On August 15, 1996, in San Antonio, Anthony Bartee murdered his friend, 37-year-old David Cook, by shooting him twice in the head with a 9-millimeter pistol and stabbing him in the neck. Bartee then stole Cook’s red Harley Davidson motorcycle and fled the scene.
According to testimony at his trial, Bartee, who was out on parole for two counts of Aggravated Rape, had previously solicited two friends to help him murder and rob Cook.
Bartee was originally scheduled to be executed on February 28, 2012, but received a reprieve on February 23, 2012 when District Judge Mary Román withdrew the execution warrant so that additional DNA testing could be conducted on strands of hair found in the hands of the victim, David Cook. Those DNA test have been conducted, and they were not exculpatory, so the execution should still be a go on Wednesday.

Sentenced to 10 years and 33 years for two counts of Aggravated Rape out of Bexar County. Bartee was on parole when he committed the offense of capital murder described here.
Here’s a thought — maybe we keep violent criminals…the rapists and murderers, especially…in prison for their full terms without parole. If Bartee had served his full term for rape, he’d still be in prison today and Cook would still be alive.

David Cook was my brother. My brother did not know any gang members. My brother was a professional. I sat through the entire trial. My family has been through hell for the past 16 years and are waiting for this chapter of our lives to be closed. Anthony Bartee was not framed and he is not innocent. He had to remove the keys to the motorcycle from the chain my brother kept on his belt loop (after he was murdered). He could not even open the garage to get the bike out more than a quarter of the way to get it out because it was locked. Do you honestly think two gang members would murder someone and let a “witness” flee.

I agree that we are not a culture of Racist. I have a teenage daughter and her best friend who calls me “mom” is one of the most beautiful human beings on the face of the earth and she is black. She is at my house almost every weekend and my daughter is at hers almost every day after school. I am not racist in anyway. I do not like the race card thrown out especially in this case. I sat through that entire trial. I had to stifle my cries when they showed the video of them turning my brother over and they bullet falling out of his cheek. My brother was my bestfriend and if I had any doubt in mind that this was the man that killed him I would be voicing my opinion.

Linda….. I work in The Woodlands but live in the Clear Lake area. I grew up in Montgomery county and spent my fair share of time in Huntsville. At one point I would go to every execution, not because I like the killing, but because I always fealt the families of the victim deserved to have someone looking out for them. You call and I will be there. If you feel intimidated or affraid in anyway becasue of the anti’s, who will be on hand, it would be my pleasure to throw the intimidation back in their direction.

People are talking about the so called “decline” in executions in Texas. That obviously cannot be the case since the total this year, as far as the schedule goes, would bring the yearly tally to 13. David Dow is a scumbag. Apparently he filed an additional request for DNA testing yesterday and did not serve the prosecutor with it. I am sure it was an “oversight,” on this snakes part. Wow thank God the prosecutor’s office is on top of things or this could have been granted due to no response being filed due to them not even knowing that the document existed. I WILL SAY IT AGAIN DAVID DOW IS A SCUMBAG NO WONDER HE IS REPRESENTING BARTEE.
David Dow has reached the point where the only thing he can do in this case is to throw sh!t at walls and hope that something can stick and make the court take notice. I think they have tried the ‘tard card, the DNA card, and even the I did not get my Malibu Barbie when i was growing up card….

Bartee has tried the DNA card twice (most recently got a reprieve in February for the second round of DNA testing) and failed both times. It is throwing Jello to the wall at this point to try it three times. Can the court file a complaint with the State Bar? His attorney is getting real close to ethical misconduct if not already there.
I was just going to ask if Bartee had any appeals going–thanks for the info. (But are there any other appeals besides this stuff?)
He has filed a request to Appeal to the 5th Circuit and the AG’s office has filed a response early today. He has also filed in the CCA as well and I believe the prosecutor has filed his response to that. The DA just found out about the request for DNA testing and is in the process of responding to that. I am not sure if there are any others that he has “failed to serve” on the DA. He will be filing appeals until they put the needle in. As you can tell I am ANGRY now.
We are angry for you. Always a last minute sham. Enough years have passed with all these bogus appeals. This waiting until the last minute garbage is deplorable.
Fortunately (for those of us who seek justice) the 5th Circuit doesn’t grant too many stays and the USSC even fewer. The CCA one seems to be nothing more than to gain time (file one down there then ask a higher court for a stay to review that issue AFTER it refuses a prior appeal).

To the extent that this can be called “a good thing”, DP filings where an execution is imminent will jump the line ahead of others. And since the courts already have the prior data they usually rule quickly (and way more often than not they rule not to grant the stay).

I do have a real job and if they do not know the facts surrounding the issues then they should not be putting their input in. I am hopeful that before midnight tonight we have justice for my family.
We should go back to hangings or the firing squad. I’m constantly amazed each time I see an amoral, unthinking, liberal pro-choice scumbag attack the death penalty. This guy had FAR more chances in life to get his act together than our Founding Fathers intended. In the 1700′s, this guy would have been hung after the first rape offense. Thanks to liberal judges and idiotic parole boards, people are unnecessarily hurt and killed every day by repeat offenders. The blood is on their hands, too.
Judge Fred Biery granted a stay. We are appealing to the 5th Circuit to vacate the Order. We have until midnight.

Oh not again! He’s had two unsuccessful rounds of DNA testing. Someone needs to refer his attorney for disciplinary action.
30 minutes until 6 PM, maybe the 5th Circuit will stop this silliness. (We do have until midnight so there is still hope…)

The fifth circuit will not be overturning the district court’s decision to halt the execution today. Bartee heads back to 12 building at Polunsky.

I blame the USSC. A defendant is required to ask for post conviction dna testing through Art. 64 which was amended last Sept to make it less restrictive. However, they still require that there be some logic to the request for additional dna testing. Now, post Skinner, if it is denied, all the defense has to do is file a last minute claim under 1382. It’s all about delaying. Anyway, the feds are going to have to put some restrictions on the bullshit that they opened the door on. The abuse was predictable.

it’s just a matter of time. They didn’t rule on it and asked for briefing. This will be done and it is being expedited. I am upset but have determined that the third time is the charm. The more time he sits on death row knowing his judgment is coming is comforting to me. Can’t be very pleasant.
He will be executed in that there is no doubt about his guilt. There is plenty of room to add him to the execution calender.

Their drugs are probably past their expiration dates.
I hate it that no U.S. or other manufacturer has stepped up to supply the needed drug. If the method is altered, it opens up a whole new series of challenges that will delay justice.

Why? We all know they will never use it. Perhaps they intend to sell it with a mark up…a handlers fee, if you will.
It’s the federal judges who have unnecessarily held up executions in CA.
They should try to get one of their state hospitals to buy it from the wholesalers (since it does have medicinal purposes) then have their criminal justice department buy it from the hospital.

My hope is for the 5th Circuit to issue an opinion quickly and for Texas to set another date immediately. The defense will file an appeal with the USSC. However, with a date set there are less delays. The USSC term ends in June. With a date set, if an appeal is filed and they intend to not grant cert, they will deny it immediately. Without a date set, they may wait until Fall to deny it.
one life spent in jail. oh wait, if he can get out after rape charges why not murder right? Our justice system is bonkers.
Think on the bright side, he would have suffered knowing he had hours left. He also knows he will not escape destiny, so he will have to suffer again.

I am so sorry for your family’s loss. I am one of Anthony Bartee’s rape victims. I was only 15 years old, he was 25. He received 33 years in prison for my rape and another 10 years for another vistims rape.
Unfortunately he was allowed to serve them concurrently instead of consecutively.
Within 1 year of his release he had absconded from justice and was arrested for murdering your brother.
When I was raped, he was in violation of his parole/probation from California for roberry (2 counts if I’m correct). He did not have permission to be in the State of Texas at that time. He used a knife on me to ‘prove’ to me he would kill me. He threatened to have the Bandidtos get me if I told anyone what happened. Then, after he was done, he actually asked me to be his girlfriend. He is a sick, sick, sick person.
I know first the harm this monster is capable of inflicting on others. He has always denied he raped me. It doesn’t shock me that he denies killing David either. I have absolutely NO DOUBT of his guilt! I testified at the sentencing hearing of your brothers trial as a character witness against Anthony Bartee. I was glad he received the death penalty. I can’t begin to imagine the suffering your family has gone through and the loss you have endured. I feel for you deeply.
I know that he stole a lot from me but I was lucky enough to survive. I have refused to let what he did to me define my life, but it has certainly affected it. I too hope the third execution date is the charm! Along with you, I have waited for over a decade to see him executed. It is emotionally exhausting to go through the mental process to prepare for this once, let alone two or three times. I wish for you peace, safety and justice. Those are things I wish for in my life.

So well said, Kanna. I cannot say how deeply it saddens me to hear what you went through but also, it comforts me to know beyond a doubt for a fact that we are not alone, and that he IS GUILTY. You of all people know why we are doing this, why we care as much as we do about this. So glad it hasn’t defined your life <3 you're amazing.

I am so sorry that Bartee took so much from you. I appreciate that you testified at his sentencing. You are brave and amazing beyond belief. Still waiting on Biery to do something. All testing has been completed once again but of course David Dow is arguing that Bexar County Crime Labs can not be trusted (as you can tell the testing once again came out in our favor).
All I can say to you Kanna is THANK YOU from the bottom of my heart. My family appreciates your bravery.

If Bartee had served his full term for rape, he’d still be in prison today and Cook would still be alive. ” Yes, Cook would still be alive. Here is the kicker . . . Where in AMERICA are the rights of the innocent people who add to society in a postive way each day. I’ll be brief. A few years back some jerk off in Nevada decided a scum bag who did a triple murder (and he was IN FACT GUILTY) shoule get out of prison after 14 years. Really? Really!? What did the convict do? Glad you asked. He drove to Pennsylvania and murdered a woman and her daughter within 2 weeks of his relased from prison. Nice. At some point, probably not in my lifetime, people will wake up and start to realize the rights of the victims.
