One of Brewer’s co-defendants, Shawn Allen Berry, who was the only one of the three thugs not to receive the death penalty, is serving life without parole.

        Which did not stop a thug-lover named Christie Marcontell to marry Berry by proxy — which means after he was tried, convicted, and sentenced for life for his role in the crimes (he drove the freak’n truck…so how he avoided the death sentence is beyond em).

        What kind of sick woman marries a man like that, knowing full well what he’s done, the evil that he is capable of, and that they will never, ever be together again? Does a sick woman like that not believe she deserves to be married to a man that she can actually hold, touch, LIVE WITH, and who isn’t a brutal killer?

        • I believe he got life WITH the possibility of parole. As to why he got a deal and not death — he flipped and testified against the other two.

        • Years ago, I and others noticed that racists are quite popular among the death row groupies. I vaguely remember that CCAP which publishes these lonely hearts ads for these thugs included a “whites only” in John King’s ad. They were called on the carpet for it by pros and I think it was removed.

      • I totally agree. And Brewer and his posse are what I consider the worst of the worst for what they did to James Byrd. White trash at it’s finest.

    (My thoughts go out to the victims of this brutal killer, and hopefully, THIS time, justice will finally be served and they can move on and heal)

    • If I remember correctly, the other times the defense filed late and the court did not have sufficient time to review the case. They lifted the stays shortly after.

      This time I suspect it’s b/c they granted cert in a case with a similar issue and will stay Foster until they review that case. I forgot the name. It’s from Arizona and is set for oral argument o 10/4.

      • I just keep thinking of the Steven Woods execution, and from what I read there was limited evidence showing Steven did that, (Im not at all saying he was innocent) just thinking about his case v/s this one where there was a gun and DNA that did match Foster and this is his 3RD stay? Im not understanding our system right now at all. I think I should have went to Law school not Med school lol.

        • There was a shit load of evidence against that thug Woods.

          Again, the other two times the USSC ran out of time. It’s not like the entire court stops what it is doing just to handle one asshole’s case. The last stay has to do with a more technical issue. I tried to link the TCCA dissent which explains it but Robbie’s software hates me.

        • To be clear, they have full calenders and other cases to handle. When they get a late appeal, they still need sufficient time to review it before they can say granted/denied.
